Peraturan Pemerintah 11/2026 (Peraturan Pemerintah Nomor 11 Tahun 2026 tentang Penempatan Dana pada Bank dan Pelaksanaan Kewenangan dalam Penyelenggaraan Program Restrukturisasi Perbankan oleh Lembaga Penjamin Simpanan) is an Indonesian government regulation on the placement of funds in troubled banks by the Deposit Insurance Agency (Lembaga Penjamin Simpanan, LPS) and on the powers the agency exercises when it runs the Banking Restructuring Programme (Program Restrukturisasi Perbankan, PRP). It was signed by President Prabowo Subianto and promulgated on 11 March 2026 as Lembaran Negara 2026 No. 22, and took effect on promulgation.[1] It belongs to the body of rules described at financial sector regulation in Indonesia.
The regulation implements Pasal 20B ayat (9), Pasal 20C ayat (4) and Pasal 41 ayat (4) of the financial crisis law, Undang-Undang 9/2016 on the prevention and handling of financial system crises, as amended by the financial sector law, Undang-Undang 4/2023.[2] The elucidation describes the power to place funds in a bank under remediation that has a liquidity problem and cannot obtain short-term liquidity support from Bank Indonesia as a new mandate given to LPS by that amendment.[3]
It has 105 articles in ten chapters. The first part governs fund placements in systemic and other banks, capped in total at 30 per cent of LPS's assets; the second governs the PRP, which the President decides to run on the recommendation of the Financial System Stability Committee in a financial system crisis, and gives LPS the powers of the bank's organs together with resolution tools that include loss absorption, conversion of liabilities, temporary equity participation, bridge banks and liquidation.[4][5][6][7] CRPG's regulatory tracker published an analysis of the regulation in July 2026.[8]
The regulation defines the PRP as a programme for handling banking problems that endanger the national economy, and a systemic bank (Bank Sistemik) as a bank whose size, capital, liabilities, network, transaction complexity or links to other financial sectors mean that its disruption or failure could bring down other banks or the financial services sector. A financial system crisis is a condition in which the financial system fails to perform its functions effectively and efficiently, shown by deteriorating economic and financial indicators.[9] Its scope is the placement of LPS funds in banks designated as under remediation (Bank dalam penyehatan), including LPS's powers over banks that receive them, and the exercise of LPS's powers in the PRP.[10]
Coordination runs through a forum of LPS, the Financial Services Authority (Otoritas Jasa Keuangan, OJK) and Bank Indonesia, in which the secretariat of the Financial System Stability Committee (Komite Stabilitas Sistem Keuangan) takes part and whose results are reported to the committee.[11]
A systemic bank under remediation that has a liquidity problem and does not qualify for Bank Indonesia's short-term liquidity loans or sharia financing may apply to OJK for a placement of funds. After assessing the application, OJK may ask LPS to place funds, directly or indirectly through an LPS guarantee of a placement by another systemic bank; placements in sharia banks follow sharia principles.[12] The application must be backed by collateral from the bank or its controlling shareholder, valued by a public appraiser and verified by a public accountant, and must include the bank's funding needs, an action plan and repayment plan, and a statement by the controlling shareholder that it cannot resolve the problem itself.[13] Bank Indonesia assesses the bank's payment-system record and the condition of the financial system within three working days, after which LPS decides whether to place funds.[14]
A bank receiving a placement is subject to LPS's powers to examine the use of the funds, prohibit certain actions, appoint technical assistance, order shareholders to replace directors or commissioners, and appoint a statutory manager.[15] Under Pasal 24, LPS may order a replacement where a director or commissioner obstructs the examination, breaches a prohibition attached to the placement, makes insufficient efforts at remediation, or is found to have committed violations that could harm the bank.[15:1] Most of these rules apply equally to banks that are not systemic (Pasal 29).[16] Pasal 30 caps total placements in all banks at 30 per cent of LPS's assets, a figure that may be changed by government regulation.[4:1]
In a financial system crisis with banking problems endangering the national economy, the Financial System Stability Committee recommends that the President decide to run the PRP, including the criteria for banks to enter it. Once the President so decides, LPS runs the programme, OJK hands over qualifying banks to LPS with their documents, and the power to take remedial action passes from OJK to LPS, while OJK continues to supervise the banks.[5:1]
LPS takes over all rights and powers of the shareholders, general meeting, directors and commissioners of a bank in the programme, and may appoint others to manage it or transfer its management (Pasal 35 to 38).[6:1] It may examine the bank, manage and sell its assets, collect its receivables, and review, amend, cancel or terminate its contracts.[6:2]
Pasal 68 authorises LPS to determine a participating bank's losses and charge them to its capital. Any remaining loss is charged first to subordinated liabilities carrying a write-down or conversion feature, and then to remaining liabilities held by controlling shareholders and affiliated parties, by conversion into paid-up capital. If capital is then positive, shareholders keep their shares; if it is negative, LPS cancels their shareholdings by recalling the shares without compensation.[7:1] LPS records its decision on losses, the amount absorbed, the new value of the shares and the status of shareholders, notifies shareholders, announces the decision, and, for a listed bank, informs the stock exchange and OJK (Pasal 69).[7:2] Pasal 70 exempts the exercise of these powers from company, banking and capital-market law, including requirements for shareholder approval, creditor objections, share buy-backs and the rules on mergers, acquisitions and consolidations, and Pasal 71 charges losses caused by fault or negligence to the directors, commissioners or shareholders responsible.[7:3]
The further tools are conversion of liabilities to certain creditors into capital, with exceptions that include tax obligations, depositors, other banks, Bank Indonesia, OJK and secured creditors; suspension of payments; temporary equity participation, open to the former controlling shareholder if it pays in the required capital; loans and loan guarantees; and the transfer of assets and liabilities to a receiving bank or to a bridge bank (Bank Perantara) that LPS establishes and must later sell at fair value in an open process.[17] Mergers and consolidations are also available, and where assets and liabilities have been transferred, or LPS decides to liquidate, LPS asks OJK to revoke the bank's licence and liquidates it under the deposit insurance law.[18]
LPS reports on the programme to the President through the Financial System Stability Committee once a month and at other times on request.[19] A bank that has been restored is returned to OJK (Pasal 102). When the committee considers that the banking problems have been resolved, it recommends that the President end the programme, which is done by presidential decision (Pasal 103).[20] Existing rules on LPS's powers remain in force so far as they are consistent with the regulation (Pasal 104).[1:1]
The regulation leaves several matters to regulations of LPS, among them the procedure for taking over the powers of a bank's organs and for charging losses to capital, and leaves the documents for placement applications to OJK regulation.[6:3][7:4][13:1] OJK's rules for sharia banking investment products, POJK 4/2026, issued in April 2026, provide that those products are not guaranteed by LPS.[21] Other OJK regulations of 2026 include POJK 3/2026 on securities companies and POJK 6/2026 on financial information communicators, which names LPS as an example of an authority whose own communications fall outside that regulation.[22]
