The water and sanitation bill of Indonesia (Rancangan Undang-Undang tentang Pengelolaan Air Minum dan Sanitasi) is a bill of the Dewan Perwakilan Rakyat (DPR), Indonesia's House of Representatives, on the management of drinking water and sanitation. DPR's legislative information system, SIMASLEG, records it under id 842 as a DPR proposal dated 27 November 2025.[1] Its subject overlaps two existing bodies of law, drinking water supply regulation and wastewater and sanitation regulation in Indonesia, and sits beside the rules on the resource itself, surveyed at water resources law of Indonesia.

As of the record retrieved on 26 September 2026 the bill was in penyusunan (drafting), the second of the five stages of law-making that Undang-Undang 12/2011 sets out: planning, drafting, deliberation, enactment, and promulgation.[2][1:1] Its record ran to twenty-nine dated entries between 30 January and 24 August 2026: the registration of a Naskah Urgensi, twenty-five expert discussions and public consultations held with the support of DPR's expert body in February and March 2026, and three sittings of the Badan Legislasi (Baleg), DPR's legislation committee, between June and August 2026.[1:2][3]

Because the bill comes from DPR, the list of contested provisions that opens clause-by-clause deliberation will be submitted by the President, not by DPR.[4] The record showed no plenary decision adopting the bill as a DPR initiative, no filed draft text or academic paper, and no such list, and the documents it names could not be retrieved from DPR's server.[1:3][3:1]

Origin and procedure

On the DPR side a bill may be proposed by an individual member, a commission, a combination of commissions, or the Badan Legislasi.[5] A member drafting the academic paper (Naskah Akademik) is assisted by the Badan Keahlian (BKD), DPR's expert body, and a commission or the Badan Legislasi by the Badan Keahlian together with the committee's expert staff.[6] SIMASLEG files the bill's entries under two drafting labels, Dukungan Penyusunan oleh BKD (drafting support by BKD) and Penyusunan oleh Komisi/Baleg/Anggota (drafting by a commission, Baleg or a member). Both fall within the constitutional stage of penyusunan.[1:4][5:1]

Harmonisation of a DPR bill is otherwise coordinated by the parliamentary body responsible for legislation, but a bill approved in a Badan Legislasi sitting is deemed to have undergone harmonisation, consolidation and consistency review.[7][8] An academic paper is mandatory: a bill originating from DPR, the President or the Regional Representative Council must be accompanied by one, and the three exceptions (the state budget, the enactment of a government regulation in lieu of law, and the revocation of either) do not cover a bill of this kind.[9]

Deliberation, the third stage, takes place in two levels of discussion: pembicaraan tingkat I in a commission, joint commission, the Badan Legislasi, the Budget Committee or a special committee, and pembicaraan tingkat II in plenary.[10] Where a bill comes from DPR, tingkat I opens with DPR's explanation and the President's views, and the Daftar Inventarisasi Masalah (DIM), the provision-by-provision list of issues, is submitted by the President. DPR submits the DIM only where the bill comes from the President.[4:1]

Record of the drafting stage

The first entry, dated 30 January 2026, registers a Naskah Urgensi for the bill.[1:5] The term is not defined in UU 12/2011; CRPG's tracker describes the document as a statement of why the bill is needed, filed before the academic paper itself.[3:2]

The next twenty-five entries, all under the same BKD support label, record ten expert discussions (diskusi pakar) and fifteen public consultations (konsultasi publik) held for the drafting of the academic paper and the bill between 25 February and 11 March 2026.[1:6] The expert discussions were held with government bodies, among them the water-quality directorate of the Ministry of Environment, the housing and settlement infrastructure directorate of Bappenas, the regional development directorate general of the Ministry of Home Affairs and the environmental health directorate of the Ministry of Health; with PERPAMSI, the association of Indonesian water utilities, and two associations of bottled-water producers; and with IPB University, the Bandung Institute of Technology and an organisation recorded as SPEAK. The public consultations were held in Solo on 2 March 2026, with academics from the law faculty of Universitas Sebelas Maret, the city water utility PAM Toya Wening and a regional water-resources agency, and in Banten on 4 March 2026, with academics from Universitas Sultan Ageng Tirtayasa, the provincial public works agency and a foundation.[1:7]

Three sittings of the Badan Legislasi followed, each agenda line headed as a plenary (pleno) meeting of the committee. On 22 June 2026 the agenda was a presentation by the Head of the Badan Keahlian, who is named in the record among those present. On 8 July 2026 the committee held a public hearing (Rapat Dengar Pendapat Umum) with the chairs of PERPAMSI and of APPAMSI, the association of drinking water and sanitation companies. On 24 August 2026 the agenda was the refinement of the formulation prepared by the Badan Keahlian (Penyempurnaan Rumusan), again presented by its head.[1:8] CRPG's regulatory tracker reported the August sitting on 26 September 2026 as the bill's entry into committee drafting.[3:3]

The record does not state whether any of the sittings was open or closed. Under DPR's standing orders every meeting is open unless it is declared closed, so the point cannot be inferred from the type of meeting.[11][1:9]

Documents

Twenty-nine documents are attached to the entries: twenty-one sets of expert material (Bahan Narasumber), five of government material (Bahan Pemerintah), two brief reports (Laporan Singkat) of the June and July sittings, and the Naskah Urgensi.[1:10] None of them could be retrieved when the record was collected in September 2026; each link DPR publishes returned a not-found response. The tracker reported the same failure for 2026 documents across the other bills it follows, while documents dated 2015 to 2024 resolved normally.[1:11][3:4] The sittings can therefore be cited by date, agenda and participating institution, but the papers tabled at them could not be examined.

What the record does not show

The record contained no plenary decision adopting the bill as a DPR initiative, the step that ends drafting and opens deliberation, and none of its twenty-nine entries records an outcome or a vote.[1:12][3:5] No draft of the bill text and no academic paper appears in it as a filed document, although the law requires the latter and a Naskah Urgensi was filed.[1:13][9:1] No DIM appears either; DPR publishes no document category for one, and for a DPR bill the DIM belongs to tingkat I deliberation and is the President's to submit.[3:6][4:2]

The absence of DIM discussion also bears on the bill's survival beyond the current parliamentary term. A bill may be carried over to the next DPR term, and returned to the national legislative programme by agreement of DPR, the President and the Regional Representative Council, only if its deliberation has reached discussion of the DIM within the current term.[12]
