Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat 21/2021 (Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 21 Tahun 2021 tentang Penilaian Kinerja Bangunan Gedung Hijau) is an Indonesian ministerial regulation that sets the technical standards for green buildings (bangunan gedung hijau, BGH), the method for assessing their performance, and the rating and certification of buildings, residential clusters and estates that meet them. It was signed by the Minister of Public Works and Public Housing on 31 March 2021 and took effect on its promulgation on 1 April 2021, to implement Pasal 123 of Peraturan Pemerintah 16/2021 on buildings.[1][2] Its certificates are issued by regency and city governments through the national building information system, which places it among the licensing rules described at public administration in Indonesia.

The regulation defines a green building as one that meets the building technical standards and has significant, measurable performance in saving energy, water and other resources.[3] It makes the standards mandatory for large buildings of certain classes and recommended for all others, and applies them at each stage of a building's life, from programming through design, construction and use to demolition.[4]

Performance is scored against a checklist, verified by the regency or city's panel of experts and rated at one of three levels, Pratama, Madya and Utama. Certificates are issued free of charge and last five years, the term of the certificate of functional worthiness.[5][6] The regulation revoked Permen PUPR 02/PRT/M/2015, the earlier green building regulation.[7]

Background

Peraturan Pemerintah 16/2021 is the implementing regulation of the buildings law, Undang-Undang 28/2002, and the ministerial regulation also cites the Job Creation law, Undang-Undang 11/2020, among its bases. It was issued to implement Pasal 123 of the government regulation, and was signed and promulgated on the same days as Permen PUPR 20/2021 on special-function buildings, which implements another provision of the same government regulation.[1:1][2:1][8]

Scope and principles

Pasal 2 sorts the objects of the standards into seven orders (ordo): new and existing buildings in a mandatory category, new and existing buildings in a recommended category, community green housing clusters (Bangunan Gedung Hunian Hijau Masyarakat, H2M), and new and existing green estates (Kawasan Hijau). The mandatory category covers buildings of classes 4 and 5 above four storeys with a floor area of at least 50,000 square metres; classes 6, 7 and 8 above four storeys with at least 5,000 square metres; class 9a above 20,000 square metres; and class 9b above 10,000 square metres.[4:1] The annex describes class 5 as offices and commercial premises, class 6 as shops, class 7 as storage, class 8 as laboratories and production buildings, class 9a as health care buildings and class 9b as public assembly buildings; class 4 is a dwelling inside a building of one of those classes.[9] All other buildings, and H2M and green estates, fall in the recommended category.[4:2]

Pasal 3 lists eleven principles, among them reducing the use of land, materials, water and other resources; reducing waste; reuse and recycling; mitigating safety, health, climate change and disaster risks; and orientation to the life cycle.[4:3] Under Pasal 4, a green building must meet the general building technical standards and, in addition, the green building standards at each stage. Service providers must involve a green building expert who holds a certificate of work competence for the field or has been trained in green building assessment.[4:4]

Performance standards by stage

At the technical design stage, performance is judged on seven parameters: site management, energy efficiency, water efficiency, indoor air quality, environmentally friendly materials, waste management, and wastewater management.[10] The energy criteria cover the building envelope, ventilation, air conditioning, lighting, vertical transport, energy-efficiency calculation and the electrical system; the water criteria cover sources, consumption and water-saving fittings; and the wastewater criteria require treatment before discharge to the municipal sewer and the recycling of domestic wastewater, matters otherwise governed by the rules described at wastewater and sanitation regulation in Indonesia.[10:1]

The construction stage is assessed on conformity with the design and on green construction processes, behaviour and supply chains; the use stage on the building's management, the maintenance of its performance and the role of occupants; and demolition on a deconstruction approach that documents materials for reuse and restores the site.[11] Existing buildings are assessed at the use and demolition stages, the use-stage assessment covering the design and construction of any retrofit. Existing buildings that never held a certificate adapt through retrofitting, in stages or in part, and heritage buildings do so under the rules on conservation as well.[12]

Community housing and green estates

Groups of houses may pursue green status collectively as an H2M, on the community's initiative and with support from the regency or city government. The collective indicators include cutting average energy consumption by at least 25 per cent and water consumption by at least 10 per cent, managing waste within the community, using local and environmentally friendly materials, and making use of green yard space.[13][14] A green estate must cover at least one hectare, contain at least two buildings and be held by a single manager.[13:1]

Rating and certification

Ratings are awarded at three levels, BGH Pratama, BGH Madya and BGH Utama, on the share of the total checklist score achieved. The annex sets the minimum at 45 per cent: 45 to 65 per cent earns Pratama, more than 65 up to 80 per cent Madya, and more than 80 per cent Utama.[5:1][6:1] A new building in the mandatory category must hold certificates for the technical design, construction and use stages, and an existing mandatory building for the use stage.[5:2]

The service provider carries out the assessment with the checklist and uploads it to the building management information system (Sistem Informasi Manajemen Bangunan Gedung, SIMBG). The regency or city panel of experts (Tim Profesi Ahli, TPA) verifies it through document checks, meetings or field observation, sets the rating and recommends it to the head of the regency or city technical agency, who issues the certificate electronically without charge. A design-stage certificate requires a building approval (Persetujuan Bangunan Gedung, PBG), a construction-stage certificate a certificate of functional worthiness (Sertifikat Laik Fungsi, SLF), and a use-stage certificate an extended SLF; a certificate is valid for five years, the term of the SLF.[5:3] Owners and managers of green buildings may receive incentives from provincial and regency or city governments in accordance with the law.[15]

Guidance and revocation

The minister is responsible for green building administration and sets a roadmap; guidance takes the form of regulation, empowerment and supervision, and the central government supervises its application in the regions.[16] Pasal 42 places the detailed rules in the annex, and Pasal 43 revoked Permen PUPR 02/PRT/M/2015 on green buildings (Berita Negara 2015 No. 309).[7:1]

Relationship to other instruments

The Job Creation law cited in the preamble, UU 11/2020, was revoked by the regulation in lieu of law Perppu 2/2022, which was enacted as law by Undang-Undang 6/2023. Pasal 23 of the Perppu amends the buildings law to ease the process of obtaining the building approval and the certificate of functional worthiness.[17] Under PP 28/2025, a business that will construct a building must hold a building approval as a basic requirement for its business licence.[18]

CRPG's regulatory tracker published an analysis of the regulation on 26 November 2025.[19]
