Peraturan Menteri Kehutanan 32/2009 (Peraturan Menteri Kehutanan Nomor P.32/Menhut-II/2009 tentang Tata Cara Penyusunan Rencana Teknik Rehabilitasi Hutan dan Lahan Daerah Aliran Sungai) was an Indonesian ministerial regulation that set the procedure for preparing technical plans for the rehabilitation of forest and land in river basins, known as RTkRHL-DAS. It was signed by the Minister of Forestry on 11 May 2009 and took effect on its promulgation on 15 May 2009, and was issued to implement Pasal 13 ayat (5) of Peraturan Pemerintah Nomor 76 Tahun 2008 on forest rehabilitation and reclamation.[1][2] It formed part of the planning rules described at forestry and land use regulation in Indonesia and, for its focus on river basins, at water resources law of Indonesia.

The regulation itself had three articles; its substance was a technical manual in an annex, which defined the plan, set out who prepares and approves it, fixed its term at fifteen years, and described the data collection, erosion and land-criticality analysis and plan-writing methods to be used.[1:1][3] It was amended twice, in 2010 to add a procedure for mangrove and coastal ecosystems and in 2012 to add one for peatland.[4][5] The regulation was revoked by Permen LHK 10/2022 with effect from 22 July 2022.[6] CRPG's regulatory tracker published a summary of it in November 2025.[7]

Background

The annex opens by describing the problem the plan was meant to address: use of forest and land beyond its carrying capacity produces critical land (lahan kritis), which in turn contributes to floods, landslides, fires, drought, river pollution, reservoir siltation and the failure of irrigation works through sedimentation.[8] Peraturan Pemerintah Nomor 76 Tahun 2008 divided the planning of forest and land rehabilitation (rehabilitasi hutan dan lahan, RHL) into three layers: the technical plan for a river basin (RTkRHL-DAS), the rehabilitation management plan, and the annual rehabilitation plan. The technical plan was the first of these and was to serve as the basis for the management plans inside and outside the forest estate.[8:1]

The regulation's preamble names that government regulation as the only ground for its issue; its legal bases include Undang-Undang 41/1999 on forestry as amended in 2004, the regional government law of 2004, and the government regulations of 2002 to 2008 on the reforestation fund, forest planning, forest protection and the division of government affairs.[2:1]

Provisions

Pasal 1 made the procedure in the annex the content of the regulation, Pasal 2 made it the guideline for the Directorate General of Land Rehabilitation and Social Forestry and its technical units in preparing RTkRHL-DAS, and Pasal 3 brought it into force on promulgation.[1:2]

Purpose and definitions

The annex defined the RTkRHL-DAS as an indicative plan of rehabilitation activities, prepared on the basis of the biophysical, socio-economic and cultural conditions of a river basin, sub-basin or basin region. Its stated purpose was to provide a base plan for rehabilitation and for the later management plans, and its targets were to identify the location, extent and degree of criticality of land according to the main problem of each basin, and to supply technical, socio-economic and environmental considerations for setting priorities.[8:2] The definitions section covered twenty-six terms, among them the river basin (daerah aliran sungai, DAS), integrated basin management, priority basins, critical land, reforestation inside the forest estate (reboisasi), greening outside it (penghijauan), check dams and retention dams, small reservoirs (embung), infiltration wells and community forests (hutan rakyat).[9]

Preparation, approval and term

The plan was to take as its references the national forestry plan, spatial plans, the integrated basin management plan and the water resources management plan. It was prepared by a team with a steering and an implementing component drawn from sectoral agencies, universities and non-governmental organisations. For a basin within one district or city the team was set by the regent or mayor; for a basin crossing districts, by the governor or the dominant regent or mayor; and for a basin crossing provinces, by a joint decision of the governors or by the dominant governor. The head of the provincial or district planning agency (Bappeda) led the implementing team and the head of the river basin management office (BPDAS) served as its secretary.[3:1] The completed plan was assessed by the Director of Forest and Land Rehabilitation and approved by the Director General of Land Rehabilitation and Social Forestry. It was a medium-term plan with a term of fifteen years, after which it could be reviewed.[3:2]

The annex recognised two approaches. A semi-detailed plan was to be prepared for all basins at once on the basis of biophysical data already held by the river basin offices, while a detailed plan was to be prepared basin by basin according to priority, drawing also on socio-economic and cultural data.[8:3][10]

Method

The later chapters prescribed the steps: preparation (Bab II), data collection (Bab III), data processing and analysis (Bab IV), identification of land criticality (Bab V), the rehabilitation plan itself (Bab VI), the drafting of the plan document (Bab VII) and the semi-detailed method (Bab VIII).[11] Erosion was to be estimated with the Universal Soil Loss Equation and compared with effective soil depth to derive an erosion hazard level (tingkat bahaya erosi).[12] Following PP 76/2008, the plan was to contain at least a plan for the recovery of forest and land, for erosion and sedimentation control, for water resources development and for institutional development; the recovery plan was mainly vegetative, through reforestation or enrichment planting inside the forest estate and greening outside it, and was to be measured with a land cover index.[13] The semi-detailed method built land mapping units from overlaid input maps, corrected them by ground checks, and analysed them against a technical plan matrix to produce maps of rehabilitation directions.[10:1] The finished plan was to be presented in three books: a main book with a 1:50,000 plan map, a data book and a map book.[14]

Amendments and revocation

Peraturan Menteri Kehutanan Nomor P.35/Menhut-II/2010 inserted a Pasal 1A attaching a second annex on technical plans for mangrove ecosystems and coastal borders, added definitions for coastal terms, and revised the preparation procedure so that the river basin office formed mapping, survey and drafting teams.[4:1] Peraturan Menteri Kehutanan Nomor P.12/Menhut-II/2012, the second amendment, inserted a Pasal 1B attaching a third annex on technical plans for peatland areas with protection and cultivation functions, and added definitions beginning with peat and the peatland ecosystem. Its preamble explained that the earlier text had not yet regulated plans for peatland.[5:1]

Pasal 40 of Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor 10 Tahun 2022 revoked the regulation, as last amended in 2012, together with the regulations on rehabilitation management plans (Permenhut 37/2010) and annual rehabilitation plans. The 2022 regulation, which implements Peraturan Pemerintah Nomor 26 Tahun 2020 on forest rehabilitation and reclamation, was signed on 12 July 2022 and took effect on its promulgation on 22 July 2022.[6:1] The CRPG tracker's November 2025 summary described the 2009 regulation as still active; the revocation clause of the 2022 regulation shows that it was no longer in force by that date.[7:1][6:2]
