Peraturan Menteri Energi dan Sumber Daya Mineral 2/2026 (Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 2 Tahun 2026 tentang Pencabutan Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 09 Tahun 2009 ...) is an Indonesian ministerial regulation that revoked the ministry's 2009 guidelines on study permits, promotion examinations for diploma adjustment and the recording of academic titles for its civil servants. It was signed by the Minister of Energy and Mineral Resources, Bahlil Lahadalia, on 13 January 2026 and took effect on its promulgation on 21 January 2026.[1][2] It is an internal personnel instrument of the ministry, listed among the rules at mining and energy regulation in Indonesia and education law of Indonesia.
The regulation has two articles. Pasal 1 revokes Permen ESDM 9/2009 and Pasal 2 brings the revocation into force on promulgation; it puts no new guidelines in place of the old ones.[3] CRPG's regulatory tracker published two analyses of it, in April and June 2026.[4][5]
The preamble states that Permen ESDM 9/2009 no longer matched legal developments and the needs of the organisation and therefore had to be revoked. The legal bases cited are Pasal 17 ayat (3) of the Constitution, the State Ministries Law as amended in 2024, Perpres 169/2024 on the Ministry of Energy and Mineral Resources and the ministry's 2025 regulation on its organisation.[6] The minister signed it on the same day as Permen ESDM 3/2026 on palm oil bioenergy certification.[7]
Permen ESDM 9/2009, published in Berita Negara 2009 No. 112, set guidelines for civil servants of what was then the Department of Energy and Mineral Resources.[3:1] It defined a study permit (izin belajar) as approval given by an authorised official to a civil servant attending an education programme related to or supporting the servant's duties. It made the permit conditional on good performance ratings, the absence of moderate or heavy disciplinary penalties, a field of study that supported the servant's position, study at an accredited institution outside working hours and at the servant's own cost. It also governed promotion in rank on the basis of a higher academic diploma, which required passing a diploma adjustment examination, and the formal recording of academic titles in personnel records.[8]
