Peraturan Menteri Energi dan Sumber Daya Mineral 14/2024 is an Indonesian ministerial regulation issued by the Minister of Energy and Mineral Resources on the licensing of groundwater abstraction. Its full title is Penyelenggaraan Izin Pengusahaan Air Tanah dan Persetujuan Penggunaan Air Tanah (administration of groundwater business permits and groundwater use approvals). It was signed on 2 December 2024 and promulgated and in force on 9 December 2024.[1][2]
The regulation implements Peraturan Pemerintah 30/2024 on water resources management, and sets the procedure for the two licences through which groundwater regulation in Indonesia divides abstraction: a business permit for commercial use and a use approval for non-business use. It ties the volume that may be licensed to the groundwater conservation zone in which a well sits, sets the regularisation route for wells operating without a licence, and revoked two earlier ministerial decrees on licensing service standards.[1:1][3]
In January 2026 most of its provisions on use approvals, competence development, supervision and administrative sanctions were revoked by Peraturan Menteri Energi dan Sumber Daya Mineral 4/2026, which kept the 2024 rules for applications already lodged.[4] The JDIH BPK database lists the 2024 regulation as no longer in force and revoked by the 2026 instrument.[2:1] CRPG's regulatory tracker covered the regulation in November 2025.[5]
Use of groundwater for business requires a groundwater business permit (Izin Pengusahaan Air Tanah); other use requires a groundwater use approval (Persetujuan Penggunaan Air Tanah). The minister is competent for groundwater in basins and other sources in river basin territories that cross national or provincial boundaries or are of national strategic importance, the governor for those crossing district boundaries, and the regent or mayor for those within one district or city. The minister's competence may be delegated by ministerial decree to the head of the Geological Agency, a governor, or a regent or mayor.[6] Business permits may be sought by state, regional and village enterprises, cooperatives, private firms and individuals, in sectors from agriculture and industry to tourism, health, education, infrastructure and housing; use approvals by individuals, community groups, government agencies and legal entities.[7] A use approval is needed for daily basic needs of 100 cubic metres a month or more per household or group, and for listed non-business activities such as construction dewatering, but not for smaller household use, government offices, places of worship or non-business smallholder farming.[8]
Business permit applications go through the OSS system and must be based on the applicant's spatial use conformity (KKPR). They carry the drilling coordinates, planned daily abstraction, well depth and diameter, a statement of willingness to build infiltration, recharge or monitoring wells, and a construction drawing. A complete application must be decided within 14 working days; an incomplete one must be corrected within seven working days or it lapses. Use approvals follow a parallel procedure through the ministry's online licensing application.[9] Neither licence carries a fee.[10]
Licences are issued on the basis of the groundwater condition recorded in the groundwater conservation zone (Zona Konservasi Air Tanah), which is either a protection zone in a recharge area or a utilisation zone classed as safe, vulnerable, critical or damaged, the classes set by Peraturan Menteri Energi dan Sumber Daya Mineral 31/2018.[11][12] For business permits, the regulation fixes the discharge that may be granted in each zone. In a protection zone, abstraction is capped at 25 cubic metres a day under what the text calls a Zero Delta Q Policy. In a safe zone the cap is the discharge shown on the zone map, and in a vulnerable zone it may not exceed the maximum shown there. In a critical zone the cap is 10 cubic metres a day. In a damaged zone no new permit may be issued, and a renewal is limited to 10 cubic metres a day.[13]
From unconfined aquifers shallower than 40 metres, business abstraction is capped at 10 cubic metres a day, unless deeper groundwater is scarce, brackish, saline or polluted, or the water is used directly for geothermal heat; in those cases the limit follows a technical evaluation that must avoid disturbing nearby community water sources. Use approvals are limited on the basis of verification and evaluation in all zones.[13:1]
A business permit holder must drill within one year, fit a water meter at the well outlet, build a recharge or infiltration well, and within two years build a monitoring well with an automatic water level recorder: one for every fifth production well at a site, or one where abstraction at a site reaches 5,000 cubic metres a day. Holders abstracting more than 10 cubic metres a day must report every six months through the online application, with monthly abstraction, six-monthly water quality analysis and monthly water level measurements.[14] A business permit runs for five years; a use approval for daily needs lasts for the life of the holder or the group, and other approvals for up to seven years, or one year for dewatering.[15] A holder whose licence lapses without renewal must close the well within 30 calendar days.[16]
Breaches lead to three successive written warnings of seven working days each, then temporary suspension, and then revocation if the breach is not corrected within 14 working days.[17]
Wells built or groundwater used without a licence before Undang-Undang 6/2023 on job creation took effect are subject to regularisation (penataan): the owner is liable to an administrative fine and must apply for a licence within three years of that law's entry into force, or close the well.[18] The fine follows the legislation on the energy ministry's non-tax revenue tariffs, and a regularised licence whose holder does not pay it is revoked.[19] The 2026 regulation later set out how that fine is calculated and collected.
