Peraturan Menteri Energi dan Sumber Daya Mineral 1/2023 (Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 1 Tahun 2023 tentang Penyediaan Infrastruktur Pengisian Listrik untuk Kendaraan Bermotor Listrik Berbasis Baterai) is an Indonesian ministerial regulation on the provision of charging infrastructure for battery electric vehicles. It covers private charging installations, public charging stations (Stasiun Pengisian Kendaraan Listrik Umum, SPKLU) and public battery-swapping stations (Stasiun Penukaran Baterai Kendaraan Listrik Umum, SPBKLU), the electricity tariffs that apply to them, electrical safety, reporting and administrative sanctions. It was signed by the Minister of Energy and Mineral Resources, Arifin Tasrif, on 9 January 2023 and took effect on its promulgation on 13 January 2023, revoking Permen ESDM 13/2020 on the same subject.[1][2] It is one of the electricity-sector rules described at mining and energy regulation in Indonesia.
Its preamble states that it was issued to accelerate the battery electric vehicle programme and improve the monitoring of charging infrastructure, by re-regulating the types of charging technology, the integration of applications and the electricity tariffs for such vehicles, and cites among its legal bases the Electricity Law, Undang-Undang 30/2009, and Peraturan Presiden 55/2019 on accelerating the battery electric vehicle programme for road transport.[3]
Charging stations must be run by holders of an electricity supply business licence and must register for an identity number, integrate their applications with a government gateway and report on their operations; swapping stations need no electricity supply licence. CRPG's regulatory tracker published an analysis of the regulation in November 2025.[4]
Pasal 2 divides charging infrastructure into recharging facilities, which comprise at least the power-supply equipment, a current, voltage and communication control system and a protection and safety system, and battery-swapping facilities. Recharging may take place at a private electrical installation (Instalasi Listrik Privat) or at an SPKLU; swapping takes place at an SPBKLU.[5]
Pasal 1 defines four charging technologies by output: slow charging up to 7 kilowatts, medium charging above 7 and up to 22 kilowatts, fast charging above 22 and up to 50 kilowatts, and ultrafast charging above 50 kilowatts.[6] For four-wheeled and larger vehicles, slow charging must offer at least alternating-current charging through a type 2 connector marked with a red sleeve; the higher tiers must offer at least one of that connector, a direct-current connector marked with a green sleeve or a combined AC and DC connector marked with a blue sleeve. Charging for two- and three-wheeled vehicles follows the national standard (SNI), the standard of the producing country or an international standard. The connector specifications are drawn in Lampiran I by reference to SNI IEC 62196.[5:1][7]
Private installations, whether used to charge public transport or other vehicles, need no licence to supply electricity for public use (IUPTLU); a party other than the owner that operates one must hold a licence for electricity supporting services (IUJPTL).[8]
Before operating, each SPKLU must obtain an identity number, which the Director General of Electricity issues within five working days of a complete submission of the station's scheme and location. The number must be displayed at the station, and changes must be reported within five working days.[9] An SPKLU operator must hold an integrated IUPTLU, or a sales IUPTLU with a business area for selling electricity at charging stations, and must have stations in more than one province; a business without such a licence must first obtain a business area, approval of its electricity supply business plan (RUPTL) and the licence.[10]
Pasal 13 sets out ten permitted business schemes, five for integrated licence holders and five for sales licence holders, differing in whether the licensee owns, leases or leaves to a third party the charging station and whether it operates the station itself or through an IUJPTL holder.[11] Every operator must have an online application that registers users and shows station locations, socket types, tariffs and the energy delivered, and records transactions. The application must be interoperable with those of other operators, its data centre must be in Indonesia, and it had to be integrated with the Directorate General's single gateway within one year of promulgation.[12] Stations are to be placed where vehicle owners can reach them without disrupting traffic; the regulation names fuel and gas stations, central and regional government offices, shopping centres and roadside public parking, and requires owners of fuel stations to provide land for charging infrastructure.[13]
An SPBKLU supplies swapped batteries to vehicle owners by rental, and needs an identity number issued on the same terms as an SPKLU. Its batteries must have a rated voltage of 48, 60 or 72 volts and a rated capacity of at least 20 ampere-hours.[14] An SPBKLU operator needs no IUPTLU but must hold the business licence required by law, and may own or lease the swapping cabinet.[14:1][15] It must guarantee the function of the batteries it rents, operate an application integrated with the single gateway, and have a swapping machine that verifies, checks and recharges batteries. The rental fee is set by agreement between operator and user, and the minister may set it as the use and technology of swapping develop.[15:1][16]
Pasal 24 provides that the provision of charging infrastructure is first carried out through an assignment to the state electricity company, PT PLN (Persero), which may cooperate with other enterprises, and whose costs may be counted in the basic cost of electricity supply or covered by state equity participation; PLN must prepare a roadmap of its charging and swapping stations.[17]
Chapter III sets the electricity tariffs. Bulk supply at medium voltage to charging operators, swapping operators and private installations for public transport carries a multiplier (Q) of 1.01, and supply at low voltage a multiplier (N) of 1. The tariff a charging station charges a vehicle owner is the special-service tariff with a multiplier of at most 1.5, applied by the operator. The minister may also set a service fee per charging session at fast and ultrafast chargers, to be evaluated every two years; no such fee applies to slow and medium charging or to two- and three-wheeled vehicles.[18] Owners and operators applying for a new connection receive relief on connection fees or subscription guarantees, and are exempt from the minimum bill for the first two years.[19]
Equipment subject to a mandatory SNI must hold a product certificate, technical staff at charging and swapping stations must be certified, and installations must hold a certificate of operational worthiness (sertifikat laik operasi).[20] The minister, through the Director General, supervises owners and operators, who must report on their charging business; swapping operators report every January.[21] An operator that fails to display or update its identity number, or to report, faces a written warning up to three times, suspension for up to three months, and then revocation of its IUPTLU or, for a swapping operator, of its identity number, notified through the ministry's licensing system linked to the online single submission (OSS) system.[22]
Existing owners and operators were given one year from promulgation to comply, and two years to make their applications interoperable; identity numbers already issued for swapping facilities using other battery voltages remain valid.[23] Pasal 43 revokes Permen ESDM 13/2020, whose inadequacy for public needs the preamble gives as a reason for the new regulation, and Pasal 44 brings the regulation into force on promulgation.[24][3:1]
