Peraturan Menteri Lingkungan Hidup 3/2009 is a regulation of the Indonesian State Minister of the Environment, Peraturan Menteri Negara Lingkungan Hidup Nomor 03 Tahun 2009 tentang Sertifikasi Kompetensi dan Standar Kompetensi Manajer Pengendalian Pencemaran Air, which sets up a certification scheme and a national competency standard for water pollution control managers (Manajer Pengendalian Pencemaran Air, MPPA), the staff of a business who are responsible for preventing and dealing with the water pollution it causes. It was signed on 23 March 2009 and took effect on that date.[1][2]
The regulation provides for competency testing and certification by bodies appointed by the minister, for training by registered training bodies, and for supervision of both by the minister. Certificates are valid for five years. Its annex defines the qualification, the minimum education and experience, and five units of competency covering wastewater characterisation, assessment of pollution potential, waste minimisation, operation of treatment plants and emergency response.[3][4][5] It is one of the instruments of pollution control within the water resources law of Indonesia and the wider regime of environmental approval in Indonesia.
The preamble cites the government's duty under Pasal 10 huruf e of the 1997 environmental management law, Undang-Undang Nomor 23 Tahun 1997 tentang Pengelolaan Lingkungan Hidup, to develop and apply pre-emptive, preventive and proactive tools, and states that businesses need competent water pollution control managers and that certification against a set standard is needed to assure that competence. It also relies on the ministry's 2006 general guideline on competency standards for environmental personnel and service bodies.[6] The 1997 law was revoked by UU 32/2009, which kept its implementing regulations in force so far as they did not conflict with the new law.[7]
Pasal 1 defines a water pollution control manager as the person on the side of the party responsible for a business or activity who holds authority and responsibility for preventing and dealing with water pollution caused by it.[2:1] Under Pasal 2, certification consists of a competency test, assessing knowledge, skills and work attitude, and the issue of a certificate. The test is open to candidates who have completed competency training and to candidates whose work experience is judged equivalent. The certificate is issued on passing the test and is valid for five years, with extension possible.[3:1]
Tests are conducted by competency certification bodies (Lembaga Sertifikasi Kompetensi, LSK) appointed by the minister. An appointed body must be a legal entity, have a quality management system, employ assessors with at least five years' experience of water pollution control in industry, publish information on its testing and have a complaints mechanism. It must keep a database of certified managers, report to the minister every six months, evaluate certified managers at least once a year, and use the competency standard in the annex.[4:1]
Training is provided by registered competency training bodies (Lembaga Pelatihan Kompetensi, LPK) on a curriculum based on the standard. A training body must be a legal entity with a quality management system, training facilities and public information on its courses; it must register with the Ministry of the Environment, keep its registration current and report on its training at least once a year.[4:2] The minister supports both kinds of body with information on the standard and capacity building, and supervises them through monitoring and evaluation at least once a year and by following up public complaints. Training, testing and registration are paid for by the applicant, and guidance and supervision by the state budget. Certificates issued before the regulation remained valid, and existing certification had one year to conform.[8]
The annex names the qualification as the person in charge of water pollution control and describes the role as assessing the pollution potential of all production activities, setting strategies, programmes and targets for pollution control, and coordinating and supervising the related activities. It requires, at minimum, a senior secondary science education with five years' experience in water pollution control, a science diploma (D-3) with two years, or a bachelor's degree with one year, together with command of Indonesian. The five units of competency are the evaluation of wastewater characteristics, the assessment of water pollution potential, wastewater minimisation, the control of wastewater treatment plant (IPAL) operation, and emergency response to water pollution.[5:1] Guidance on water pollution control procedures, including local permits for wastewater discharge, was issued the following year in Permen LH 1/2010.
CRPG's regulatory tracker listed the regulation in a November 2025 series of English-language entries on water pollution control instruments. The entry does not describe the certification scheme.[9]
