Peraturan Menteri Lingkungan Hidup 9/2006 is a regulation of the Indonesian State Minister of the Environment, Peraturan Menteri Negara Lingkungan Hidup Nomor 09 Tahun 2006 tentang Baku Mutu Air Limbah bagi Usaha dan/atau Kegiatan Pertambangan Bijih Nikel, which sets the effluent quality standards for wastewater from nickel ore mining and processing. It was signed on 13 September 2006 and took effect on that date.[1] It is one of the sector standards within wastewater regulation in Indonesia and one of the environmental instruments applying to the nickel industry described at mining and energy regulation in Indonesia.

The regulation sets separate maximum concentrations for wastewater from mining and from ore processing, covering pH, suspended solids and nine metals, and prohibits meeting them by dilution. It requires treatment before discharge, a studied and permitted point of compliance, daily self-monitoring, monthly laboratory analysis and quarterly reporting, and requires the regent or mayor to write these duties into the wastewater discharge permit.[2][3][4] Provinces may set stricter standards, and a stricter standard required by an environmental impact assessment prevails.[5]

Background

The regulation was made to implement Pasal 21 ayat (1) of Peraturan Pemerintah 82/2001 on water quality management and water pollution control, and cites among its legal bases the 1967 mining law and UU 23/1997 on environmental management, the statute that preceded UU 32/2009.[6] It defines the nickel ore business broadly, as the mining of nickel ore together with its processing into semi-finished products or nickel metal, and including the closure of the mining site; processing covers crushing, grinding, flotation, leaching, concentration, drying, smelting and refining.[7] CRPG's regulatory tracker published an analysis of the regulation on 26 November 2025.[8]

Scope and standards

Two streams are regulated: water from mining operations whose quality has been changed by, and in direct connection with, the mining, and wastewater from ore processing discharged to a water body.[9] Standards for the closure of mining sites were to be set by a separate ministerial regulation; until then, the annex applies to closure as well.[10]

The annex gives maximum concentrations for mining and for processing. Both must keep pH between 6 and 9. The total suspended solids limit is 200 mg/L for mining and 100 mg/L for processing. The metal limits are identical for the two: copper 2 mg/L, cadmium 0.05 mg/L, zinc 5 mg/L, lead 0.1 mg/L, nickel 0.5 mg/L, hexavalent chromium 0.1 mg/L, total chromium 0.5 mg/L, iron 5 mg/L and cobalt 0.4 mg/L, measured by the Indonesian national standard (SNI) methods listed. The annex bars reaching these values by diluting the wastewater with water drawn directly from a water source.[4:1]

The limits may not be exceeded at any time. Where they are exceeded because operations have stopped until they restart, or because of rainfall above normal at the mining site according to research or meteorological data, the operator must report the event and its pollution-control response to the regent or mayor, with copies to the governor and the minister.[11]

Compliance point, monitoring and permits

Operators must treat their wastewater so that the discharge does not exceed the annex.[2:1] They must study the location of the compliance point (titik penaatan), which must lie on the outlet of the runoff treatment system or of the processing wastewater treatment system before discharge, and be kept free of the influence of other activities; the regent or mayor sets it as part of the wastewater discharge permit, and a change of location requires a fresh study and approval.[12]

Operators must self-monitor pH and suspended solids daily, have all annex parameters analysed by an accredited laboratory at least monthly, and report the results at least every three months to the regent or mayor, with copies to the governor, the minister and other agencies. The regent or mayor must include the non-exceedance, treatment, compliance-point and monitoring duties in the discharge permit.[3:1]

Relationship to other instruments

A province may set its own standard for nickel mining by provincial regulation, provided it is the same as or stricter than the annex, and the annex applies until it does. Where an environmental impact assessment (AMDAL) or an environmental management and monitoring plan (UKL-UPL) requires a stricter standard, that standard applies.[5:1] Earlier standards looser than the regulation had to be brought into line within one year, while stricter earlier standards remained in force.[13]

The general effluent regulation of 2014, Permen LH 5/2014, does not list the nickel standard among the instruments it revoked.[14] Nickel mining is one of the sectors obliged to operate continuous online wastewater monitoring under Permen LHK 93/2018, monitoring pH, suspended solids and flow,[15] and Permen LHK 5/2022 sets a separate table of limits for nickel ore wastewater treated in constructed wetlands.[16]
