Peraturan Menteri Lingkungan Hidup dan Kehutanan 14/2024 (Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor 14 Tahun 2024 tentang Penyelenggaraan Pengawasan dan Sanksi Administratif Bidang Lingkungan Hidup) was an Indonesian ministerial regulation on the supervision of businesses' compliance with their environmental obligations and on the administrative sanctions imposed for breaches. It was signed by the Minister of Environment and Forestry on 19 September 2024 and took effect on its promulgation on 26 September 2024, as Berita Negara 2024 No. 591.[1][2] It was issued to implement Pasal 504 and 526 of PP 22/2021 on environmental protection, and belongs to the body of rules described at environmental approval in Indonesia.[3]

The regulation set out how the minister, governors and regents or mayors plan and carry out supervision, how environmental inspectors (Pejabat Pengawas Lingkungan Hidup) examine compliance and report, and how the five administrative sanctions are imposed, from a written warning to the revocation of a business licence. It fixed the methods for calculating administrative fines of up to three billion rupiah, provided for evaluation of supervision and sanctions, and set a code of ethics for inspectors.[4][5][6][7]

It replaced Permen LH 2/2013 on administrative sanctions and four ministerial decisions of 2001 and 2002 on environmental inspectors.[8] It was itself revoked by Permen LH 6/2026, which took effect on 15 June 2026.[9]

Background and scope

Pasal 2 gave the minister, governors and regents or mayors, within their powers, the task of supervising compliance with the terms of business licences or government approvals relating to environmental approval (persetujuan lingkungan), and with the environmental regulations, and of imposing administrative sanctions. The minister could also supervise and sanction, as a second tier (lapis kedua), activities whose licences were issued by regional governments.[4:1] The regulation defined administrative sanctions as instruments of administrative law that impose obligations or orders, or withdraw an administrative decision, on the person responsible for an activity for non-compliance with environmental rules or with a business licence or government approval.[10]

Supervision

Supervision proceeds in three stages: planning, execution and evaluation. Planning begins with an inventory of activities, drawing on environmental approvals, technical approvals (persetujuan teknis) and operational feasibility letters (surat kelayakan operasional, SLO), environmental reports, compliance and sanction histories, and data from the ministry's environmental reporting system (Simpel).[11] Each activity is profiled, and its complexity rated low, medium or high by the number of its regulated activities, among them wastewater, emissions, hazardous and non-hazardous waste, peat, mangrove and other ecosystem damage, forest and land fires, and solid waste.[11:1]

Supervision may be regular or incidental. Regular supervision is direct, by field verification or continuous monitoring, for designated national strategic installations and regional priorities, activities of public concern or with significant impacts, activities that have held an SLO for more than a year or operated for more than two years, and repeat offenders; it is indirect, by review of reports, for activities with a recent SLO or newly operating and compliant. Incidental supervision follows public complaints or emergency reports.[12] Annual and detailed supervision plans are set by the Director General for the minister and by the heads of regional environmental offices.[13]

In an inspection, inspectors may monitor, request information, copy documents, enter premises, photograph and record, take samples, examine equipment and installations, and stop certain violations, marked by a sign or an inspector's line. The findings are recorded in a supervision record and a report that analyses the law, states whether the activity is compliant, and recommends sanctions and, where a crime or dispute is suspected, criminal or civil action.[14] Obstructing supervision is prohibited and is reported to the environmental civil servant investigators.[15] The minister may supervise activities licensed by regional governments where a serious violation occurs and the region does not act, and a governor, regent or mayor may ask the minister to do so.[16]

Administrative sanctions

Sanctions are imposed by the authority that issued the licence or approval, a power that may be delegated to the Director General or the head of the regional environmental office.[17] Pasal 33 lists five sanctions: a written warning, government coercion (paksaan pemerintah), an administrative fine, suspension of the business licence and revocation of the business licence.[5:1]

A written warning applies to minor violations as classified in Lampiran XV of PP 22/2021, and must be complied with within 30 days. Government coercion follows a warning that is not complied with, or may be imposed directly where a violation poses a serious threat or wider damage; it can take the form of halting production, closing a wastewater or emission outlet, demolition, seizure, suspension of the activity, an order to prepare environmental documents, or other measures including clean-up, restoration and an environmental audit. Where the operator does not comply, the authority may take over the clean-up and restoration, paid from the operator's restoration guarantee fund.[18]

Fines are imposed together with coercion for seven categories of violation, including operating without an environmental approval, exceeding the wastewater or emission standards in the licence, failing to meet licence obligations, preparing an Amdal without a competence certificate, and negligent pollution or damage. Each fine is capped at three billion rupiah and is paid to the treasury as non-tax state revenue.[19] Operating without an environmental approval but with a business licence incurs 2.5 per cent of the investment value, and without either 5 per cent; fines for exceeding effluent or emission standards are calculated from the actual and permitted concentrations, the flow, the duration and the fine rate; and fines for an Amdal prepared without certification are 10 per cent of its cost. Fines for negligent pollution or damage are calculated by appointed experts, and late compliance with coercion incurs a further daily-based fine.[20]

Suspension of the licence follows failure to comply with coercion or to pay fines, and revocation follows continued failure or irreparable pollution or damage; neither releases the operator from its obligations or from civil and criminal liability.[21] Where the sanctioning authority did not issue the licence, it recommends suspension or revocation to the issuer, and may annul the environmental approval.[22] Sanction decisions are delivered within five working days, compliance with them is supervised, and unpaid fines are referred to the state debt collection agency or pursued in civil or criminal proceedings.[23]

Evaluation, ethics and funding

The minister, governors and regents or mayors evaluate supervision and sanctions at least once a year, on formal aspects such as the realisation of supervision plans and on substantive aspects such as the effect on compliance and repeat violations.[7:1] Inspectors are bound by a code of ethics based on integrity, professionalism and responsiveness; the regulation established the professional association of environmental inspectors (Ikatan Pengawas Lingkungan Hidup Indonesia) and a code of ethics council and panel, with regional councils in the provinces and regencies. Supervision and sanctions are funded from the national and regional budgets and other lawful sources.[7:2][24]

Revocation

Pasal 77 revoked Keputusan Menteri Negara Lingkungan Hidup 7/2001 on environmental inspectors, 56/2002, 57/2002 and 58/2002 on supervision guidelines and the working procedures of inspectors, and Permen LH 2/2013 on guidelines for administrative sanctions.[8:1] Pasal 84 of Permen LH 6/2026 revoked Permen LHK 14/2024 when the later regulation took effect on 15 June 2026.[9:1]

CRPG's regulatory tracker published a short post on the regulation on 26 November 2025.[25]
