Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat 3/2024, whose text is titled Peraturan Menteri Pekerjaan Umum Nomor 3 Tahun 2024 tentang Pedoman Pembentukan Dewan Sumber Daya Air Provinsi dan Kabupaten/Kota, is an Indonesian ministerial regulation that sets the guidelines for provincial and district or city water resources councils (Dewan Sumber Daya Air). It was issued by the Minister of Public Works, not the Minister of Public Works and Public Housing, and was signed on 13 December 2024 and took effect on its promulgation on 20 December 2024.[1][2][3] It forms part of the institutional side of the water resources law of Indonesia, and implements Pasal 65 ayat (10) of Undang-Undang 17/2019 on water resources.[1:1]

The regulation treats a regional council as a non-structural coordinating body answerable to the governor, regent or mayor, formed where the need arises. It prescribes the councils' functions, their composition from government and non-government members in balanced numbers, a secretariat housed in the regional water resources office, at least two plenary sessions a year, and a procedure for selecting non-government members.[4][5][6][7][8]

Until a council is formed, its coordinating functions rest with the regional agency responsible for water resources.[9] The instrument is distinct from a regulation of the Minister of Public Works and Public Housing that bears the same number and year, issued on 2 February 2024, which amended that ministry's strategic plan for 2020 to 2024.[10] CRPG's regulatory tracker analysed the regulation in November 2025 and April 2026.[11][12][13]

Background

UU 17/2019 requires water resources management to be coordinated at national, provincial and district or city level. National coordination falls to the National Water Resources Council, established by the President; coordination at provincial and district or city level falls to regional councils formed according to need, with regional government representatives as permanent members and non-government representatives as non-permanent members. Where a regional council has not been formed, the regional office responsible for water resources coordinates instead. Pasal 65 ayat (10) delegates the guidelines on the organisation of the regional councils to a further regulation.[14] The membership of the national council was last set by Keppres 18/2024 in April 2024.[15]

The regulation's preamble cites UU 17/2019 as amended by UU 6/2023 on job creation, Peraturan Pemerintah 30/2024 on water resources management, Peraturan Presiden 37/2023 on the national water resources policy, and Peraturan Presiden 170/2024 on the Ministry of Public Works.[1:2] A companion guideline for coordination bodies at river-territory level (wilayah sungai) was issued by the same minister as Permen PU 2/2024.[16]

Establishment and functions

Pasal 2 states that the regulation is a guideline for provincial and district or city governments, and that the councils are formed as a forum in which water resources stakeholders coordinate interests across sectors and regions.[4:1] Under Pasal 4, the need for a council is assessed by the potential for conflict over water use, an imbalance between water availability and demand, or a rapid rate of development in the region. A provincial council is established by the governor, and a district or city council by the regent or mayor.[4:2]

Each council is non-structural, sits in the capital of its province, district or city, and is answerable to the head of the region. Its task is to coordinate water resources management at its level of government.[5:1] A provincial council coordinates the formulation of provincial water resources policy, the setting of guidelines for and calculation of a provincial water security index (indeks ketahanan air), proposals to change the designation of river territories under provincial authority, and policy on hydrological, hydrometeorological and hydrogeological information systems. It also coordinates advice on strategic water issues and liaises with the national council, the district and city councils and the river-territory coordination bodies.[5:2] The functions of a district or city council are similar, except that it coordinates the drafting of river-territory designations and has no water security index function.[5:3]

Membership and organisation

A council consists of a chair, a daily chair (ketua harian) and members. The governor, or the regent or mayor, chairs the council and may delegate the chair to the regional secretary; the head of the relevant regional office acts as daily chair.[6:1] Members may be grouped into commissions, and are drawn from government and non-government representatives in balanced numbers on the principle of representation. Where balance cannot be achieved, government members may outnumber the rest.[6:2]

Pasal 14 lists up to fourteen government bodies, from regional planning, water resources, environment, agriculture, health and forestry to disaster management and the technical units for meteorology and for water resources management. It lists thirteen categories of non-government organisation, among them customary law communities (masyarakat adat), agricultural water users, drinking water providers, industrial users, fisheries, conservation groups and users of water for power generation, transport, tourism, sport and mining.[17] Members serve five-year terms; non-government members may be replaced between terms on resignation, death or replacement by their organisation, and may be removed for permanent absence of at least one year or a final criminal conviction.[18] The chair's powers include setting the council's work plan, its procedures and the water security index, and issuing written warnings to agencies that have not acted on the council's recommendations and to members inactive for six months or one session.[19]

Each council is supported by a secretariat headed by a head of division in the regional office responsible for water resources. The secretariat prepares sessions and draft work plans, compiles data on eligible organisations, runs the election of non-government members, and monitors the follow-up of the council's recommendations.[20] The district and city provisions in Pasal 19 to Pasal 24 largely repeat the provincial ones.[20:1]

Working procedures and funding

A council holds a plenary session at least twice a year, chaired by the chair or, in the chair's absence, the daily chair, and may involve experts from government, universities and civil society. In setting regional water resources policy it must refer to the national water resources policy, and it reports in writing at least once a year to the head of region, with a copy to the director general responsible for water resources.[7:1] The annex sets out the detail: pre-session coordination by the secretariat, the order of a session, decisions by deliberation to consensus with a majority vote as the fallback, recommendations signed by the chair, and publication of the councils' activities through social media, websites or other media.[21]

Relations between the national, provincial and district or city councils and the river-territory bodies are coordinative and consultative, and a regional council may seek the national council's consideration.[22] Operating costs are met from the regional budget of the regional planning agency or water resources office, or from other lawful sources.[23]

Selection of members

Government members are officials at echelon II or III level concerned with water resources; at district or city level they may include the heads of sub-districts (camat) within the river territory.[8:1] A non-government member must be nominated by an organisation that is a legal entity, registered with the regional government, based in the region and active in water resources for at least two years.[8:2] For a council's first term, members are selected by a selection team appointed by the head of region; for later terms the secretariat runs the selection, at the latest six months before the current term ends.[17:1][8:3]

The annex sets a schedule for the first term that runs from public announcement and registration through the grouping of organisations by category, a three-day objection period and a definitive list, to mandate letters from the organisations and the head of region's decision on day 35. Organisations within a category elect their representative where more eligible organisations apply than there are seats.[24]

Transition and entry into force

Pasal 43 provides that, until a provincial or district or city council is formed under the regulation, the agency responsible for water resources management in that region performs its coordinating functions, matching the fallback in UU 17/2019.[9:1][14:1] The regulation took effect on promulgation.[2:1][3:1]
