Peraturan Menteri Pekerjaan Umum 2/2024 (Peraturan Menteri Pekerjaan Umum Nomor 2 Tahun 2024 tentang Pedoman Pembentukan Wadah Koordinasi Pengelolaan Sumber Daya Air pada Tingkat Wilayah Sungai) is an Indonesian ministerial regulation that sets the guidelines for forming the water resources coordination bodies of river territories (wilayah sungai), known as TKPSDA WS. It was signed by the Minister of Public Works, Dody Hanggodo, on 13 December 2024 and took effect on its promulgation on 20 December 2024.[1][2] It belongs to the institutional side of the water resources law of Indonesia and implements Pasal 66 ayat (6) of Undang-Undang 17/2019 on water resources.[3][4]

The regulation distinguishes five kinds of coordination body according to the river territory they serve, and assigns their establishment to the minister, the governor or the regent or mayor. Each body is non-structural, is chaired by the head of the regional development planning agency, draws its members in balanced numbers from government and from thirteen categories of non-government organisation, and meets in plenary sessions at least four times a year, or twice for a territory within one district or city.[5][6][7][8] Its operating costs are met from the budget of the level of government that forms it.[9]

The regulation revoked Permen PUPR 17/PRT/M/2017, the earlier guideline on the same subject, and let existing bodies serve out their terms.[10] It is distinct from Permen PUPR 2/2024, a regulation of the former Minister of Public Works and Public Housing with the same number and year, signed in February 2024, on business licensing and approvals for the use of water resources.[11] It was issued on the same day as its companion Permen PU 3/2024 on provincial and district water resources councils. CRPG's regulatory tracker published two analyses of it in November 2025.[12][13]

Background

UU 17/2019 provides that coordination at river-territory level is conducted by a coordination body whose principal tasks are to align the interests of sectors, regions and stakeholders in the territory, to advise the central and regional governments on the results of that coordination, and to monitor and evaluate water resources programmes and activity plans. Its members are representatives of government agencies and of the public who represent the territory's water stakeholders. Pasal 66 ayat (6) delegates the organisation, working procedures and guidelines for forming these bodies to a ministerial regulation.[4:1]

The regulation's preamble cites UU 17/2019 as amended by UU 6/2023 on job creation, Peraturan Pemerintah 30/2024 on water resources management, Peraturan Presiden 37/2023 on the national water resources policy, Peraturan Presiden 170/2024 on the Ministry of Public Works, and the ministry's organisational regulation, Permen PU 1/2024.[3:1] It defines a river territory as a unit of water resources management covering one or more river basins and/or small islands of up to 2,000 square kilometres, and the TKPSDA WS (Tim Koordinasi Pengelolaan Sumber Daya Air Wilayah Sungai) as the coordination body at that level, an institution in which the stakeholders coordinate to integrate the interests of sectors, regions and stakeholders.[14]

Types, establishment and tasks

Pasal 2 makes the regulation a guideline for the central government and for provincial and district or city governments in forming these bodies, and Pasal 3 lists what the guideline covers: position, location, tasks and functions; organisation; working procedures; the procedure for formation; working relations; and funding.[15] Pasal 4 divides the bodies into five types: transboundary (lintas negara), inter-provincial, national strategic, inter-district, and within a single district or city. Under Pasal 5 the minister forms the first three, the governor forms the inter-district bodies and the regent or mayor forms those for a territory within one district or city.[5:1]

Each body is non-structural and answerable to the official who forms it. A transboundary body is located in Indonesia within the territory concerned, the inter-provincial, national strategic and inter-district bodies in one of the districts or cities of the territory, and a single-district body in the district or city capital.[16] The tasks set for every type repeat the three principal tasks in UU 17/2019. To perform them, a body coordinates by discussing the draft pattern (pola) and plan for water resources management in the territory, the guideline for and the calculation of a river-territory water security index (indeks ketahanan air), draft programmes and activity plans, proposed plans for allocating water from each source, the plan for hydrological, hydrometeorological and hydrogeological information systems, and the empowerment of water resources institutions, and by giving the minister its considerations.[16:1]

