Peraturan Menteri Lingkungan Hidup 19/2008 (Peraturan Menteri Negara Lingkungan Hidup Nomor 19 Tahun 2008 tentang Standar Pelayanan Minimal Bidang Lingkungan Hidup Daerah Provinsi dan Daerah Kabupaten/Kota) is an Indonesian ministerial regulation that sets the minimum service standards (standar pelayanan minimal, SPM) for the environment that provincial, regency and city governments must deliver. It was issued by the State Minister of the Environment and took effect on signature on 28 November 2008.[1] It belongs to the rules on the obligations of regional governments described at public administration in Indonesia.

The regulation defines the environmental SPM as the type and quality of basic environmental services, an obligatory regional function, to which every citizen is entitled at a minimum.[2] It gives provinces three services and regencies and cities four, each with an indicator, a target of up to 100 per cent (90 per cent for one regency service) and a deadline of 2013.[3] Governors, regents and mayors are responsible for delivering them through their environmental agencies, and report on achievement up the chain to the minister and the Minister of Home Affairs.[4]

Background

The preamble grounds the regulation in the regional government law, Undang-Undang 32/2004, and in Peraturan Pemerintah 38/2007 on the division of government functions, under which obligatory regional functions are to follow minimum service standards set by the central government, and states that it implements Pasal 6 ayat (2) of Peraturan Pemerintah 65/2005 on the preparation and application of such standards. It replaced a 2004 decree on environmental SPM guidelines for regencies and cities, which the preamble described as no longer suited to circumstances, and records a recommendation from the Regional Autonomy Advisory Council (Dewan Pertimbangan Otonomi Daerah) of 11 June 2008.[5]

Services and targets

Under Pasal 2, a province must provide information on the status of water quality, measured as the percentage of water sources whose quality is monitored, classified and published; information on ambient air quality, measured as the percentage of regencies and cities monitored; and follow-up of public complaints of suspected pollution or environmental damage. Each target is 100 per cent, to be reached in stages by 2013.[3:1]

Under Pasal 3, a regency or city must provide prevention of water pollution, measured as the percentage of businesses and activities meeting the administrative and technical requirements for preventing it; prevention of air pollution from stationary sources, on the same measure; information on the status of damage to land and soil for biomass production; and follow-up of public complaints. The targets are 100 per cent, except 90 per cent for complaints, again by 2013. Pasal 14 applies the regency and city standards to the Special Capital Region of Jakarta as well.[3:2][6]

Organisation, reporting and funding

Governors answer for the provincial services and regents and mayors for the regency and city services, which regional environmental agencies deliver and plan in stages under technical guidance to be set by a further ministerial regulation. Regency and city agencies report to their heads, who report to the governor; governors report both on provincial achievement and on a summary of regency and city achievement to the environment minister and the Minister of Home Affairs.[4:1] Regions may set targets earlier than the minister's deadlines.[4:2]

The minister guides and supervises all regions and evaluates the provinces, and governors do the same for their regencies and cities; the results feed capacity building and may ground incentives and disincentives. Regional implementation is funded from regional budgets, the minister's guidance from the state budget, and governors' guidance of regencies and cities from provincial budgets.[7]

Transition and relationship to other instruments

Pasal 13 required the standards to be applied within one year of signature at the latest. Pasal 15 revoked Keputusan Menteri Negara Lingkungan Hidup 197/2004 on environmental SPM guidelines for regencies and cities, and Pasal 16 brought the regulation into force on signature.[6:1]

Among the laws the regulation cites, the environmental management law of 1997 was replaced by Undang-Undang 32/2009, and the government regulations of 1999 on air pollution control and of 2001 on water quality were revoked by Peraturan Pemerintah 22/2021.[5:1][8][9] The technical guidelines for the environmental special allocation fund for 2013, Permen LH 26/2012, cite the regulation and direct that fund to helping regencies and cities meet the environmental SPM.[10] CRPG's regulatory tracker published an analysis of the regulation on 26 November 2025.[11]
