Peraturan Menteri Lingkungan Hidup dan Kehutanan 6/2021 (Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor 6 Tahun 2021 tentang Tata Cara dan Persyaratan Pengelolaan Limbah Bahan Berbahaya dan Beracun) is the Indonesian ministerial regulation that sets the procedures and requirements for managing hazardous and toxic waste (limbah B3), from the determination of a waste's status through storage, collection, transport, utilisation, treatment, landfilling, dumping and cross-border movement. It implements Pasal 449 huruf a to q of PP 22/2021 and integrates the technical approval and operational worthiness letter for hazardous-waste management into the environmental approval (Persetujuan Lingkungan). It was signed and promulgated on 1 April 2021 as Berita Negara 2021 No. 294 and took effect that day.[1][2]

The regulation replaced the earlier permit system for hazardous-waste management with a two-stage arrangement: a business subject to an environmental impact assessment (Amdal) or to environmental management and monitoring efforts (UKL-UPL) that collects, utilises, treats or landfills hazardous waste must hold a technical approval (Persetujuan Teknis PLB3) and then an operational worthiness letter (Surat Kelayakan Operasional, SLO-PLB3) before operating.[3] It revoked ten earlier ministerial and agency instruments, among them the 2009 permit regulation and the 2018 rule integrating hazardous-waste permits with environmental permits through the online licensing system.[4]

It forms part of hazardous waste regulation in Indonesia and of environmental approval in Indonesia, and sits within solid waste management law. CRPG's regulatory tracker published an analysis of its permitting provisions on 26 November 2025.[5]

Background

The preamble of Permen LHK 6/2021 gives two grounds: to implement Pasal 449 huruf a to q of PP 22/2021, and to integrate technical approvals and operational worthiness letters for hazardous-waste management into the environmental approval.[1:1]

The regulation defines hazardous and toxic substances (B3) as substances, energy or other components that by their nature, concentration or quantity can pollute or damage the environment or endanger health and life, hazardous waste as the residue of a business or activity that contains B3, and hazardous-waste management as reduction, storage, collection, transport, utilisation, treatment and landfilling.[6] Its fourteen chapters follow that sequence, and Pasal 2 lists eleven subjects: status determination, reduction, storage, collection, transport, utilisation, treatment, landfilling, dumping, cross-border movement, and the application for and issue of technical approvals and SLO-PLB3.[6:1]

Status, reduction and storage

A waste's status is determined for hazardous waste from specific sources, to exclude it from hazardous-waste management or to classify it as a by-product, and for waste suspected of having hazardous characteristics, to classify it as hazardous or non-hazardous. Status is determined by testing for explosivity, flammability, reactivity, infectiousness, corrosivity and toxicity, the last through the TCLP leaching test, LD50 toxicology and sub-chronic toxicology.[7]

Every person that generates hazardous waste must reduce it, through substitution of materials, process modification or environmentally friendly technology, and report on reduction to the minister at least every six months.[8] Generators, collectors, utilisers, treaters and landfill operators must store hazardous waste, may not mix the waste they store, and must meet storage standards that are integrated into the business identification number for activities requiring only an SPPL, or set out in the environmental approval for those requiring an Amdal or UKL-UPL.[9] A generator may store hazardous waste for at most 90 days where it produces 50 kilograms a day or more, 180 days for smaller quantities of category 1 waste, and 365 days for smaller quantities of category 2 waste and for category 2 waste from specific sources; beyond those periods the waste must be utilised, treated or landfilled, or handed to another party.[10]

Collection, transport and cross-border movement

Collection consists of segregation by name and characteristic and storage, and a collector may hold waste for at most 90 days from its handover by the generator, after which it must pass the waste to a utiliser, treater or landfill operator. Collectors report electronically at least every six months.[11] Transport must be carried out by a transporter licensed for the purpose, in closed vehicles for category 1 waste and open or closed vehicles for category 2, and with a transport recommendation and an electronic transport manifest (Festronik) recording each handover.[12] A generator unable to utilise or treat its waste may export it only where the technology is not available in Indonesia, after notification to and consent from the receiving and transit states and with an export recommendation from the minister.[13]

Technical approval and operational worthiness

Pasal 220 requires every business or activity subject to an Amdal or UKL-UPL that collects, utilises, treats or landfills hazardous waste to hold both a technical approval and an SLO-PLB3; dumping requires a technical approval only. The minister decides applications for national-scale collection, utilisation, treatment, landfilling and dumping, the governor for provincial-scale collection, and the regent or mayor for district-scale collection. For activities requiring an Amdal the application may be made together with the application for environmental approval or separately; for those requiring UKL-UPL it must be made before the environmental approval is sought.[3:1]

An application must include a technical study, proof of an environmental restoration guarantee fund of at least five billion rupiah, a cost calculation and economic model, and copies of the competency certificates of the workers concerned; generators are exempt from the guarantee and the economic model.[3:2] The workers' competency framework was later set by Permen LHK 11/2024.[14] The regulation fixes processing times: two working days for the completeness check, ten working days for the applicant to correct an incomplete file, seven working days for verification, and seven working days to communicate the decision. The approval must be amended when the facility's location, design, capacity, technology or waste changes, and the amendment becomes a condition for amending the environmental approval.[15]

Once the facility is built, and any required trial has been run, the business reports to the issuing authority with a copy of its environmental approval. The authority verifies within ten working days that the facility or trial conforms to the technical approval, and then issues the SLO-PLB3 or refuses it with directions for correction. The SLO-PLB3 is the basis for starting operations and for supervising compliance.[16]

Transition and revocation

Hazardous-waste management permits already issued remained valid until they expired, and renewal applications declared complete before the regulation took effect were to be continued through to a technical approval or an amended environmental approval. Road drivers transporting hazardous waste were given two years to obtain a driver's competency certificate.[4:1] Pasal 236 revoked ten instruments, including Permen LH 18/2009 on hazardous-waste permitting, the ministry's regulations of 2016 on landfilling in final disposal facilities, of 2018 on integrated permitting and on dumping at sea, and of 2020 on transport, characteristic testing, storage and utilisation, and two older decrees on technical requirements and on the biological treatment of oil-contaminated soil.[4:2] The CRPG post of November 2025 put the number of consolidated instruments at eleven.[5:1]
