Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat 8/2024 is a regulation of the Indonesian Minister of Public Works and Public Housing, Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 8 Tahun 2024, which makes the second amendment to the ministry's regulation on its own organisation and working procedures, Peraturan Menteri PUPR Nomor 13 Tahun 2020. Nearly all of its changes concern the Directorate General of Water Resources, the ministry's arm for administering the water resources law of Indonesia. It was signed on 19 September 2024 and took effect on its promulgation on 23 September 2024.[1][2][3]

The regulation adds irrigation development, including the creation of new rice fields in centrally managed irrigation areas, to the functions of the directorate general and its irrigation directorate, and restates the tasks of the directorates for dams and lakes and for groundwater and raw water. It creates a Subdirectorate of Institutions and Licensing within the Directorate of Operations and Maintenance, and gives the Directorate of Water Resources Engineering the task of coordinating the technical units that provide technical advice.[4][5][6][7]

It is an instrument of internal organisation rather than a technical standard: it sets which units of the ministry carry out tasks such as water-use licensing, dam safety assurance and verification of setback studies, and leaves the substantive rules to other instruments. It sits within the field of public administration in Indonesia.[6:1][7:1]

Background

The preamble states that the amendment follows up Peraturan Presiden Nomor 27 Tahun 2020 on the ministry, as amended by Peraturan Presiden Nomor 24 Tahun 2024, which required adjustments to the ministry's tasks, functions, organisation and working procedures, and records that the Minister for Administrative and Bureaucratic Reform had given written approval of those adjustments. It rests on Pasal 17 ayat (3) of the 1945 Constitution and on Undang-Undang Nomor 39 Tahun 2008 tentang Kementerian Negara. The regulation it amends had been amended once before, by Peraturan Menteri PUPR Nomor 11 Tahun 2022.[8]

The regulation has two articles. Pasal I contains thirty-five numbered amendments to the 2020 regulation, the last of which replaces its annex, the organisation chart of the ministry. Pasal II provides that existing posts and their holders continue to perform their tasks and functions until the new posts are formed and officials appointed, and brings the regulation into force on promulgation.[3:1][9]

Directorate General of Water Resources

Pasal 79 of the 2020 regulation, as amended, adds to the functions of the Directorate General of Water Resources the development and management of irrigation systems as a single system, including the creation of rice fields (pencetakan sawah) in irrigation areas under central government authority. Pasal 82 adds to the functions of its secretariat the facilitation of civil servant investigators (penyidik pegawai negeri sipil) in the water resources field.[4:1] Under UU 17/2019, the central government manages cross-provincial, cross-border and nationally strategic river territories and licenses water use within them.[10]

The Directorate of Irrigation and Swamps is given matching tasks on rice-field creation, readiness assessment, planning and preparation for operation and maintenance, and its three regional subdirectorates are restated for Sumatra and Kalimantan; Java, Bali and Nusa Tenggara; and Sulawesi, Maluku and Papua. The Directorate of Dams and Lakes is tasked with guiding the implementation of norms, standards, procedures and criteria, and with planning, preparing and carrying out operation and maintenance of dams, lakes and small lakes (situ) and the physical conservation of water resources; its functions include assessing the readiness of activities before they proceed. The Directorate of Groundwater and Raw Water receives the same structure for groundwater, raw water and small reservoirs (embung), together with their conservation infrastructure, which links its work to groundwater regulation in Indonesia.[5:1]

Operations, maintenance and licensing

The amended Pasal 151 gives the Directorate of Operations and Maintenance functions that include processing permits and approvals for river diversion and for the use of water resources, applying the calculation of the water resources management service fee, deploying civil servant investigators, and validating the results of studies fixing setback lines. It also covers guidance on the operation and maintenance of rivers and coasts, urban drainage, irrigation and swamps, dams, lakes, groundwater and raw water, the fostering of dam, irrigation and flood-control management units, and the facilitation and evaluation of disaster response.[6:2]

Pasal 152 reorganises the directorate into five subdirectorates and an administrative subsection. The subdirectorates for rivers and coasts, for dams and lakes, and for groundwater, raw water, irrigation and swamps each verify the setback studies within their field: rivers; lakes, situ and reservoirs; and irrigation networks, embung, springs and swamps respectively. The setback lines they verify are fixed under Permen PUPR 28/2015. New articles, Pasal 160A and Pasal 160B, establish the Subdirectorate of Institutions and Licensing, whose tasks cover the performance of water resources management bodies and community participation, cooperation between central and regional governments, coordination bodies for river territories, permits and approvals for river diversion and water use, and verification of the service-fee calculation. The organisation of several of these subdirectorates is stated to consist of a group of functional positions (kelompok jabatan fungsional).[6:3]

Water resources engineering and safety

The Directorate of Water Resources Engineering (Direktorat Bina Teknik Sumber Daya Air) is responsible under the amended Pasal 162 for norms, standards, procedures and criteria, professional and functional development, the safety of water structures (keamanan bangunan air), technical services, data analysis and water resources information systems. The amended Pasal 163 adds the coordination of technical units that carry out technical advice to its functions, which also include testing, certification, inspection, calibration and technical advice, and the assurance of water-structure safety.[7:2]

Under the amended Pasal 167, the Subdirectorate of Water Structure Safety prepares and implements policy and standards on safety management systems and technology for water structures, and on occupational health, safety and environment in the water resources field. It tests materials, assesses construction quality, carries out inspections and gives technical advice during both design and construction, prepares technical recommendations for natural disaster mitigation, and coordinates the technical advisory units.[7:3]

Reception

CRPG's regulatory tracker published an analysis of the regulation in November 2025 under the heading of dam safety oversight. It described the regulation as an organisational instrument and noted that the technical rules for dam safety are contained in separate ministerial regulations.[11]