Organisation and membership

A body consists of a chair, a daily chair (ketua harian) and members, all of whom sit as members. The chair is held by the head of the regional development planning agency (Bappeda): of the province in which the territory lies for transboundary, national strategic and inter-district bodies, of the provinces in rotation by inter-provincial agreement for inter-provincial bodies, and of the district or city for a single-district body. The daily chair is the head of the regional office responsible for water resources at the corresponding level.[6:1][17] Members are grouped into commissions and come from government and non-government sides in balanced numbers on the principle of representation; where balance cannot be reached, government members may outnumber the rest.[6:2]

For a transboundary body, government members are at least one technical unit of each relevant central ministry or agency, represented by one person, up to five officials from five provincial agencies nominated by the governor, and up to three officials from three agencies nominated by each regent or mayor in the territory.[18] The inter-district bodies have no central government members, and a single-district body draws up to five members from district or city agencies together with the heads of the sub-districts (camat) within the territory.[19][20] Non-government members come from organisations or associations in thirteen categories: customary communities (masyarakat adat), agricultural water users, drinking water enterprises, industrial, fisheries, hydropower, transport, tourism, sport and mining users, water conservation groups, forestry businesses, and organisations concerned with the control of the destructive force of water.[7:1]

Members serve five-year terms. A non-government member may be replaced between terms on resignation, death or replacement by the organisation represented, and may be removed for permanent incapacity lasting at least one year or on a final conviction carrying at least three months' imprisonment.[21] The chair sets the work plan, the procedure for sessions, decisions arising from sessions and the river-territory water security index, reports to the minister, and may issue written warnings to agencies that have not acted on the body's recommendations and to members inactive for six months or two sessions.[22] A secretariat, headed at central level by the head of the operation and maintenance division or section of the technical unit for water resources in the territory, and at regional level by the equivalent official in the regional apparatus, prepares sessions, evaluates members' performance, keeps data on organisations in the territory, runs the election of non-government members and monitors the follow-up of recommendations.[23][17:1]

Working procedures

The transboundary, inter-provincial, national strategic and inter-district bodies hold plenary sessions at least four times a year and a single-district body at least twice; sessions are chaired by the chair or, in the chair's absence, the daily chair, and may involve experts from government, universities, non-governmental organisations or the public. Each body reports in writing at least twice a year to the minister, the governor or the regent or mayor, as the case may be.[8:1]

The annex sets out standard procedures for the stages before, during and after a session, and requires rules of procedure establishing at least three commissions, for water resources conservation, water resources use and the control of the destructive force of water. Decisions, taking the form of minutes and recommendations, are made by deliberation to reach consensus, with a majority vote as the fallback; recommendations are signed by the chair and their follow-up monitored by the secretariat, which may publicise the body's activities through social media, websites or other media and reports through an information system, half-yearly reports and annual reports.[24]

Selection of members

Government members must be officials at echelon II or III level concerned with water resources; for a single-district body the district officials must be at echelon II.[25] A non-government member must be nominated by an organisation or association that is a legal entity, registered with the provincial government (or, for a single-district body, the district or city government), active in water resources for at least two years, and based in the territory.[25:1] For a body's first term, selection is run by a selection team of at least five members from the agencies responsible for water resources, forestry, agriculture, environment and regional planning, appointed by the official who forms the body; for later terms the secretariat runs the selection, at the latest six months before the current term ends.[7:2][25:2]

The annex sets a first-term timetable running from public announcement on day 0 through registration, grouping of organisations by category, a three-day objection period and a definitive list, to mandate letters from the organisations on day 30 and the decision establishing the body on day 35. Where more eligible organisations apply in a category than there are seats, they elect their representative among themselves.[26]

Relationship to other instruments

Under Pasal 93, a TKPSDA WS may coordinate and consult with other water resources coordination bodies on technical and operational matters, may seek input from the national water resources council and from provincial and district or city councils, and may coordinate with the irrigation commission in the territory when discussing the annual water allocation plan.[27] The provincial and district councils are governed by Permen PU 3/2024; the membership of the national council was set by Keppres 18/2024.[28][29]

Funding for the transboundary, inter-provincial and national strategic bodies comes from the state budget of the Directorate General of Water Resources, for inter-district bodies from the provincial budget, and for single-district bodies from the district or city budget.[9:1] Pasal 95 provides that bodies formed before the regulation remain in place until their terms end, and that bodies still being formed are formed under the new rules; Pasal 96 revokes Permen PUPR 17/PRT/M/2017 on the guideline for forming river-territory coordination teams.[10:1] The regulation has 97 articles in nine chapters and one annex.[1:1]
