Peraturan Otoritas Jasa Keuangan 9/2026 (Peraturan Otoritas Jasa Keuangan Nomor 9 Tahun 2026 tentang Pelaporan Insidental melalui Sistem Pelaporan Otoritas Jasa Keuangan di Sektor Pasar Modal, Keuangan Derivatif, dan Bursa Karbon) is a regulation of Indonesia's Financial Services Authority (Otoritas Jasa Keuangan, OJK) on the submission of incidental reports through OJK's online reporting system by parties in the capital market, derivatives and carbon exchange sectors. It was signed by the Chair of the OJK Board of Commissioners on 15 June 2026 and takes effect on 1 October 2026.[1][2] It forms part of financial sector regulation in Indonesia and, through its coverage of the carbon exchange, of carbon trading and climate regulation in Indonesia.
The regulation requires reports prepared for OJK at particular times, as opposed to periodic reports, to be filed online, and sets rules on their correction, on system failures and force majeure, and on supervisory requests for supporting documents, each backed by a common scale of administrative sanctions.[3][4][5][6] It does not repeal the sector rules that create particular incidental reporting duties; its closing provisions keep them in force so far as they are consistent with it.[7] CRPG's regulatory tracker reported the regulation in August 2026.[8]
The preamble states that OJK developed its reporting system to obtain complete, accurate, current and timely data from all parties in the capital market, derivatives and carbon exchange sectors, and that simpler, digitised reporting was needed to support technology-based supervision.[9] The general elucidation adds that some incidental reports were still being submitted offline or on paper.[10] The regulation was issued under the Capital Market Law, UU 8/1995, and the OJK Law, UU 21/2011, both as last amended by UU 4/2026 amending the financial sector development law.[9:1]
Pasal 1 defines an incidental report (Laporan Insidental) as a report prepared for OJK at a particular time, and a reporter (Pelapor) as a party active in the capital market, derivatives or carbon exchange sector that is obliged by law to submit one.[3:1] Pasal 2 requires reporters to submit incidental reports that are complete, accurate, current and timely, and to submit them online through the OJK reporting system. It lists eighteen categories of reporter, among them stock exchanges, clearing and depository institutions, market operators, securities companies, custodian banks, trustees, crowdfunding operators, the directors and commissioners of those institutions, and public accountants, ending with any other party required to submit incidental reports.[3:2] Reporters must keep their own copies, and where these differ from the report held in OJK's database, OJK's version prevails.[3:3]
A reporter that finds an error in a report after its deadline must notify OJK in writing and, once OJK issues a correction request, file the correction through the system within five working days unless OJK sets another period.[4:1] Access to the system requires user rights, which a reporter must apply for within two working days of obtaining its licence, registration or approval; until the system or access is available, and during system failures announced by OJK, reports are filed offline and later resubmitted online. A reporter affected by force majeure may ask for a postponement within two working days, and a report counts as filed on the date OJK receives it.[5:1] Pasal 14 obliges reporters to provide documents relating to an incidental report on OJK's request in the course of supervision.[6:1]
Pasal 4, 7, 13 and 15 each attach administrative sanctions to breaches of the provisions in their chapter, extending them to any party that causes the breach. The scale is a written warning, a fine, restriction or suspension of business, revocation of the business licence, and cancellation of an approval or a registration; measures other than the warning may be imposed without a prior warning, and a fine may be imposed alone or with the heavier measures.[3:4][4:2][5:2][6:2] OJK may also take further action against a party in breach, announce sanctions to the public, and grant approvals or policies that differ from the regulation on particular considerations.[11] The same scale of sanctions appears in the carbon exchange provisions amended by POJK 10/2026.[12]
Pasal 19 keeps in force the incidental reporting provisions of twenty-five earlier instruments so far as they do not conflict with the new regulation. They range from decisions of the former capital market supervisory agency of 1998, 2004 and 2009 to OJK regulations on stock exchange, clearing and depository reports, investor protection funds, anti-money-laundering programmes and the use of public accountants, and include POJK 3/2026 on underwriting and broker-dealer securities companies.[7:1] The regulation comprises twenty articles in seven chapters, and Pasal 20 sets its entry into force at 1 October 2026.[2:1] The held text leaves the promulgation date and the Lembaran Negara number blank.[1:1]
Carbon exchange operators are covered by the regulation's definition of a reporter, while their periodic and event-based reporting duties to OJK are set by the carbon exchange regulation as amended in 2026, which aligned that regulation with Perpres 110/2025.[3:5][12:1]
