AmendsPermen LHK 93/2018

Peraturan Menteri Lingkungan Hidup dan Kehutanan 80/2019 is a regulation of the Indonesian Minister of Environment and Forestry, Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor P.80/MENLHK/SETJEN/KUM.1/10/2019 tentang Perubahan atas Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor P.93/MENLHK/SETJEN/KUM.1/8/2018, which amends the 2018 regulation requiring continuous, online monitoring of industrial wastewater. It was signed on 18 October 2019 and took effect on its promulgation on 16 December 2019.[1] It belongs to the monitoring layer of wastewater regulation in Indonesia.

The amendment revises the definitions of the parent regulation, Permen LHK 93/2018, reduces its list of sectors obliged to operate the monitoring system (Sparing) from fourteen to twelve, restates the technical specification that monitoring devices must meet in terms of measurement range and accuracy, and replaces all three of its technical annexes.[2] It leaves untouched the parent regulation's two-year installation period and its rules on data validity, manual monitoring and reporting.

Background

The preamble states a single reason for the amendment: that Permen LHK 93/2018 no longer matched developments in conditions on the ground and therefore needed to be changed.[3] Like the parent regulation, the amendment rests on UU 32/2009 on environmental protection and management and on Peraturan Pemerintah 82/2001 on water quality management and water pollution control, and lists the parent regulation itself (Berita Negara 2018 No. 1236) among its legal bases.[3:1] CRPG's regulatory tracker published an analysis of the amendment on 26 November 2025.[4]

Amendments

The amendment is made in a single article, Pasal I, of six points.[2:1]

Definitions. Pasal 1 was replaced. The definition of Sparing now describes an automatic, continuous and online system for monitoring, recording and reporting the measured level of a parameter or the discharge flow of wastewater to water, and eighteen terms are now defined instead of five. The additions define each obliged sector, among them the rayon, pulp or paper, upstream petrochemical, basic oleochemical and palm oil industries, oil refining, oil and gas exploration and production, gold and copper mining, coal mining, nickel mining and industrial estates, and introduce measurement accuracy, the permitted deviation between a Sparing device and a calibration laboratory. The textile industry is defined by a discharge of 1,000 cubic metres a day or more, the threshold that the original list carried in its text.[5]

Obliged sectors. Pasal 2 ayat (2) was replaced by a list of twelve sectors. Pulp and paper are merged into a single entry for the pulp or paper industry, and the fertiliser industry, which the 2018 list included, no longer appears.[6][7]

Device specification. Pasal 5 ayat (1) huruf c was restated to require devices to meet a minimum measurement range and a maximum measurement error set in Lampiran III.[8] No other provision of the body of the 2018 regulation was changed, so its two-year installation period (Pasal 14), its data-validity and abnormal-condition rules, its manual-monitoring duties and its reporting duties continued to apply as originally written.[2:2]

Revised annexes

Lampiran I, on how the system works, describes the measuring technology as sensors at the compliance point rather than the immersed multiprobe sensors of the 2018 text, and retains transmission by mobile (GSM) or internet networks and licensed or open-source data software.[9][7:1]

Lampiran II revises the parameters monitored per sector. All twelve sectors monitor pH and flow. The three mining sectors monitor TSS in addition; the rayon, pulp or paper, upstream petrochemical and palm oil industries monitor COD and TSS; the basic oleochemical and textile industries and industrial estates monitor COD, TSS and ammonia; and oil refining and oil and gas production monitor COD and ammonia, the latter only for produced water from onshore operations.[10]

Lampiran III replaces the 2018 description of a multiprobe sensor with a table of minimum measuring ranges: 0-14 for pH, 0-50 mg/L for ammonia, 10-1,400 mg/L for COD and 0-2,000 mg/L for TSS, with the flow range set by the discharge. The permitted error is at most 0.1 pH unit, and 10 per cent for the other parameters.[11]

Relationship to other instruments

The effluent limits against which Sparing readings are checked are set outside both instruments, in Permen LH 5/2014 on wastewater quality standards and in sector standards such as those for nickel mining and industrial estates, whose sectors remain on the amended list.[6:1]
