Peraturan Presiden 169/2024 (Peraturan Presiden Nomor 169 Tahun 2024 tentang Kementerian Energi dan Sumber Daya Mineral) is the Indonesian presidential regulation that sets out the position, tasks, functions and organisation of the Ministry of Energy and Mineral Resources (Kementerian Energi dan Sumber Daya Mineral, ESDM). It was signed by President Prabowo Subianto and promulgated on 5 November 2024, and took effect on promulgation, replacing Perpres 97/2021 on the same ministry.[1] It forms part of the body of rules described at mining and energy regulation in Indonesia, and was issued to implement Pasal 11 of the State Ministries Law as amended by UU 61/2024.[2]
The regulation assigns the ministry the government affairs of energy and mineral resources, and lists its functions across oil and gas, electricity, minerals and coal, new and renewable energy, energy conservation, geology, and law enforcement in the sector.[3] It organises the ministry into a secretariat general, five directorates general, an inspectorate general, two agencies and four expert staff positions. Among the directorates general is one for law enforcement in energy and mineral resources, whose functions run from prevention and complaint handling to investigation, administrative sanctions and the application of criminal law.[4][5]
It also sets the ministry's working arrangements, its funding from the state budget, and the procedure for later changes to its organisation. CRPG's regulatory tracker published an analysis of the regulation in March 2026.[6]
The regulation's single recital states that it was needed to implement Pasal 11 of Law 39/2008 on State Ministries, as amended by Law 61/2024. Its Mengingat clause cites Pasal 4 ayat (1) and Pasal 17 of the Constitution, that law, and Perpres 140/2024 on the organisation of state ministries.[2:1] It was signed and promulgated on the same day as Perpres 176/2024 on the Ministry of Agrarian Affairs and Spatial Planning, which was issued under the same provision of the State Ministries Law.[7]
Under Pasal 2 the ministry is under and responsible to the President and is led by the minister, who may be assisted by a deputy minister appointed by the President; Pasal 3 limits the deputy minister's scope to helping the minister formulate or carry out ministry policy and coordinate strategic policies across the ministry's top-level units, and Pasal 4 treats the minister and deputy minister as a single leadership.[8] Pasal 5 gives the ministry the task of administering government affairs in energy and mineral resources to assist the President.[3:1]
Pasal 6 lists its functions. They include the formulation, adoption and implementation of policy in oil and natural gas, electricity, minerals and coal, new energy, renewable energy, energy conservation and geology, together with law enforcement in energy and mineral resources; technical guidance and supervision of that policy; management of state property in the ministry's charge; investigation and services in geological resources, volcanology and geological disaster mitigation, groundwater, environmental geology and geological survey; and human resource development in the sector.[3:2]
Pasal 7 sets the ministry's structure:[4:1]
The four sectoral directorates general each formulate and implement policy on the guidance, supervision and control of their sector, including the setting of norms, standards, procedures and criteria and the monitoring and evaluation of business activity, engineering, safety and the environment.[9] The Geological Agency carries out investigation and services in geological resources, volcanology, geological disaster mitigation, groundwater, environmental geology and geological survey, and also formulates policy on geological services.[10] The expert staff for strategic planning advise the minister on strategic planning and digital transformation.[11]
The Directorate General of Energy and Mineral Resources Law Enforcement (Direktorat Jenderal Penegakan Hukum Energi dan Sumber Daya Mineral) formulates and implements policy on law enforcement in the sector. Its functions under Pasal 25 cover the formulation, implementation, coordination, standard-setting, technical guidance and monitoring of policy on prevention, complaint handling, supervision of legal compliance, investigation, the imposition of administrative sanctions and the application of criminal law, together with support for enforcement operations.[5:1] The regulation does not itself set sanctions; it defines the unit's functions.[5:2]
Pasal 38 and Pasal 39 allow technical implementing units to be formed for operational or supporting technical tasks, established by the minister with the written approval of the minister responsible for the state apparatus.[12] In leading the ministry, the minister applies the government performance accountability system, national development risk management and national digital transformation (Pasal 40), and reports to the President on the results periodically or when needed (Pasal 42). Every unit applies coordination, integration, synchronisation and collaboration, supported by the interoperability of data and information (Pasal 44), together with the government internal control system (Pasal 45).[13] Resources are managed through electronic government systems in support of digital transformation (Pasal 48), and the ministry is funded from the state budget (Pasal 49).[14]
Under Pasal 50, later reorganisation is made by presidential regulation, on the proposal of the minister for the state apparatus, for top-level (echelon I) positions, and by ministerial regulation with that minister's written approval for echelon II and below.[15]
Under Pasal 52 existing officials continue in their posts until new positions are formed and new officials appointed. Pasal 53 keeps the implementing regulations of Perpres 97/2021 in force insofar as they do not conflict with the new regulation, and Pasal 54 revokes Perpres 97/2021. Pasal 55 brings the regulation into force on promulgation.[16][1:1]
