Peraturan Menteri Lingkungan Hidup 26/2012 (Peraturan Menteri Lingkungan Hidup Nomor 26 Tahun 2012 tentang Petunjuk Teknis Pemanfaatan Dana Alokasi Khusus Bidang Lingkungan Hidup Tahun Anggaran 2013) is an Indonesian ministerial regulation that sets the technical guidelines for regencies and cities spending the environmental special allocation fund (Dana Alokasi Khusus Bidang Lingkungan Hidup, DAK Bidang LH) in the 2013 budget year. It was signed by the Minister of the Environment on 28 December 2012 and took effect on its promulgation on 29 January 2013.[1] It is one of the instruments on transfers from the state budget to the regions described at public finance and non-tax revenue in Indonesia.
The fund was meant to strengthen regencies' and cities' delivery of the minimum service standards for the environment set by Permen LH 19/2008 and to support climate change adaptation and mitigation, by financing physical facilities for environmental protection and management.[2][3] The regulation lists four groups of eligible purchases, bars the fund from paying administrative and running costs, requires a matching contribution of at least 10 per cent from the regional budget, and sets up chains of supervision and reporting through the provinces and the ministry's ecoregion management centres.[4][5][6]
The regulation defines the environmental DAK as funds from the state budget allocated to particular regions to help finance the monitoring of environmental quality, pollution control, the protection of environmental functions and support for climate change adaptation and mitigation, where these are regional functions and in line with national priorities.[3:1] Its preamble cites, among other laws, the state finance and fiscal balance laws, the waste management law Undang-Undang 18/2008, the environmental protection law Undang-Undang 32/2009, the government regulation on household waste Peraturan Pemerintah 81/2012, Permen LH 19/2008, and the Minister of Finance regulation on the general guidelines and allocation of the DAK for 2013.[2:1] It replaced the guidelines for the 2012 fund, Permen LH 17/2011.[7]
Pasal 2 gives the fund two aims for regencies and cities: meeting the environmental minimum service standards and supporting climate change adaptation and mitigation; Pasal 3 sets its target as completing the physical facilities for environmental protection and management.[3:2] Pasal 5 lists the support it is to give regents and mayors: setting water classes for priority rivers, reducing pollution loads on water, air and soil, adopting policies to reduce waste, adding green open space, restoring rivers and lakes, preparing the regional state of the environment report (Status Lingkungan Hidup Daerah), and supporting national programmes such as Adiwiyata, Adipura, waste banks and Langit Biru.[3:3]
The fund may buy four kinds of facilities, on a limited and conditional basis. For monitoring, it covers permanent laboratory equipment, portable equipment for testing water, emissions and soil, and four-wheel vehicles. For pollution control, it covers wastewater treatment plants for small and medium enterprises, communal plants and plants for community health centres, and facilities for the reduce, reuse and recycle handling of waste at temporary waste points, public and social facilities and schools. For climate change, it covers biodiversity parks, green parks and urban forests, mangrove and coastal planting, community-based coral reef restoration models and units turning organic waste into biogas. For protecting environmental functions, it covers infiltration wells, biopore holes, small reservoirs (embung), tree planting around springs and along rivers and lakes, sediment traps and landslide prevention.[4:1]
In choosing activities, a regency or city must weigh the ministry's key performance indicators, its priority environmental problems and local conditions, sustainability, its regional plans, the size of the allocation and the staff available.[4:2] The annex adds that permanent laboratory equipment may be bought only by a regency or city that already runs a laboratory with competent staff, a regular budget and suitable premises, and only on the recommendation of the head of the ecoregion management centre after consultation with the province.[8]
The fund may not pay for project administration, preparation of physical projects, research, training, honoraria, officials' travel, or general costs such as sampling, waste data collection and report writing.[5:1] Each recipient regency or city must allocate matching funds of at least 10 per cent from its own budget, together with supporting funds for the activities.[5:2]
The heads of the ministry's ecoregion management centres (Pusat Pengelolaan Ekoregion) supervise and evaluate the guidance and monitoring carried out by provinces, and the minister delegates guidance and supervision to governors through the 2013 deconcentration fund.[6:1] Regency and city environmental agencies form implementation teams and report quarterly on progress and spending, and at the end on results, outputs and outcomes, together with their 2012 regional state of the environment report, to the provincial agency; provinces compile the reports for the ecoregion centres, which pass them to the secretary of the ministry as the basis for evaluating and planning the next year's fund.[6:2]
Pasal 15 revoked Permen LH 17/2011 on the environmental DAK guidelines for 2012 (Berita Negara 2012 No. 90), and Pasal 16 brought the regulation into force on promulgation.[7:1] CRPG's regulatory tracker published a post on the regulation on 26 November 2025, under a title describing it as a set of environmental management guidelines.[9]
