Peraturan Menteri Energi dan Sumber Daya Mineral 14/2012 (Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 14 Tahun 2012 tentang Manajemen Energi) was an Indonesian ministerial regulation on energy management by large energy users. It was signed by the Minister of Energy and Mineral Resources on 29 May 2012 and promulgated on 30 May 2012 in Berita Negara 2012 No. 557, taking effect on promulgation.[1][2] It implemented provisions of Peraturan Pemerintah 70/2009 on energy conservation, and forms part of the body of rules surveyed at mining and energy regulation in Indonesia.[3]

The regulation required every user of energy or energy sources consuming 6,000 tonnes of oil equivalent or more a year to practise energy management: to appoint a certified energy manager, draw up an energy conservation programme, carry out an energy audit at least once every three years, implement the audit's recommendations within set periods, and report every year.[4][5][6] Smaller users were encouraged to do the same, and the regulation listed energy-saving measures for air conditioning, lighting, office equipment, production processes and major energy-using plant.[7][8]

Compliance was supported by incentives for users that cut their specific energy consumption and enforced by a graduated series of disincentives, from written warnings and publication of the user's name to fines and a reduction in energy supply.[9][10] The regulation was revoked with effect from 13 March 2025 by Peraturan Menteri Energi dan Sumber Daya Mineral 8/2025, also on energy management.[11][12]

Background

Peraturan Pemerintah 70/2009 made the efficient use of energy an obligation and required users of energy sources and energy consuming at least 6,000 tonnes of oil equivalent a year to conserve energy through energy management, which it defined by the same five steps later repeated in the ministerial regulation.[13] The preamble of Permen ESDM 14/2012 states that it was issued to implement Pasal 13 ayat (5), Pasal 19 ayat (3), Pasal 21 ayat (2) and Pasal 27 of that government regulation, and its Mengingat clause cites Undang-Undang 30/2007 on energy.[3:1] It was issued on the same day as Peraturan Menteri Energi dan Sumber Daya Mineral 13/2012, which set targets for saving electricity in government and state-enterprise buildings.[1:1][14]

Pasal 1 defines energy conservation (konservasi energi) as a systematic, planned and integrated effort to preserve domestic energy resources and raise the efficiency of their use, and energy management (manajemen energi) as integrated activity to control energy consumption so that energy is used effectively and efficiently. It also defines the energy audit, specific energy consumption (the energy used to produce one unit of output) and three classes of audit recommendation by cost.[15]

Pasal 2 divided responsibility by the authority that licensed the user: the minister for users whose energy supply or use was licensed by, or whose cooperation contract was supervised by, the central government; governors and regents or mayors for users licensed by them.[16]

Energy management

Pasal 3 made energy management compulsory for users of energy sources and energy consuming 6,000 tonnes of oil equivalent or more a year; Pasal 4 asked users below that level to practise energy management or energy saving.[4:1][7:1] Energy management consisted of appointing an energy manager, preparing an energy conservation programme, carrying out periodic energy audits, implementing the audit recommendations and reporting every year to the minister, governor or regent or mayor.[4:2]

A user subject to the obligation had to form an energy management team led by an energy manager, who planned conservation, carried out the programme and monitored results, and who had to hold a certificate of competence.[17] The conservation programme covered short-term measures such as better operating procedures, medium- and long-term measures such as more efficient equipment and fuel switching, and continuous training of staff.[18] Energy audits of the main energy-using equipment were required at least once every three years, by certified internal auditors or accredited bodies, or by a team formed by the Director General for new and renewable energy and energy conservation where none was available.[5:1]

Audit recommendations were classed by cost and had to be carried out within set periods.[15:1][6:1]

Class of recommendation Criteria Deadline
No investment No cost to implement Less than one year
Low investment Savings up to 10 per cent or payback under two years Less than two years
Medium investment Savings of 10 to 20 per cent or payback of two to four years Less than five years
High investment Savings above 20 per cent or payback over four years Less than five years

The annual report, due between January and 31 March of the following year, described the energy management organisation, the conservation programme, the audits and the implementation of their recommendations, in the format of the annex; the first report was due in January 2013.[19]

Energy saving measures

Chapter III listed measures through which energy could be saved: air conditioning, lighting, supporting equipment, production processes and major energy-using equipment.[8:1] For buildings the measures matched those in Permen ESDM 13/2012, including room temperatures of 24 to 27 °C in workrooms, maximum lighting power densities by type of room, and lifts stopping only at every second floor. For industry, the regulation named more efficient production technology, inverters on large electric motors working under variable load, control of the air-to-fuel ratio, cogeneration or combined heat and power, insulation against heat losses, and switching from high-speed diesel to natural gas.[8:2]

Incentives and disincentives

Pasal 15 allowed the minister, a governor or a regent or mayor to reward users that, over three consecutive years of energy management, reduced their specific energy consumption by at least 2 per cent a year. The incentive took the form of an energy audit in partnership financed by the government or a recommendation for priority in energy supply, and was granted on application.[9:1]

Users bound by Pasal 3 that did not carry out energy management faced disincentives under Pasal 16. A user that failed to appoint a manager, prepare a programme, audit, implement recommendations or report received up to three written warnings, each with one month to comply. The authority then published the user's name in the mass media; a month later it imposed a fine of twice the value of the energy wasted, reckoned as 5 per cent of the user's energy costs for the one-year reporting period. If the fine went unpaid for a month, the energy supply could be reduced by up to 5 per cent of the contracted capacity for a month, renewable, without cancelling the fine; a governor or regent or mayor needed the minister's approval for such a reduction.[10:1] Supervision lay with the minister through the Director General, and with governors and regents or mayors, each of whom could form an energy management supervisory team.[20]

Revocation

Pasal 17 brought the regulation into force on promulgation.[1:2] Pasal 40 of Permen ESDM 8/2025, signed on 7 March 2025 and in force from 13 March 2025, revoked it, together with a 2015 ministerial regulation on the competence standard for energy managers.[11:1][12:1] The government regulation it implemented had itself been revoked by Peraturan Pemerintah 33/2023 on energy conservation, promulgated on 16 June 2023.[21]

CRPG's regulatory tracker published a short note on the regulation on 26 November 2025.[22]
