Peraturan Presiden 3/2016 (Peraturan Presiden Nomor 3 Tahun 2016 tentang Percepatan Pelaksanaan Proyek Strategis Nasional) is an Indonesian presidential regulation that established a special regime to accelerate the implementation of national strategic projects (Proyek Strategis Nasional, PSN). It was signed by President Joko Widodo on 8 January 2016 and took effect on its promulgation on 12 January 2016.[1] It is one of the instruments described at public administration in Indonesia.
The regulation defines a national strategic project as a project carried out by the central government, a regional government or a business entity that is strategic for growth and the equal distribution of development, and lists the projects in an annex that may be changed on a study by the committee for accelerating priority infrastructure.[2] Its twelve chapters and 33 articles cover permits and other approvals, spatial planning, land, domestic components, government guarantees, assignments to state-owned enterprises, procurement, the resolution of obstacles and the handling of legal complaints.[1:1]
It was amended by Peraturan Presiden 58/2017, 56/2018 and 109/2020; the text described here is the text as issued in 2016.[3] CRPG's regulatory tracker published an analysis of the regulation in November 2025.[4]
Under Pasal 3, ministers, heads of agencies, governors and regents or mayors issue the permits (perizinan) and other approvals (nonperizinan) needed for a strategic project within their authority. The permits needed to begin a project are a location decision or location permit, an environmental permit (Izin Lingkungan), a permit to borrow and use forest land (Izin Pinjam Pakai Kawasan Hutan) and a building permit, applied for through the central one-stop service (PTSP Pusat) at the Investment Coordinating Board (BKPM) or through provincial and district one-stop services.[5] A business entity that is responsible for a project first obtains a principle permit (izin prinsip), which the head of BKPM must issue within one working day of a complete application.[5:1]
Pasal 7 sets time limits: three working days for permits delegated to the head of BKPM, five working days for the recommendations of the responsible authorities, and five working days for the central one-stop service to complete processing. It excepts the environmental permit, allowed up to 60 working days, the forest-land permit, allowed up to 30 working days, and tax facilities, allowed up to 28 working days.[6] Approvals that do not endanger the environment, including the building permit, the nuisance permit and approval of a building's technical plan, are to be issued as checklists; once the applicant's commitment to meet the technical requirements is registered, the permit counts as approved.[7] A project that is one chain of works across several locations needs a single permit for all of them.[8]
Where a regent or mayor fails to issue a permit on time, the head of BKPM refers the matter to the governor for an administrative sanction, and the governor then takes the permit over; the Minister of Home Affairs does the same for a governor.[9] Construction may begin once a project holds a location decision or permit, an environmental permit and a building permit, and, in a forest area, a forest-land permit.[10] An application to extend a permit that is not decided within five working days is deemed granted.[11] Ministers, heads of agencies and regional heads must delegate their permit powers for strategic projects to the one-stop services, except where law or technical considerations prevent it.[12]
These permit and forest-land provisions sit within the fields covered at environmental approval in Indonesia and forestry and land use regulation in Indonesia.
Strategic projects must conform to regional spatial plans, detailed spatial plans or coastal zoning plans. Where a project does not conform and cannot technically be moved, the spatial plan may be adjusted under the spatial-planning law. Projects that harness water, heat (panas) or wind energy may be located in nature reserve and nature conservation areas in accordance with the law.[13]
Land for projects carried out by the central government, a regional government or a state-owned enterprise assigned by the central government is acquired under the law on land acquisition for public purposes, using the shortest time periods; enterprises without such an assignment and private businesses acquire land by agreement with its owners. Land whose location a governor has determined may be transferred by its holder only to the National Land Agency.[14] A business entity may pre-finance land acquisition on the government's behalf and be reimbursed from the state or regional budget after acquisition is complete.[14:1]
Strategic projects are to give priority to domestic components.[15] The central government may guarantee a project carried out by a business entity, or by a regional government in cooperation with one, against the financial effect of government decisions that obstruct it, with the Minister of Finance managing the risk; the responsible minister may also assign projects to state-owned enterprises.[16] Pasal 27 relaxes procurement rules for these projects: direct procurement of consultancy services up to Rp500 million, direct appointment of international financial institutions that cooperate in project preparation and of contractors with good performance on similar contracts, and the continuation of unfinished contracts into the next budget year.[17]
Officials must resolve obstacles within their field and may exercise discretion in accordance with the general principles of good governance, including to deal with the social impact of projects; where the law does not clearly assign authority to resolve an obstacle, they may take the necessary decisions on the same principles.[18]
Pasal 31 provides that public complaints of irregularities or abuse of authority in a strategic project are handled first by administrative process. Complaints made to the Attorney General's Office or the police are forwarded within five days to the responsible minister, agency head or regional head, who may ask the government's internal auditors to examine the matter within 30 working days. Administrative errors are corrected, with any state loss repaid, within ten working days; findings of a criminal offence of a non-administrative kind are passed back to the prosecutors or police.[19] The Coordinating Minister for Economic Affairs monitors and evaluates the projects and reports to the President at least once every six months.[20]
Among the functions that Peraturan Presiden 195/2024 gives the national development planning agency in 2024 is the formulation and setting of policy on national strategic projects, and one of its deputies monitors, controls, evaluates and manages the risks of those projects.[21]
