Peraturan Wali Kota Batu 18/2026 (Peraturan Wali Kota Batu Nomor 18 Tahun 2026 tentang Pengadaan Barang/Jasa Badan Layanan Umum Daerah Pusat Kesehatan Masyarakat) is a mayoral regulation of the city of Batu, in East Java, that governs the procurement of goods and services by the city's community health centres (Pusat Kesehatan Masyarakat, Puskesmas) operating as regional public service agencies (Badan Layanan Umum Daerah, BLUD). It was signed and promulgated on 3 March 2026 as Berita Daerah Kota Batu 2026 No. 18/E and took effect on promulgation.[1] It forms part of the field described at health sector regulation in Indonesia, and was issued to implement Pasal 77 ayat (1) of Permendagri 79/2018 on regional public service agencies.[2]
The regulation applies to procurement that is not funded from the regional budget but from the health centres' own service income, untied grants, the proceeds of cooperation with other parties and other lawful BLUD revenue.[3] It names the officials who take part in procurement and their duties, sets the methods for selecting suppliers, fixes value bands for each method and each form of contract document, and requires procurement plans and contract data to be entered in the national electronic procurement systems.[4][5][6]
A crpg.id post of August 2026 reported the instrument under the RegVault identifier PMK 18/2026, a label that suggests a regulation of the Minister of Finance; the text is a regulation of the Mayor of Batu, and has nineteen articles.[7][1:1]
A BLUD is defined in the regulation as a system applied by a technical implementation unit of a regional office or agency in serving the public, with flexibility in financial management as an exception to the general rules on regional finance; a Puskesmas is the regional government's first-level health facility, which provides and coordinates promotive, preventive, curative, rehabilitative and palliative services in its working area.[8]
Under Permendagri 79/2018, procurement by a BLUD funded from the regional budget follows the general rules on government procurement, while procurement funded from service income, untied grants, cooperation with other parties and other lawful BLUD revenue is given flexibility in the form of a partial or full exemption from those rules. Pasal 77 of the ministerial regulation leaves the detail of that flexible procurement to a regulation of the regional head, with the aim of securing better and cheaper goods and services through a simple and quick process.[9] The preamble of the Batu regulation cites that provision as its sole ground, and its Mengingat clause lists, among others, UU 23/2014 on regional government, PP 12/2019 on regional financial management and Perda Kota Batu 4/2024 on regional financial management.[2:1]
Pasal 2 describes the regulation as a guideline for procurement not funded from the regional budget, and Pasal 3 lists the four sources of funding it covers, the same four named in Permendagri 79/2018.[3:1][9:1] Procurement may be of goods, construction works, consultancy services or other services, may be integrated, and may be carried out by self-management (swakelola) or through suppliers. Its stages run from procurement planning and preparation through the preparation and conduct of selection to the handover of the contract and of the completed work.[10] The staff responsible must be civil servants who understand procurement in the health centres, as shown by a certificate of competence, a training certificate or experience.[11]
Pasal 6 names seven actors: the budget user (Pengguna Anggaran, PA), the budget user's proxy (Kuasa Pengguna Anggaran, KPA), the commitment-making official (Pejabat Pembuat Komitmen, PPK), the procurement official (Pejabat Pengadaan), the selection working group (Pokja Pemilihan), the self-management organiser and the supplier.[4:1]
The PA takes the actions that commit spending, enters agreements within the budget, sets the procurement plan and announces the general procurement plan (Rencana Umum Pengadaan, RUP), consolidates procurement, orders direct appointment after a failed tender, imposes blacklisting, and appoints the PPK, the procurement official, the self-management organiser and technical teams. It may also adjust procedures, methods and contract types to fill a legal gap or overcome administrative stagnation in the public interest, and determines the winning supplier in the larger tenders. The PA may delegate these powers to a KPA, whose delegation is set by the mayor on the proposal of the head of the regional office; the KPA also decides appeals by bidders in construction tenders, may assign spending and contracting powers to the PPK, and may perform the PPK's duties itself if it has the necessary knowledge.[12]
The PPK prepares procurement planning and consolidation, sets technical specifications, the draft contract and the owner's estimate (harga perkiraan sendiri), fixes advance payments, carries out e-purchasing above 200 million rupiah, issues letters of appointment, enters and controls electronic contracts, reports to the PA or KPA, hands over the work with a handover record, keeps the implementation documents and assesses supplier performance.[13] The procurement official conducts direct procurement, direct appointment up to 200 million rupiah for goods and other services, 400 million rupiah for construction works and 100 million rupiah for consultancy, and e-purchasing up to 200 million rupiah.[14] The selection working group, of three or another odd number of members, conducts other selections and determines winners in tenders of up to 100 billion rupiah and consultancy selections of up to 10 billion rupiah.[15] Self-management is run by preparation, implementation and supervision teams, and suppliers are answerable for the contract, the quality of the goods or services, the accuracy of quantities, and timely delivery.[16]
Pasal 14 provides four methods for selecting suppliers: e-purchasing from the electronic catalogue, direct procurement (pengadaan langsung), direct appointment (penunjukan langsung) in specified circumstances, and tender or, for consultancy above 100 million rupiah, selection.[5:1] Pasal 15 sets the value bands. Goods and other services up to 200 million rupiah, construction works up to 400 million rupiah and consultancy up to 100 million rupiah may be procured directly by the procurement official; above those values, goods, other services and construction works go to tender through the city's procurement unit (Unit Kerja Pengadaan Barang/Jasa, UKPBJ), and consultancy to selection through the working group. E-purchasing has no value limit.[5:2]
Pasal 16 fixes the contract document required for each band. For goods and other services, a proof of purchase suffices up to 10 million rupiah and a receipt up to 50 million rupiah; a work order (surat perintah kerja) is required above 50 million and up to 200 million rupiah, and a written agreement above that. For construction works and consultancy, a work order covers values up to 400 million and 100 million rupiah respectively, and a written agreement is required above them. An order form serves for e-purchasing.[5:3]
Procurement may be carried out electronically. Each health centre must announce its procurement plans in the general procurement plan system (Sistem Rencana Umum Pengadaan, SIRUP) and submit its contract data to the electronic procurement system.[6:1] Further technical rules are left to a regulation of the head of the city health office; until one is issued, procurement follows the general regulations on procurement.[17] The regulation took effect on the date of its promulgation.[1:2]
