Peraturan Menteri Kesehatan 13/2026 (Peraturan Menteri Kesehatan Nomor 13 Tahun 2026 tentang Perubahan Kedua atas Peraturan Menteri Kesehatan Nomor 71 Tahun 2020 tentang Organisasi dan Tata Kerja Politeknik Kesehatan di Lingkungan Kementerian Kesehatan) is an Indonesian ministerial regulation that amends, for the second time, the rules on the organisation and working procedures of the health polytechnics (Politeknik Kesehatan, Poltekkes) run by the Ministry of Health. It was signed by the Minister of Health on 17 June 2026 and took effect on its promulgation on 19 June 2026, as Berita Negara 2026 No. 405.^[1] It concerns institutions of vocational higher education, and so forms part of education law in Indonesia as well as health sector regulation.

The amendment abolishes the administrative sections and subsections that had formed part of each polytechnic's structure, and reorganises its staff into functional and implementing positions and position groups, assigned individually or in work teams.^[2][3] It also requires polytechnic directors to apply the government's performance-accountability, risk-management and digital-transformation systems, and replaces the organisational charts in the annex.^[4][5] CRPG's regulatory tracker published an analysis of the regulation in August 2026.^[6]

¶ Background

A Poltekkes Kemenkes is defined as a technical implementation unit (Unit Pelaksana Teknis, UPT) of the ministry in the form of a higher education institution that carries out vocational education in the field of health. Vocational education covers diploma programmes up to the applied bachelor's degree and, where requirements are met, applied master's and doctoral programmes; professional education is education after the bachelor's degree for work requiring special expertise.^[7]

The preamble gives performance optimisation and bureaucratic simplification (penyederhanaan birokrasi), a theme of public administration in Indonesia, as the reasons for the reorganisation, states that the restructuring had been approved by the Minister for Administrative and Bureaucratic Reform, and presents the regulation as implementing Pasal 240 of the ministry's own organisation regulation, Permenkes 21/2024 as amended by Permenkes 17/2025.^[8] The parent regulation, Permenkes 71/2020, had been amended once before, by Permenkes 12/2023.^[8:1]

¶ Provisions

Article I amends the parent regulation in twenty-two points. It restates the definitions in Pasal 1, and deletes letter b of Pasal 11, which in the 2020 text listed "sections and/or subsections" (bagian dan/atau subbagian) among the elements of the director's organisation, together with Pasal 16 to 23, which set out those administrative units for each class of polytechnic, and Pasal 50, which had classed the heads of sections and subsections as structural positions of echelon III.b and IV.a.^[2:1][9]

Chapter VI is retitled "functional positions and implementing positions". Under the new Pasal 37 and 38, functional positions provide functional services according to expertise, and implementing positions carry out public services and government and development administration; both are grouped, and the number of groups is set by need on the basis of job and workload analysis. Pasal 39 allows these officials and groups to be assigned individually or in work teams by the performance appraisal official or the head of the unit.^[3:1]

The new Pasal 40 requires the director to apply the government agencies' performance accountability system, national development risk management and national digital transformation. Pasal 41 bases cooperation between units on business processes set by the minister, and Pasal 44 requires coordination, integration, synchronisation and collaboration supported by the interoperability of data and information.^[4:1] Pasal 51 on appointments is amended to remove the provision on administrative officials, and Pasal 56, a transitional provision of 2020, is deleted.^[4:2]

Lampiran I of the parent regulation is replaced. The new charts show, for class I and II polytechnics and separately for class III, a supervisory board, senate, internal audit unit, director and three deputy directors, departments, centres and units, without administrative sections.^[5:1]

¶ Transition

Article II provides that all positions and officials under the previous text remain in place and continue their duties until new positions are formed and new officials appointed under the amended regulation. The regulation entered into force on promulgation.^[1:1]
