Peraturan Pemerintah 24/2026 (Peraturan Pemerintah Nomor 24 Tahun 2026 tentang Tata Kelola Ekspor Komoditas Sumber Daya Alam Strategis) is an Indonesian government regulation on the governance of exports of strategic natural-resource commodities. It provides that designated commodities, initially coal, palm oil and ferroalloy, may be exported only by a state-owned enterprise given a special assignment for the purpose, the BUMN Ekspor.[1] It was signed by President Prabowo Subianto and promulgated on 20 May 2026 as Lembaran Negara 2026 No. 58, and took effect on 1 June 2026.[2] It forms part of the body of rules described at trade and commodity regulation in Indonesia, and bears on mining and energy regulation through its coverage of coal and ferroalloy.

The regulation rests on the government's power under the Trade Law, Undang-Undang 7/2014, as last amended by Undang-Undang 6/2023, to set export policy and controls, and on the State-Owned Enterprises Law, Undang-Undang 19/2003, as last amended in 2025.[3] Its elucidation grounds it in Pasal 33 of the 1945 Constitution and reasons that, where the state has the capital, technology and management capacity, it should manage strategic commodities directly so that the proceeds accrue to the state.[4]

It has ten articles in six chapters. Besides the export channel, it allows the enterprise to set selling prices and a reasonable margin, provides for exemptions for businesses with contracts with the government that include investment, divestment and domestic processing commitments, and sets a transition ending no later than 31 December 2026.[5][6] CRPG reported on a circulating draft of the regulation on 20 May 2026 and published analyses of the enacted text in June and September 2026.[7][8][9]

Background

The preamble cites the constitutional principle that natural resources are controlled by the state and used for the greatest prosperity of the people, the government's export powers under Pasal 38 ayat (1) of the Trade Law, and the need to regulate the export of strategic natural-resource commodities to maintain domestic supply stability, national economic resilience, added value and sustainable development.[3:1] The general elucidation quotes Pasal 33 ayat (1) to (3) of the Constitution and describes direct management as the export of strategic commodities by a state-owned enterprise under a special assignment, intended to ensure optimal management while keeping supply stable.[4:1]

On the day the regulation was signed, CRPG published a report on an unsigned draft that had begun circulating among commodity businesses, titled as a regulation on strategic commodity exports through state-owned enterprises. The report stated that the draft named coal and palm oil, with other commodities to be designated later, and that CRPG could not verify its authenticity.[7:1] The enacted text, which bears a shorter title, adds ferroalloy to the initial list.[1:1]

Strategic commodities

Pasal 1 defines a strategic natural-resource commodity (Komoditas SDA Strategis) as a natural resource commodity designated by the government having regard to the national interest, economic stability, domestic need or the management of national strategic natural resources. A BUMN Ekspor is a state-owned enterprise that receives a special assignment (penugasan khusus) from the government to export such commodities.[1:2] The elucidation of Pasal 2 describes these as commodities that affect the livelihood of many people and serve an allocation, distribution or stabilisation function.[10]

Designation proceeds in stages. The initial stage covers coal, palm oil and ferroalloy (paduan besi). Further commodities are designated through a coordination meeting chaired by the coordinating minister for economic affairs, for non-food commodities, or the coordinating minister for food, for food commodities, attended by ministers and heads of non-ministerial agencies. In both stages the specific types of commodity are to be set by regulation of the minister of trade.[11]

Export governance

Under Pasal 3, designated commodities may be exported only by the BUMN Ekspor, either as owner or as sole intermediary (perantara tunggal). The enterprise determines the selling price and may set a margin within reasonable limits; the enterprise itself is designated under the law on state-owned enterprises.[1:3] Pasal 4 lists the instruments of export governance as export control, including verification or technical tracing, the regulation of export transport and insurance, and other mechanisms provided by law.[5:1]

Pasal 4 ayat (2) allows the channelling requirement to be waived for a business that holds a contract or agreement with the government containing at least provisions on investment, divestment and domestic processing or refining. An exemption is decided in a coordination meeting of the same form as for designation.[5:2] Further rules are left to the ministers and agency heads concerned, who are also responsible for guidance and supervision (Pasal 5 and 6).[12]

Transition

Pasal 7 provides that exports of the designated commodities may be carried out only through the BUMN Ekspor no later than 31 December 2026. Within three months of entry into force, the arrangement is evaluated in a coordination meeting chaired by the coordinating minister for economic affairs, who may, on the basis of the evaluation, set an earlier deadline. After the deadline, or earlier if the function has been fully transferred, only the BUMN Ekspor may export.[6:1] The elucidation of Pasal 7 describes exporting through the enterprise in the interim as including the reporting and submission of export documents and sales contracts to it through systems integrated with it, naming the customs system CEISA, the Indonesia National Single Window, the trade information system INATRADE, the foreign-exchange monitoring system SiMoDIS and the mineral and coal monitoring system MOMS.[13]

Sales contracts signed before 1 June 2026 and still in force are to be evaluated by the BUMN Ekspor (Pasal 8), and existing regulations on the export of strategic commodities are to be implemented in accordance with the regulation (Pasal 9).[6:2][14]

Relationship to other instruments

The regulation does not itself name the enterprise that is to act as BUMN Ekspor, nor list the specific commodity types, leaving both to instruments made under the State-Owned Enterprises Law and to regulations of the minister of trade.[1:4][11:1] CRPG's report on the draft noted that a company within the Danantara group had been incorporated the day before the draft began circulating, reported as a vehicle for mineral and coal exports, and stated that no official source had confirmed a link between that company and the draft.[7:2]
