Undang-Undang 61/2024 (Undang-Undang Nomor 61 Tahun 2024 tentang Perubahan atas Undang-Undang Nomor 39 Tahun 2008 tentang Kementerian Negara) is an Indonesian statute that amends the 2008 law on state ministries. Enacted with the joint approval of the House of Representatives and the President, it was signed by President Joko Widodo and promulgated on 15 October 2024, and took effect on promulgation.[1][2] It is one of the statutes described at public administration in Indonesia.
The law removes the ceiling of 34 ministries set by the 2008 law and leaves the total number to the President, allows a ministry to be formed around a sub-affair or a detail of a government affair, and lets the President change, by implementing regulation, a ministry's organisational elements even where another statute names them.[3][4] It also rewrites the provision on the relationship between ministries and non-ministerial government agencies to cover non-structural and other government institutions, and deletes the elucidation of the article on deputy ministers.[3:1] Its preamble states that the 2008 law needed refinement to meet the needs of government and to follow up decisions of the Constitutional Court.[5]
Six days after it took effect, Peraturan Presiden 140/2024, which cites it as its legal basis, organised the government into 48 ministries.[6] CRPG's regulatory tracker published an analysis of the law in November 2025.[7]
Undang-Undang 39/2008 on state ministries, signed on 6 November 2008, implements the constitutional provision that ministries are formed, changed and dissolved by statute.[8][9] It sorts government affairs into three groups: foreign affairs, home affairs and defence, which the Constitution names expressly; affairs whose scope the Constitution mentions, such as religion, law, finance, health, public works and agriculture; and affairs handled to sharpen and co-ordinate government programmes, such as national development planning, the state apparatus, the environment and investment.[10] Pasal 9 sets the organisational elements of a ministry: the minister, a secretariat-general, directorates-general, an inspectorate-general, supporting agencies or centres, and, for some ministries, regional or overseas units.[11] Pasal 11 leaves the tasks, functions and organisation of ministries to presidential regulation.[11:1]
In its original form, Pasal 15 capped the total number of ministries, including co-ordinating ministries, at 34, and the general elucidation described the cap as a bureaucratic-reform measure under which the number could not be exceeded and was expected to fall.[4:1] The elucidation of Pasal 10 described a deputy minister (wakil menteri) as a career official who is not a member of the cabinet.[12]
The general elucidation of UU 61/2024 states that the amendment does not reduce the President's right to compose the ministries, and is intended to make that task easier by setting out their position, tasks, functions and organisation in line with decisions of the Constitutional Court and with the President's needs.[9:1]
The law has two articles. Pasal I makes six amendments to UU 39/2008, and Pasal II contains transitional and closing provisions.[3:2][13]
A new Pasal 6A provides that, in certain cases, a separate ministry may be formed on the basis of a sub-affair (suburusan) or a detail (perincian) of a government affair, provided it is related to the scope of the affairs listed in Pasal 5 ayat (1) to (3).[3:3] The amended Pasal 15 provides that the total number of ministries formed under Pasal 12 to 14 is set by the President according to the needs of government. The elucidation reads that phrase as meaning that each ministry is formed according to the President's policy, with attention to the alignment of government affairs between ministries and to Pasal 12 to 14 of the 2008 law.[3:4][14]
A new Pasal 9A provides that where a statute writes, lists or regulates an organisational element of the kind referred to in Pasal 9, the President may change that element in implementing regulations according to the needs of government. The elucidation gives the example of a directorate-general named in a statute, which may be converted into a separate institution or into an element of a separate institution.[3:5][14:1] Pasal II angka 2 provides that when such a change is made, the provisions of the other statute on the element, its nomenclature or the position concerned are revoked and cease to have effect.[13:1] The amendment also deletes the elucidation of Pasal 10, the article that allows the President to appoint deputy ministers where the workload requires it.[3:6][12:1]
The heading of Chapter VI is changed to cover the functional relationship between ministries and non-ministerial government agencies, non-structural institutions and other government institutions. The amended Pasal 25 requires that relationship to be conducted synergistically as one system of government. It places non-ministerial government agencies (lembaga pemerintah nonkementerian) under the President and makes them responsible to the President through the minister who co-ordinates them, unless the President decides otherwise. Non-structural and other government institutions are positioned and responsible as the President or the legislation determines, and further rules on all three are to be set by presidential regulation.[3:7] Before the amendment, Pasal 25 covered only ministries and non-ministerial agencies, and its line of responsibility through the co-ordinating minister carried no exception.[15] The elucidation defines a non-ministerial agency as a central-government institution formed to carry out particular government tasks from the President, without a steering element or collegial leadership, and reads "unless the President decides otherwise" as meaning a written direction from the President.[14:2]
Pasal II angka 1 obliges the government and the House of Representatives, through its legislation body, to monitor and review the implementation of the law no later than two years after it takes effect, under the procedure set by the law on the making of legislation. Pasal II angka 3 brings the law into force on promulgation.[13:2]
Peraturan Presiden 140/2024, signed on 21 October 2024, was issued to implement Pasal 11 of UU 39/2008 as amended by UU 61/2024. It lists 48 ministries, seven of them co-ordinating ministries, and revoked the previous regulation on the organisation of state ministries, Peraturan Presiden 68/2019.[6:1] Peraturan Presiden 90/2025, signed on 8 September 2025, added a Ministry of Hajj and Umrah to that list, bringing the number to 49; it too cites UU 39/2008 as amended by UU 61/2024.[16]
