Peraturan Otoritas Jasa Keuangan 6/2026 (Peraturan Otoritas Jasa Keuangan Nomor 6 Tahun 2026 tentang Perilaku Penyampai Informasi Sektor Jasa Keuangan) is a regulation of Indonesia's Financial Services Authority (Otoritas Jasa Keuangan, OJK) that sets standards of conduct for people and organisations other than licensed financial firms who communicate information about financial products and services to the public. It was signed by the chair of OJK's Board of Commissioners on 26 May 2026 and took effect on its promulgation on 4 June 2026.[1][2] It is part of the body of rules described at financial sector regulation in Indonesia, and was issued under the OJK Law, Undang-Undang 21/2011, as amended by the financial sector law, Undang-Undang 4/2023.[3]

The regulation creates the category of Penyampai Informasi (information communicator), which covers anyone outside the licensed sector who conveys financial information with the aim of raising financial literacy or influencing consumers' use of financial products. It sets basic rules of conduct for all such communicators, classifies their activity as financial education, marketing or recommendation, and attaches separate disclosure duties to each.[4][5][6]

Marketing by a communicator must be done in cooperation with a licensed financial services business, which carries eight obligations and faces administrative sanctions of up to Rp15 billion for breaching them.[7] Against communicators themselves, OJK's tools are guidance, written orders and requests to the communications ministry to take down electronic content.[8] Existing marketing arrangements were given six months from promulgation to conform.[9] CRPG's regulatory tracker published an analysis of the regulation in August 2026, and it was issued in the same half-year as other OJK regulations on securities firms and sharia banking products.[10][11][12]

Background

The preamble states that public trust in the financial system must be maintained through legal certainty, transparency and accountability in the information that financial information communicators convey, and that rules on their conduct are needed to prevent losses to consumers and the public.[3:1] The general part of the elucidation (Penjelasan) links the regulation to the growing reach of people who convey financial information through digital channels and to the use of that reach by parties seeking private gain without regard to the risks for consumers. It describes OJK's supervision of communicators as monitoring based on risk (responsive oversight).[13]

The regulation is short: seventeen articles in eleven chapters, followed by an article-by-article elucidation.[1:1]

Definitions and scope

Pasal 1 defines a financial services business actor (Pelaku Usaha Jasa Keuangan, PUJK) as a financial services institution or another party that collects, channels or manages funds in the financial services sector, whether conventional or sharia-based. A Penyampai Informasi is any party other than a PUJK that conveys financial sector information intended, directly or indirectly, to raise financial literacy or to influence consumers and the public in using products and services. Information (Informasi) covers statements, data, facts and explanations in any packaging or format, through electronic or non-electronic media.[4:1]

Pasal 14 excludes two kinds of communication from the regulation: information conveyed by professions outside the financial sector in the course of their professional duties and subject to a professional code of ethics, and information initiated by the government or an authority within its statutory functions.[14] The elucidation gives teachers acting within a curriculum and journalists engaged in journalism as examples of the first, and Bank Indonesia and the Deposit Insurance Agency as examples of the second.[15]

Conduct standards

Pasal 2 requires every communicator to act in good faith, to be responsible for the information conveyed, and to give information that is clear, accurate, honest, easily accessible and not potentially misleading. Communicators may not promise certain profits inconsistent with a product's characteristics, compare products without balanced analysis, publicise or market products that lack a required OJK licence, or cooperate with unlicensed financial businesses.[5:1] The elucidation adds that information produced with artificial intelligence should say so and be verified by a person before publication.[16]

A communicator that obtains an economic interest from its activity must declare it (Pasal 3). Pasal 4 requires risk statements and disclaimers when a communicator speaks about high-risk or complex products or about peer-to-peer lending for lenders; a lighter set of statements applies to peer-to-peer lending for borrowers and to buy-now-pay-later services.[17]

Education, marketing and recommendation

Pasal 5 divides the activity into financial education (edukasi keuangan), marketing (pemasaran) and the giving of recommendations (pemberian rekomendasi), conducted face to face or remotely.[6:1] An educator may present simulations, provided the calculation formula is shown with a disclaimer that it is only a simulation, and must identify itself (Pasal 6).[18]

Under Pasal 7, a communicator that markets products must do so in cooperation with a PUJK. The PUJK must ensure that the communicator discloses its identity and its relationship with the firm before conveying information, that marketing is confined to the products named in their agreement and licensed by OJK, that the communicator has the necessary skills and qualifications, that consumer data is not misused, and that complete product information is supplied; the firm is also responsible for what the communicator conveys and must evaluate the marketing periodically. A communicator may market crypto-asset products to the public only through the PUJK's official media.[7:1]

Pasal 8 governs recommendations. A communicator that must be licensed under sectoral law must hold the licence; one that recommends digital financial assets without a licence requirement must hold a certificate of competence; and a recommendation of a digital financial asset must be confined to assets on the exchange's list and to licensed firms.[19] OJK provides a learning-management system for financial education, which communicators may use (Pasal 9).[20]

Supervision and enforcement

A PUJK that breaches its obligations under Pasal 7 ayat (2) faces administrative sanctions ranging from a written warning through restriction or suspension of products or business, dismissal of management and a fine, to revocation of a product licence or business licence. Every sanction after the warning may be imposed without one, and the fine is capped at Rp15,000,000,000.[7:2]

Communicators themselves are not licensed by the regulation. OJK may take guidance measures against them, in the form of reprimand, direction or coaching (Pasal 10), and the regulation designates them as "certain parties" to whom OJK may issue a written order (Perintah Tertulis), non-compliance with which is sanctioned under the OJK Law (Pasal 11).[8:1] Under Pasal 12, where a communicator conveys non-compliant information through electronic media, OJK requests the minister responsible for communications to terminate access, ordinarily after guidance has gone unheeded but directly in an urgent situation that has caused or threatens what the regulation calls significant loss; OJK may announce the take-down publicly. The elucidation describes take-down as blocking access, closing accounts or deleting content, and gives fraud and the promotion of illegal products as examples of urgency.[8:2][21]

Transition

Pasal 16 required licensed firms and communicators that had entered into marketing cooperation before promulgation to adjust their arrangements within six months of promulgation, that is by 4 December 2026. Pasal 15 allows OJK to adopt a different policy on particular considerations.[9:1][2:1]

Relationship to other instruments

The regulation cross-refers to OJK's rules on written orders, on consumer and public protection and on trading in digital financial assets including crypto assets, and to sectoral rules on marketing and recommendations.[19:1][8:3] It was one of several OJK regulations issued in the first half of 2026; POJK 3/2026 on underwriters and broker-dealers and POJK 4/2026 on sharia banking investment products were both signed on 1 April 2026.[11:1][12:1]
