Peraturan Menteri Lingkungan Hidup dan Kehutanan 93/2018 is a regulation of the Indonesian Minister of Environment and Forestry, Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor P.93/MENLHK/SETJEN/KUM.1/8/2018 tentang Pemantauan Kualitas Air Limbah secara Terus Menerus dan Dalam Jaringan bagi Usaha dan/atau Kegiatan, which requires designated industries to monitor their wastewater discharges automatically, continuously and online. It was promulgated on 6 September 2018 and forms part of the monitoring layer of wastewater regulation in Indonesia.[1]

The regulation names the monitoring system Sparing, an acronym for the continuous and online wastewater quality monitoring system, and obliges the operators of fourteen types of business, from pulp and paper mills to coal and nickel mines and industrial estates, to install and operate it.[2] It sets how the equipment is installed, when its data are valid, how much deviation is tolerated in abnormal conditions, what manual monitoring must supplement it, and how results are reported to the national and regional governments.[3][4]

The regulation was amended in October 2019 by Permen LHK 80/2019, which rewrote its definitions, its list of obliged sectors and its three technical annexes.[5]

Background

The regulation was issued to implement Pasal 68 of UU 32/2009 on environmental protection and management, which obliges everyone conducting a business or activity to provide environmental information that is correct, accurate, open and timely, and to comply with environmental quality standards. Its preamble reasons that obtaining such information requires wastewater quality to be monitored continuously and online.[6] Its legal bases also include Peraturan Pemerintah 82/2001 on water quality management and water pollution control.[6:1] CRPG's regulatory tracker published an analysis of the regulation on 26 November 2025.[7]

Scope and the Sparing system

Pasal 2 makes the installation and operation of Sparing mandatory for the person responsible for a business or activity when monitoring wastewater quality and reporting on that monitoring. The original list comprised the rayon, pulp and paper, paper, upstream petrochemical, basic oleochemical, palm oil, oil refining and fertiliser industries; oil and gas exploration and production; gold and copper, coal and nickel mining; textile plants discharging 1,000 cubic metres a day or more; and industrial estates.[2:1] A Sparing installation consists of the measuring device, a data logger that records, stores and transmits readings, and a data centre that receives and processes them; Lampiran I describes transmission by mobile (GSM) or internet networks so that remote sites can report without new infrastructure.[8]

Lampiran II fixes the parameters monitored per sector. Every sector monitors pH and discharge flow; most also monitor chemical oxygen demand (COD) and total suspended solids (TSS), and the paper, oil refining and oil and gas sectors ammonia as well, while the three mining sectors monitor only pH, TSS and flow.[9]

Installation, validity and abnormal conditions

The device must be installed at the designated compliance point (titik penaatan); where there are several, at the one carrying the largest load. Each monitored compliance point must carry a name and coordinates, which serve as its code in the system.[3:1] Pasal 7 treats the data as valid only if the system has passed a connectivity test with the ministry's data centre, is built and operated according to its operating manual, functions properly, takes a reading every hour, and computes daily averages from at least 85 per cent, or 20, valid readings.[3:2]

The data must meet the applicable effluent standards. Under Pasal 8, in abnormal conditions (a temporary shutdown and restart of production, calibration, or another condition preventing optimal use of the system) results may exceed the standard for no more than 5 per cent of the daily averages over one month. An operator whose readings exceed a limit must repair its treatment system, and must document abnormal conditions and report them to the regent or mayor within 72 hours.[3:3] Devices must be maintained and tested periodically and calibrated monthly, or as their manual requires.[10]

Manual monitoring and reporting

Continuous monitoring does not replace sampling. Operators must monitor manually, once a month, the parameters not covered by the device and the compliance points without one, and must sample weekly when a device is out of service for between one and three months; manual analysis must be done by a laboratory accredited or registered with the ministry.[4:1] Pollution loads are calculated from both continuous and manual results.[4:2]

Hourly concentration and pollution-load figures are reported to the minister, the governor and the regent or mayor through the ministry's data centre, with a monthly recapitulation through the online reporting system; Lampiran IV gives the report format.[4:3] Operators were given two years from the regulation's signing to install Sparing, and governors, regents and mayors were required to prepare their own data centres, with computing equipment, internet access and competent staff.[11]

Relationship to other instruments

The effluent limits that Sparing data are checked against are set elsewhere, chiefly in Permen LH 5/2014 on wastewater quality standards and in sector instruments such as Permen LH 9/2006 for nickel mining and Permen LH 3/2010 for industrial estates, both of whose sectors appear on the Sparing list.[2:2] Later instruments refer back to the system: Permen LHK 5/2022, on treating mining wastewater in constructed wetlands, requires automatic continuous monitoring to follow the rules on the continuous and online monitoring system.[12] The 2019 amendment reduced the list of obliged sectors to twelve and replaced the parameter table and the device specification, as described at Permen LHK 80/2019.[5:1]
