Peraturan Menteri Kehutanan 7/2026 (Peraturan Menteri Kehutanan Nomor 7 Tahun 2026 tentang Perubahan atas Peraturan Menteri Kehutanan Nomor 27 Tahun 2025 tentang Pemanfaatan Jasa Lingkungan pada Kawasan Suaka Alam, Kawasan Pelestarian Alam, dan Taman Buru) is an Indonesian ministerial regulation that amends the 2025 rules on the use of environmental services in nature reserves, nature conservation areas and hunting parks, and is concerned almost entirely with the licensing of carbon environmental services in those areas. It was signed by the Minister of Forestry on 20 April 2026 and took effect on its promulgation on 21 April 2026.[1][2] It forms part of the body of rules described at carbon trading and climate regulation in Indonesia and forestry and land use regulation in Indonesia.
Its preamble gives two reasons for the amendment: to encourage the use of carbon environmental services in nature conservation areas and hunting parks by simplifying several of the provisions that govern it, and to bring the 2025 regulation into line with later legislation and public needs.[3] The amendment rewrites the definitions, the application requirements and fee payment for the carbon environmental services business licence (PB-PJL Karbon), the conditions attached to carbon trading under the licence, the activities that may not generate tradable offsets, and the licence holder's obligations and prohibitions.[4]
It was issued two weeks after Permenhut 6/2026 on forestry carbon offsets, and both regulations cite Perpres 110/2025 on the carbon economic value instrument among their legal bases.[3:1][5] The national forestry plan, revised by the same minister on the following day, sets aside conservation forest for carbon economic value, and the environmental approval required of an applicant is subject to the environment ministry's rules on supervision.[6][7] CRPG's regulatory tracker published an analysis of the amendment in July 2026.[8]
Peraturan Menteri Kehutanan Nomor 27 Tahun 2025 (Berita Negara 2025 No. 1082) governs the use of environmental services in nature reserves (kawasan suaka alam), nature conservation areas (kawasan pelestarian alam) and hunting parks (taman buru). As amended, its Pasal 1 lists geothermal, water and hydropower, nature tourism, hunting parks, wind, solar and carbon among the forms that such use may take.[9] The amending regulation cites among its legal bases the conservation law, Undang-Undang 5/1990 as amended by Undang-Undang 32/2024, the forestry law, Undang-Undang 41/1999, PP 28/2025 on risk-based business licensing, and Perpres 110/2025.[3:2]
Carbon environmental services (PJL Karbon) are defined as the use of an ecosystem's potential to absorb and store carbon in national parks, nature tourism parks, grand forest parks (taman hutan raya, Tahura) and hunting parks. The PB-PJL Karbon is the business licence granted to use those services, and is defined as serving to increase funding and public support for maintaining and improving the regulating functions of the ecosystem.[9:1]
Pasal I angka 1 deletes two definitions from Pasal 1 (angka 94 and 97) and inserts two new ones. The first, the Iuran PB-PJL Karbon, is a fee charged on the licence for a commercial carbon business in national parks, grand forest parks and nature tourism parks; the second, the Pungutan PB-PJL Karbon, is a levy charged on every carbon trading transaction carried out by a licence holder in its business area.[9:2] The amended Pasal 493 confirms that the licence is granted through the Online Single Submission (OSS) system to business actors holding a business identification number, lists the eligible entities (state-owned and regional enterprises, limited liability companies, limited partnerships, village enterprises, cooperatives and foreign business entities), and adds a new ayat (5) subjecting foreign entities to the applicable legislation.[10]
The amended Pasal 495 requires an application to be made to the minister, governor or regent or mayor, according to their authority, through the OSS system, with six documents: a principle approval, the environmental approval (Persetujuan Lingkungan) and its documents, minutes and a map of boundary marking at a scale of at least 1:25,000, a map of the proposed business area at a scale of at least 1:10,000 with a digital shapefile, a carbon business plan (RP-PJL Karbon), and proof of payment of the fee or of a regional retribution. Where the type and rate of the fee have not yet been regulated, the applicant instead signs an integrity pact committing to pay from the date the licence is issued.[11]
The amended Pasal 501 distinguishes the fee payable in national parks, nature tourism parks and hunting parks, which is the first-year fee set under the forestry non-tax revenue legislation, from the retribution payable in grand forest parks. Once the other documents are complete, the applicant pays the fee within 24 working days of receiving a payment order from the Director General or the provincial or district forestry service; payment is valid only if the payment code on the transfer or deposit slip matches the code in the online non-tax revenue system. A fee paid on an application later refused is refunded under the applicable rules.[12][9:3]
The amended Pasal 510 sets ten conditions for carbon trading under a PB-PJL Karbon. The trade must accord with the forestry carbon trading roadmap, meet eligibility tests of additionality, permanence and leakage prevention, and follow the licence holder's fulfilment of the obligations in its licence decree, including annual work plans and reports on ecosystem recovery and area protection. Offsets in nature conservation areas are confined to natural carbon removal, carbon sequestration or other categories permitted by law. The article also requires an assessment of biodiversity and social impacts, free, prior and informed consent, a safeguards mechanism, benefit sharing between the licence holder, the conservation technical unit and local communities as set by the Director General, and competence in environmental, social and governance principles and qualification in the administration of the NEK instruments on the part of the business actor.[13]
The amended Pasal 511 excludes from offset trading any reduction produced in the course of meeting a licence obligation, watershed rehabilitation, corporate social responsibility, or a cooperation agreement for strengthening area functions and unavoidable strategic development in nature reserves, nature conservation areas and hunting parks. Pasal 512 provides that trading may be domestic or foreign, in accordance with the applicable legislation.[14]
The amended Pasal 514 lists eighteen obligations of a licence holder. They include conducting the business according to conservation principles and the environmental approval, preparing and registering a DRAM or DPP (the domestic or international project design document) within six months of obtaining the licence, paying the transaction levy and the fee for the second and later years, protecting the business area, allocating funds for conservation and community empowerment, filing annual reports and five-yearly and annual plans, submitting copies of validation and verification reports, and reporting each carbon transaction, endorsed by the head of the technical unit or service, within fourteen working days. The holder must also obtain the minister's recommendation or approval for the issuance of carbon units.[15][9:4]
The amended Pasal 515 forbids a holder to treat the business area and its resources as property or possession, to transfer the licence, to pledge it as collateral, to build outside the business area, to carry out mitigation actions that depart from the business plan, and to trade existing carbon stocks that are not the result of its own mitigation actions.[16]
Permenhut 8/2026, signed by the Minister of Forestry on 21 April 2026, the day after this amendment, revised the national forestry plan for 2011 to 2030. Its first annex states that conservation forest contributes to the targets for carbon provision through an area of 2.5 million hectares prepared for the implementation of carbon economic value, and that use of conservation areas follows the zones and blocks of the conservation forest.[6:1]
The environmental approval that the amended Pasal 495 requires in every PB-PJL Karbon application is subject to supervision under Permen LH 6/2026, the environment ministry's regulation of May 2026 on supervision and administrative sanctions. Under its Pasal 2, the environment minister supervises activities whose environmental approval the minister issued, and a governor those whose approval the governor issued.[11:1][7:1]
