Peraturan Menteri Lingkungan Hidup 1/2010 is a regulation of the Indonesian State Minister of the Environment, Peraturan Menteri Negara Lingkungan Hidup Nomor 01 Tahun 2010 tentang Tata Laksana Pengendalian Pencemaran Air, which sets the procedures by which central, provincial and district governments control water pollution. It was signed on 14 January 2010, took effect on that date, and revoked the 2003 ministerial decree on permits and studies for discharging wastewater into water sources.[1][2] It forms part of the pollution-control side of the water resources law of Indonesia.

The regulation is addressed to governments rather than to polluters. It requires them to inventory pollution sources, to determine the pollution load capacity (daya tampung beban pencemaran air) of rivers, lakes and reservoirs, to set effluent standards and pollution control policies, to monitor water quality at least twice a year, and to publish information. Load capacity determines whether a district may use the standard effluent limits in a discharge permit or must set tighter ones, and whether it must refuse a location permit.[3][4][5]

Permits for discharging wastewater into water sources, and for applying wastewater to land, are issued by regents and mayors under procedures they set by regional head regulation, with a five-year term for discharge permits. The regulation also provides for incentives and disincentives, guidance to small businesses and households, and supervision by environmental inspectors at each level of government, and it links to the environmental documents at the centre of environmental approval in Indonesia.[6][7][8]

Background

The preamble states that water quality must be safeguarded for present and future generations and that, under Pasal 9 of Peraturan Pemerintah Nomor 38 Tahun 2007 on the division of government affairs, the mandatory affairs of water pollution control are carried out according to norms, standards, procedures and criteria set by the environment minister. The regulation cites, among others, the 2004 water resources law, the 2007 spatial planning law, UU 32/2009 on environmental protection and management, Peraturan Pemerintah Nomor 82 Tahun 2001 on water quality management and water pollution control, and PP 42/2008 on water resources management.[9]

Pasal 2 states that the regulation's purpose is to guide the central and regional governments in controlling water pollution. Pasal 3 lists its eight subjects: inventory and identification of pollution sources, load capacity, effluent standards, pollution control policy, permits, water quality monitoring, guidance and supervision, and information.[3:1] Six annexes set out guidelines for inventory, for applying load capacity, for setting effluent standards, for drafting policy, for permit procedures and for supervision.[3:2][4:1][6:1][8:1]

Pollution sources and load capacity

Regents and mayors inventory the sources of water pollution in their district, identify them, and report the results to the governor, with a copy to the minister, at least once a year. Governors compile and analyse the district results and report to the minister annually, and each level updates its data at least once a year.[10]

Pasal 8 assigns the determination of load capacity to the minister for rivers, estuaries, lakes, reservoirs and situ that cross provincial or national borders, to the governor for those crossing districts, and to the regent or mayor for those within one district. The determination must take account of the hydrology and morphology of the water body, its quality status or trophic status, the applicable water quality standards and the load from each source, and must show each source's contribution. Priority goes to water bodies selected by quality status, by the sources found in the inventory, and by their use as raw water for drinking. Load capacity is to be redetermined at least once every five years.[4:2]

Load capacity is the basis for location permits and wastewater discharge permits issued by regents and mayors, for effluent standards, for pollution control policy, for spatial plans and for target water quality. Under Pasal 11, where the existing effluent standard keeps discharges within the load capacity, a regent or mayor may use it as the permit condition; where applying it would exceed the capacity, the regent or mayor must set effluent quality from the capacity determination instead. Pasal 12 requires a regent or mayor to reject an application for a location permit where the analysis shows that the proposed location would cause the load capacity to be exceeded.[4:3]

Effluent standards and policy

Pasal 16 allows a provincial government to set effluent standards equal to or stricter than those set by the minister, and to add parameters with the minister's approval. The minister must decide on a request to add parameters within 90 working days, failing which the request is deemed approved, and must give reasons for a refusal.[11] National effluent standards for domestic wastewater are covered at wastewater and sanitation regulation in Indonesia. Pollution control policy is set by ministerial regulation at national level, by governor's regulation in the provinces and by regent's or mayor's regulation in the districts, on the basis of the inventory, the load capacity and target water quality, and forms part of water quality management policy.[12]

Permits

The environmental permit for discharging wastewater into a water source proceeds through application, analysis and evaluation, and decision. The application must meet administrative requirements, including the business's other permits and its environmental impact assessment (Amdal) or environmental management and monitoring document (UKL-UPL), and technical requirements, including measures for pollution prevention and wastewater minimisation and a study of the discharge's effects on fish, animals and crops, soil and groundwater, and public health. Regents and mayors set the detailed requirements and procedure by regional head regulation; a permit is valid for five years and may be extended, and ends on expiry, revocation or cancellation.[6:2]

A separate permit governs the application of wastewater to land as a substitute for fertiliser or irrigation. The regional head regulation for it must require monitoring wells and six-monthly monitoring reports, and must prohibit application on peat, on land with soil permeability above 15 centimetres or below 1.5 centimetres an hour, or where groundwater is less than 2 metres deep, as well as letting runoff reach rivers and diluting the wastewater used.[7:1] Regents and mayors must inform the public of permit requirements and of the status of applications.[7:2]

Monitoring, guidance and supervision

Water quality in water sources is monitored by the minister for cross-provincial and cross-border sources and by regents and mayors for sources within their district, with governors coordinating where a source spans districts, at least once every six months.[5:1] The minister, governors and regional heads must promote compliance through guidance, which may include incentives such as lower wastewater discharge charges, awards and publication of a business's compliance record, and disincentives such as higher charges, more frequent self-monitoring and publication. They must also assist small and medium businesses, and address household wastewater by building treatment infrastructure, encouraging septic tanks that meet sanitation requirements and forming community self-help groups; the regulation of household tanks is treated at septic tank regulation in Indonesia.[8:2]

Supervision of compliance is carried out by environmental inspectors at each level, according to which authority approved the business's environmental documents or issued its permit, and governors also supervise the permits issued by regents and mayors.[8:3] Each level must publish information on pollution sources, water bodies, permits and applicable law, updated at least yearly, and bears the cost of pollution control for the water sources under its authority.[13]

CRPG's regulatory tracker listed the regulation in a November 2025 series of English-language entries on water pollution control instruments. The entry does not describe the regulation's procedures.[14]
