Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat 43/2015 (Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 43/PRT/M/2015 tentang Badan Pengatur Jalan Tol) was an Indonesian ministerial regulation that established the Toll Road Regulatory Agency (Badan Pengatur Jalan Tol, BPJT), the body through which the Minister of Public Works and Public Housing exercised part of the government's authority over toll roads. It was signed on 29 September 2015 and took effect on its promulgation on 7 October 2015.[1] It is one of the instruments on government bodies described at public administration in Indonesia.
The regulation defined BPJT as a non-structural body formed by, under and responsible to the minister, with its seat in the capital, and gave it part of the government's authority to regulate toll-road business and to supervise toll-road business entities.[2][3] It replaced the 2005 regulation on the agency and was itself revoked in April 2023 by Peraturan Menteri PUPR 6/2023.[1:1][4] CRPG's regulatory tracker published a post on it in November 2025.[5]
The regulation was issued to implement Pasal 72, 75 and 84 of Peraturan Pemerintah 15/2005 on toll roads, which by then had been amended several times, last by Peraturan Pemerintah 43/2013.[6] Its preamble records that the Minister of State Apparatus Empowerment and Bureaucratic Reform had approved the re-establishment of the organisation and working procedures of BPJT by a letter of 20 August 2015.[6:1] It also cites Peraturan Presiden 7/2015 on the organisation of state ministries, Peraturan Presiden 15/2015 on the Ministry of Public Works and Public Housing, and the ministry's own regulation on its organisation and working procedures.[6:2]
BPJT had previously been governed by Peraturan Menteri Pekerjaan Umum 295/PRT/M/2005, whose second amendment was Peraturan Menteri Pekerjaan Umum 15/PRT/M/2014; Permen PUPR 43/2015 revoked both.[1:2]
Pasal 1 defines a toll road (jalan tol) as a public road that forms part of the road network and is a national road whose users must pay a toll, and a toll-road business concession (konsesi pengusahaan jalan tol) as the fixed period given to a business entity to recover its investment and a reasonable profit. It distinguishes a closed toll-collection system, in which the user takes an entry ticket and pays at the exit gate, from an open system, in which the user pays on passing an entry or exit gate.[2:1]
Pasal 2 establishes BPJT. Pasal 3 makes it a non-structural body (badan non struktural) under and responsible to the minister in charge of public works, and Pasal 4 places its seat in the national capital.[3:1] Pasal 5 gives BPJT the power to carry out part of the government's authority in the administration of toll roads, covering the regulation and business of toll roads and the supervision of toll-road business entities, so that they bring the greatest benefit to the state for the prosperity of the people.[3:2]
Peraturan Menteri PUPR 6/2023 on the Toll Road Regulatory Agency, signed on 17 April 2023 and promulgated on 18 April 2023, revoked Permen PUPR 43/2015 in its Pasal 40. Its Pasal 39 kept BPJT's officials and staff working under the 2015 regulation until new officials and staff were appointed under the 2023 regulation.[4:1] The government regulation that Permen PUPR 43/2015 implemented, PP 15/2005, was itself revoked in 2024 by Peraturan Pemerintah 23/2024.[7]
