Keputusan Menteri Energi dan Sumber Daya Mineral 344.K/MB.01/MEM.B/2025 (Keputusan Menteri Energi dan Sumber Daya Mineral Nomor 344.K/MB.01/MEM.B/2025 tentang Pedoman Teknis Pelaksanaan Reklamasi dan Pascatambang pada Kegiatan Usaha Pertambangan Mineral dan Batubara) is a decision of the Indonesian Minister of Energy and Mineral Resources, dated 23 October 2025, that sets the technical guidelines for reclamation (reklamasi) and post-mining activities (pascatambang) in mineral and coal mining.[1][2] It belongs to the body of rules described at mining and energy regulation in Indonesia.
The decision adopts four sets of guidelines as annexes: on the management of reclamation and post-mining, including mining at sea; on reclamation cost standards; on reopening areas that have already been reclaimed; and on appointing third parties to carry out reclamation or post-mining work and to assess its success. It delegates the related approval and sanctioning powers of the Minister to the Director General of Mineral and Coal.[1:1][3]
Its first annex governs the reclamation and post-mining plans that permit holders must prepare, the procedure for their approval, and the reclamation and post-mining guarantees, which are held as time deposits in a state-owned bank.[4][5][6] Transitional provisions deal with pending success assessments, guarantees held in other forms, existing approved plans and pending applications to reopen reclaimed areas.[7][8] CRPG's regulatory tracker reported the decision in June 2026.[9]
Reclamation is defined in the decision as work carried out throughout the stages of a mining business to arrange, restore and improve the quality of the environment and ecosystem so that it can function again according to its designation, and post-mining activity as planned, systematic and continuing work after part or all of the mining business to restore the natural environmental function and the social function according to local conditions across the mining area.[10]
The held text of the decision's legal basis cites, among others, Peraturan Presiden 55/2022 on the delegation of mining business licensing, Peraturan Presiden 169/2024 on the Ministry of Energy and Mineral Resources, Permen ESDM 26/2018 on good mining practice and the supervision of mineral and coal mining, and Permen ESDM 12/2025 on the ministry's organisation.[11]
The first operative part (Diktum KESATU) establishes the technical guidelines as four annexes that form an integral part of the decision: Lampiran I on the management of reclamation and post-mining, including in marine areas; Lampiran II on reclamation cost standards; Lampiran III on reopening reclaimed areas; and Lampiran IV on the appointment of third parties as executors of reclamation or post-mining and as assessors of their success.[1:2]
Diktum KEDUA delegates to the Director General of Mineral and Coal the evaluation and approval or refusal of reclamation plans for the exploration and production-operation stages, of post-mining plans and of plans to reopen reclaimed areas; the receipt and evaluation of implementation reports; the approval of the release of reclamation and post-mining guarantees; the designation of third-party executors and assessors; and the imposition of administrative sanctions on reclamation and post-mining. Under Diktum KETIGA the Director General reports to the Minister every six months, or at any time when needed.[3:1]
Diktum KEEMPAT applies the decision mutatis mutandis to holders of a people's mining licence (IPR), a rock mining permit (SIPB), a special mining business licence issued as the continuation of a former contract or agreement, a contract of work, and a coal contract of work (PKP2B).[12]
Lampiran I covers the preparation of reclamation plans, the procedure for their submission, evaluation and approval, changes to them, reclamation guarantees, the same four matters for post-mining plans, the conduct of reclamation and post-mining, and reporting and the release of guarantees. It applies to land mining outside forest areas, which are governed by the rules on forest reclamation and rehabilitation, and it adds rules on reclamation at sea for production-stage holders that carry out mining in marine areas; the land procedures apply at sea unless the annex provides otherwise. Reclamation duties of IPR and SIPB holders are adjusted to the scope of their obligations.[4:1] Reclamation in marine areas is defined by its aims, which include preventing coastal abrasion and silting, protecting biodiversity and maintaining sea water quality or sedimentation levels, by reference to the approved environmental document.[10:1]
An exploration-stage holder must prepare a reclamation plan for five years, based on its approved environmental document (see environmental approval in Indonesia), before exploration begins, and submit it to the Director General or the governor within 45 working days of receiving its licence; the approval, due within 45 working days of a complete application, includes the amount of the reclamation guarantee.[13]
The exploration-stage reclamation guarantee is placed in full, within 20 working days of the approval of the plan, as a time deposit in a state-owned bank in Indonesia in the name of the Director General or the governor on behalf of the holder, for twelve months with automatic rollover, in rupiah or United States dollars. For the production-operation stage, the guarantee for the first five-year period is placed in full within 20 working days of approval, and later periods may be placed in full or yearly; the amount must be at least that given by the reclamation cost standard in Lampiran II. In both stages the guarantee does not discharge the holder's duty to reclaim, and any shortfall in its cost remains the holder's responsibility.[5:1]
The post-mining guarantee is placed each year in equal amounts, so that it is fully placed no later than two years before the production-stage licence expires, as a time deposit in a state-owned bank with automatic rollover and interest capitalised to the principal. Its currency cannot be changed once set, and it likewise does not discharge the holder's post-mining duty.[6:1]
Diktum KELIMA provides that applications for the assessment of reclamation or post-mining success already lodged may still be inspected in the field by mining inspectors until the list of mining service licence holders acting as third-party field reviewers is published. Production-stage reclamation guarantees placed before the decision in a form other than a time deposit remain valid until they expire, and must then be placed again as a time deposit at the value set for the same period. Approved reclamation and post-mining plans remain valid while unchanged, and success is assessed against the criteria already approved.[7:1] Under Diktum KEENAM, applications to reopen reclaimed areas lodged but not yet approved are processed under Lampiran III.[8:1]
