Peraturan Menteri Lingkungan Hidup 3/2010 is a regulation of the Indonesian State Minister of the Environment, Peraturan Menteri Negara Lingkungan Hidup Nomor 03 Tahun 2010 tentang Baku Mutu Air Limbah bagi Kawasan Industri, which sets the effluent quality standards for industrial estates that treat their tenants' wastewater in a central treatment plant. It was signed on 18 January 2010 and replaced a 1998 ministerial decree on the same subject.[1][2] It is one of the sector standards within wastewater regulation in Indonesia.
The standards are expressed both as maximum concentrations of sixteen parameters and as a maximum volume of wastewater per hectare of occupied estate land.[3][4] The regulation places the duty of compliance on the party responsible for the estate, requires daily flow and pollutant monitoring, monthly laboratory analysis and quarterly reporting, and requires these duties to be written into the estate's wastewater discharge permit.[5][6] Provinces may adopt stricter standards or additional parameters.[7] The regulation carries no sanctions of its own; breaches are fined under the general administrative sanctions for environmental violations.[8][9]
The regulation was made to implement Pasal 20 ayat (5) of UU 32/2009 on environmental protection and management, and its preamble reasons that industrial estates can pollute the environment, so that water pollution must be prevented by fixing their effluent standards. Its legal bases also include the 1984 industry law, the 2004 water resources law, Peraturan Pemerintah 82/2001 on water quality management and water pollution control, and Peraturan Pemerintah 24/2009 on industrial estates.[10]
An industrial estate is defined as an area concentrating industrial activity, equipped with supporting infrastructure and developed and managed by an estate company holding an industrial estate business licence. A central wastewater treatment plant (IPAL terpusat) is one that treats wastewater from all the industries in the estate and their supporting activities.[11] CRPG's regulatory tracker published an analysis of the regulation on 26 November 2025.[12]
Pasal 2 applies the estate standard only to an estate that already has a central treatment plant; where it has none, each business is governed by the effluent standard for its own type of activity.[3:1] The estate standard may not be exceeded at any time.[13]
The annex sets maximum concentrations of pH 6-9; 150 mg/L total suspended solids; 50 mg/L biochemical oxygen demand; 100 mg/L chemical oxygen demand; 1 mg/L sulphide; 20 mg/L ammonia (as NH3-N); 1 mg/L phenol; 15 mg/L oil and grease; 10 mg/L detergents (MBAS); 0.1 mg/L cadmium; 0.5 mg/L hexavalent chromium; 1 mg/L total chromium; 2 mg/L copper; 1 mg/L lead; 0.5 mg/L nickel; and 10 mg/L zinc. The maximum quantity of wastewater is 0.8 litres per second per hectare of occupied estate land, defined as the land held by tenants under sale or lease agreements that discharge to the central plant.[4:1][11:1] The ammonia limit does not apply to estates whose industries mostly use raw materials containing ammonia; for them the ammonia parameter is set by regional regulation.[14]
The party responsible for the estate must comply with the annex and manage its wastewater so that the discharge does not exceed it. It must use watertight wastewater channels, must not dilute its effluent (including by mixing cooling water into the discharge from the central plant), and must separate wastewater channels from storm drains. It must set a compliance point for sampling, install a flow meter and record daily flow, monitor pH and COD daily, and have all parameters analysed at least monthly by a laboratory accredited and registered with the environment ministry. Flow records, daily monitoring and laboratory results are reported at least every three months to the regent or mayor, with copies to the governor, the minister and other agencies, and emergencies or abnormal events causing an exceedance must be reported within 48 hours together with the response taken.[5:1]
The regent or mayor must write the applicable standard and these duties into the permit for an estate discharging to a water source; for discharges to the sea, the same duty falls on the minister, or on a governor to whom the minister has delegated sea-discharge permitting.[6:1]
A provincial government may set, by provincial regulation, a standard for industrial estates that is the same as or stricter than the annex, and may add parameters with the minister's approval. The minister must decide on such a request within 90 working days, failing which it is deemed approved, and must give reasons for a refusal. A stricter provincial standard prevails, as does a stricter standard required by an environmental impact assessment (AMDAL), an environmental management and monitoring plan (UKL-UPL), or a study of the estate's wastewater discharge.[7:1] Estate standards looser than the regulation had to be brought into line within one year of its signing.[15]
Pasal 12 revoked Decree KEP-03/MENLH/1/1998 on liquid waste standards for industrial estates. Pasal 13 provides that the regulation takes effect one year from the date of its signing.[2:1] The general effluent regulation of 2014, Permen LH 5/2014, does not list it among the instruments it revoked.[16] Industrial estates are one of the sectors obliged to operate continuous online wastewater monitoring under Permen LHK 93/2018; since the 2019 amendment they monitor pH, COD, suspended solids, ammonia and flow.[17]
The regulation contains no sanctions of its own.[8:1] Breaches are enforced through the administrative sanctions of PP 22/2021, under which a person responsible for an activity that exceeds the wastewater quality standard in its business licence is liable to an administrative fine, paid as non-tax state revenue and imposed together with government coercion (paksaan pemerintah).[9:1]
