Peraturan Pemerintah 33/2023 (Peraturan Pemerintah Nomor 33 Tahun 2023 tentang Konservasi Energi) is an Indonesian government regulation on energy conservation. It was signed by President Joko Widodo on 16 June 2023 and took effect on its promulgation the same day, in Lembaran Negara 2023 No. 83 (Tambahan Lembaran Negara No. 6879).[1] It replaced Peraturan Pemerintah 70/2009 on the same subject, and is part of the body of rules surveyed at mining and energy regulation in Indonesia and carbon trading and climate regulation in Indonesia.[2][3]
The regulation applies energy conservation to the whole chain of energy management, from the conservation of energy resources upstream to efficiency in the supply and use of energy downstream. It obliges energy providers using 6,000 tonnes of oil equivalent a year or more, transport and industrial users of 4,000 tonnes or more, and building users of 500 tonnes or more to practise energy management, and it obliges the central and regional governments to do so for their own facilities without any threshold.[4][5][6]
It also provides for energy performance standards and energy-saving labels on appliances, the financing of conservation, energy conservation service businesses, incentives for successful conservation and disincentives for failing to manage energy, and supervision by the ministers, governors and regents concerned.[7][8][9][10] Its provisions on energy conservation services are implemented by Permen ESDM 1/2026.[11] CRPG's regulatory tracker published two analyses of the regulation in November 2025.[12][13]
The preamble states that, to preserve domestic energy resources and improve the efficiency of their use, energy conservation had to be extended to more energy users and users of energy sources, thresholds for energy consumption had to be lowered, conservation within central and regional government had to be regulated and energy conservation service businesses had to be developed; on that basis PP 70/2009 no longer met the need and had to be replaced. The regulation rests on Pasal 5 ayat (2) of the Constitution and on the Energy Law, UU 30/2007.[2:1] The elucidation adds that energy is a basic need of sustainable economic development and must be used sparingly, rationally and wisely so that present and future needs can be met.[14]
Pasal 1 defines energy conservation (konservasi energi) as a systematic, planned and integrated effort to preserve domestic energy resources and increase the efficiency of their use. Energy management (manajemen energi) is an integrated activity to control energy consumption so that energy is used effectively and efficiently, and an energy audit is the evaluation of energy use and the identification of opportunities for savings.[15]
Under Pasal 2 to Pasal 5, conservation covers upstream management, where it takes the form of conserving energy resources by setting which resources are prioritised, how much may be produced and which may not be exploited for a period, and downstream management, where it aims at energy efficiency through energy-saving behaviour and efficient technology in the supply and the use of energy. Energy providers carry out conservation in supply; users of energy sources and users of energy carry it out in use.[16]
Pasal 6 lists eight conservation programmes: energy management, energy performance standards and labels, conservation financing, the development of energy conservation service businesses, awareness raising, human resource capacity, research and innovation, and cooperation.[16:1] Energy management consists of appointing an energy manager holding a competency certificate, preparing an energy efficiency programme, carrying out periodic energy audits by certified internal or external auditors, and implementing the audit recommendations, which are reported in the energy management report.[17] Producers and importers of energy-using appliances must attach a minimum energy performance label or an energy-saving label, and the technology used must meet domestic component requirements.[7:1] Conservation is financed by the providers and users themselves or other lawful sources, and the government is to work with Bank Indonesia and the Financial Services Authority to encourage financial institutions to support it.[8:1]
Energy conservation services may be provided by business entities, public service agencies and technical implementation units, and consist of investment-grade energy audits, the financing of energy efficiency projects through energy saving performance contracts, installation and construction, operation and maintenance, and the measurement and verification of energy performance by certified verifiers. Pasal 23 leaves the details to a ministerial regulation.[8:2]
Pasal 29 requires an energy provider that uses 6,000 tonnes of oil equivalent (setara ton minyak) a year or more in exploiting energy resources or producing energy to conserve energy through energy management and to report on it to the minister every year; smaller providers may do so voluntarily.[4:1] Users are divided into four sectors: transport, industry, households and buildings. The threshold for mandatory energy management is 4,000 tonnes of oil equivalent a year for transport and industry and 500 tonnes for buildings, and implementation is reported to the minister every year. Households conserve energy by using efficient appliances.[5:1] The elucidation equates the transport threshold with a fleet of 300 taxis or 200 trucks or buses, and the building threshold with electricity use of 5.8 gigawatt-hours a year or a floor area of 20,000 square metres, in offices, hotels, shopping centres, hospitals, educational institutions, apartments and transport buildings such as airports and stations.[14:1]
Under Pasal 37 the central government, provincial governments and district and city governments must conserve energy through energy management in their own use of energy; the thresholds do not apply to them. Ministries and agencies act under the coordination of the energy minister, regional agencies under the governor or regent, and budgets are to be allocated for the purpose. Regents report to governors, governors and heads of ministries report to the minister once a year, and the minister's evaluation of the results is sent to the ministers for the civil service and for home affairs and used as an indicator of institutional performance.[6:1] Pasal 45 gives the public a role through energy-saving technology, household savings, mass transport and awareness.[6:2]
The central and regional governments are to ease access to information, consultancy and financing for providers, users, producers and importers that conserve energy, and may grant fiscal or non-fiscal incentives to providers, transport, industrial and building users and producers of energy-saving equipment that succeed in conservation over a given period, measured by improved energy performance proven by a measurement and verification report.[9:1] A provider or user that fails to carry out mandatory energy management faces disincentives imposed by the minister: up to three written warnings of at most one month each, then publication of its name in the mass media, and one month later a recommendation to the minister, governor or regent concerned to withdraw any incentives it has received.[9:2]
Governments, state- and regionally-owned enterprises and businesses share data and information on conservation, and the central government standardises and develops the data system.[18] The energy minister, the ministers and heads of agencies concerned, governors and regents supervise implementation within their powers through energy conservation supervisory officials, and report the results to the energy minister for evaluation.[10:1]
Energy management already carried out before the regulation took effect is recognised until the end of the reporting period. The obligations of transport, industrial and building users took effect twelve months after promulgation, in June 2024. Implementing regulations of PP 70/2009 remain in force so far as they are consistent, and PP 70/2009 is revoked.[19][3:1]
