Peraturan Presiden 83/2018 (Peraturan Presiden Nomor 83 Tahun 2018 tentang Penanganan Sampah Laut) is an Indonesian presidential regulation on the handling of marine debris. It was signed by President Joko Widodo on 17 September 2018 and promulgated on 21 September 2018, taking effect on promulgation, and was recorded as Lembaran Negara 2018 No. 168.[1] It adopted the National Action Plan for Marine Debris Handling 2018–2025 (Rencana Aksi Nasional Penanganan Sampah Laut Tahun 2018-2025) and set up a national coordination team under the President to carry it out.[2][3] It forms part of solid waste management law of Indonesia.

The preamble links the regulation to the Indonesian government's commitment to handle 70 per cent of plastic waste in the sea by 2025.[4] The action plan rests on five strategies, from public awareness and land-based waste management to funding, law enforcement and research, and is a guide for sectoral policy and for regional governments, which are to draw up their strategic plans in line with the national household waste strategy of Peraturan Presiden 97/2017.[2:1][5]

The coordination team is chaired by the Coordinating Minister for Maritime Affairs, with the Minister of Environment and Forestry as daily chair, and reports on the action plan to the President at least once a year.[6][7] The regulation also provides for the integration of the action plan with development planning, its periodic review, and its funding.[8][9] CRPG's regulatory tracker published an analysis of the regulation in December 2025.[10]

Background

The preamble states that debris in the sea pollutes and damages the environment and aquatic ecosystems and endangers human health, that micro- and nano-sized plastic has been found in marine biota and resources in Indonesian waters, and that plastic waste is the component most resistant to natural decomposition.[4:1] To follow up the government's commitment to handle 70 per cent of marine plastic waste by 2025, it calls for integrated measures to accelerate the handling of marine debris and for integrated planning, budgeting and organisation.[4:2] Among the laws it cites are Undang-Undang 18/2008 on waste management, the laws on coastal areas and small islands and on marine affairs, Peraturan Pemerintah 81/2012 on household waste, the presidential regulation on Indonesian ocean policy and Peraturan Presiden 97/2017.[4:3]

Provisions

Definitions

Pasal 1 defines marine pollution as the entry of living organisms, substances, energy or other components into the marine environment through human activity so that the established seawater quality standard is exceeded. Waste (sampah) is the solid residue of daily human activity or natural processes; marine debris (sampah laut) is waste from land, water bodies and coasts that flows into the sea, or waste from activities at sea; and plastic waste is waste containing polymer compounds.[11]

The action plan

Pasal 2 requires synergistic, measurable and directed strategies, programmes and activities to reduce the amount of debris in the sea, especially plastic, in the form of the action plan. The plan is a planning document that gives strategic direction to ministries and agencies and a reference for the public and businesses over eight years, from 2018 to 2025.[2:2] It is implemented through five strategies: a national movement to raise stakeholder awareness; management of land-based waste; handling of waste on coasts and at sea; funding mechanisms, institutional strengthening, supervision and law enforcement; and research and development.[2:3] The plan itself is set out in the annex to the regulation.[2:4][12]

Under Pasal 3, the plan guides ministers and heads of non-ministerial agencies in setting sectoral policy on marine debris in their strategic plans, and regional governments in preparing their own acceleration policies. In drawing up their strategic plans, ministers, agency heads, governors, regents and mayors are to refer to the rules on the national policy and strategy for household waste and similar waste.[5:1]

National coordination team

Pasal 4 establishes the National Coordination Team for Marine Debris Handling (Tim Koordinasi Nasional Penanganan Sampah Laut), placed under and directly responsible to the President. Its tasks are to coordinate the activities of ministries, agencies, regional governments, the public and businesses on marine debris; to formulate policies to resolve obstacles to implementation; and to coordinate monitoring and evaluation of the action plan.[3:1][13]

The team is chaired by the Coordinating Minister for Maritime Affairs, with the Minister of Environment and Forestry as daily chair. Its members are the ministers of home affairs, foreign affairs, finance, industry, transportation, marine affairs and fisheries, public works and housing, health, education and culture, research, technology and higher education, communication and informatics, national development planning, cooperatives and small and medium enterprises, and tourism, together with the Cabinet Secretary and the head of the Maritime Security Agency.[6:1] A director general of the Ministry of Environment and Forestry responsible for waste and hazardous substances is its secretary.[6:2] An implementing team, whose membership and tasks the chair sets on the daily chair's proposal, assists the team, and the same directorate general functionally provides its secretariat.[14] The chair and daily chair report on the implementation of the action plan to the President at least once a year, or whenever needed.[7:1]

Planning, review and funding

The action plan is integrated with the national medium-term development plan for 2015–2019 and its successors, and at regional level with regional medium-term development plans. It may be reviewed periodically, with programmes and activities adjusted to national priorities; review is carried out by the ministries and agencies and coordinated by the Coordinating Minister for Maritime Affairs with the Minister of National Development Planning.[8:1] The costs of the implementing team and the secretariat are borne by the state budget, and the programmes and activities of the action plan are funded from the state budget, regional budgets and other lawful, non-binding sources.[9:1]

Relationship to other instruments

The regulation was issued a year after Peraturan Presiden 97/2017, which sets the national policy and strategy for managing household waste and similar waste, and it directs sectoral and regional strategic plans on marine debris to follow that strategy.[5:2] Both rest on Undang-Undang 18/2008 and Peraturan Pemerintah 81/2012, which it cites among its legal bases.[4:4]
