Peraturan Presiden 176/2024 (Peraturan Presiden Nomor 176 Tahun 2024 tentang Kementerian Agraria dan Tata Ruang) is an Indonesian presidential regulation that sets out the position, tasks, functions and organisation of the Ministry of Agrarian Affairs and Spatial Planning (Kementerian Agraria dan Tata Ruang). It was signed by President Prabowo Subianto on 5 November 2024 and took effect on its promulgation the same day, as Lembaran Negara 2024 No. 372, replacing Peraturan Presiden 47/2020 on the same ministry.^[1] It is one of the institutional instruments of forestry and land use regulation in Indonesia and of public administration in Indonesia.

The regulation defines the ministry as the one that administers government affairs in land (pertanahan) and the sub-affair of spatial planning, which it places within the public works affair.^[2] It organises the ministry into a secretariat-general, seven directorates-general, an agency for human-resource development, an inspectorate-general and five expert staff, and requires the minister to collaborate with the ministers for forestry and for marine affairs and fisheries on forestry planning and marine spatial planning.^[3][4] CRPG's regulatory tracker published an analysis of the regulation in April 2026.^[5]

¶ Background

The regulation was issued to implement Pasal 11 of Law 39/2008 on State Ministries, as amended by Undang-Undang 61/2024, and lists Peraturan Presiden 140/2024 on the organisation of state ministries among its legal bases.^[6] It was signed and promulgated on the same day as Peraturan Presiden 175/2024, which created a separate Ministry of Forestry, and the two regulations received consecutive numbers in the State Gazette.^[1:1][7]

Pasal 2 to Pasal 4 place the ministry under the President, led by the minister, who may be assisted by a deputy minister appointed by the President.^[2:1]

¶ Functions and organisation

Under Pasal 6, the ministry formulates, determines and implements policy on spatial planning, survey and mapping of land and space, the determination of rights and land registration, agrarian restructuring (penataan agraria), land acquisition and land development, the control and enforcement of land and space use, and the handling of land disputes and conflicts. The remaining functions cover technical guidance to regions, internal administration, state property, oversight and human-resource development.^[2:2]

Each of the seven substantive fields has a directorate-general under Pasal 7.^[3:1] The Directorate General of Spatial Planning is responsible for national spatial planning, guidance of regional spatial planning and synchronisation of space use.^[8] The Directorate General of Land and Space Survey and Mapping covers cadastral and basic land mapping and thematic surveys, and the Directorate General of Rights Determination and Land Registration covers the determination of land and space rights, land registration, communal rights, land held by government agencies and the supervision of land deed officials (Pejabat Pembuat Akta Tanah).^[9]

The Directorate General of Agrarian Restructuring handles land redistribution, community land empowerment, land-use management and the arrangement of coastal areas, small islands, border areas and other specified areas.^[10] The Directorate General of Land Acquisition and Land Development covers land acquisition and land reserves, land consolidation, land valuation and land economics.^[11] The Directorate General of Land and Space Control and Enforcement covers the control of space use and of the conversion of land, and enforcement against unlawful control, ownership, use and exploitation of land. ^[12] The Directorate General of Land Dispute and Conflict Handling deals with the handling and prevention of land disputes and conflicts and with land litigation.^[13] The five expert staff advise the minister on agrarian law and customary communities (masyarakat adat), bureaucratic reform, public participation and regional government, area development, and information technology and digital transformation.^[14]

¶ Working procedures and transition

Pasal 41 and Pasal 42 allow technical implementing units to be set up by the minister with the written approval of the minister for state apparatus. Pasal 43 to Pasal 50 require the minister to apply the government performance accountability system, national development risk management and national digital transformation, to set business processes between units, and to report to the President periodically and as needed, and require the ministry to prepare job and workload analyses and to support coordination through interoperable data. Pasal 51 requires the minister to collaborate with the ministers responsible for forestry and for marine affairs and fisheries when formulating and implementing policy on forestry planning (planologi kehutanan) and marine spatial planning.^[4:1]

The ministry is funded from the state budget, and changes to its organisation are made by presidential regulation for echelon I posts and by ministerial regulation, with the approval of the minister for state apparatus, for lower posts.^[15] Pasal 56 keeps existing officials in post until new posts are filled, Pasal 57 keeps the implementing rules of Perpres 47/2020 in force where consistent, and Pasal 58 revokes Perpres 47/2020.^[16][1:2]
