Peraturan Presiden 85/2024 (Peraturan Presiden Nomor 85 Tahun 2024 tentang Rencana Tata Ruang Kawasan Strategis Nasional Kawasan Perkotaan Metropolitan Banjarmasin, Banjarbaru, Banjar, Barito Kuala, dan Tanah Laut) is an Indonesian presidential regulation that sets the spatial plan for the Banjarbakula metropolitan area of South Kalimantan, a national strategic area (Kawasan Strategis Nasional, KSN) designated for its importance to economic growth. It was signed by President Joko Widodo on 16 August 2024 and took effect on its promulgation the same day, as Lembaran Negara 2024 No. 175.[1] It is one of the national strategic area plans within forestry and land use regulation in Indonesia, alongside Peraturan Presiden 23/2024 for the Palembang urban area and Peraturan Presiden 123/2024 for the Subak landscape of Bali.
The plan covers 47 sub-districts in two cities and three regencies, and its coastal waters, and sets the objective of developing the area as a centre of international-scale economic activity based on sustainable development.[2][3] Like the plans for the Palembang urban area and the Subak landscape, it contains a plan for spatial structure (settlement centres and infrastructure networks), a plan for spatial pattern (protected and cultivation zones), directions for space use with a programme of main projects, and directions for controlling space use through zoning, incentives, disincentives and administrative sanctions.[4][5][6][7][8]
The plan runs for twenty years from promulgation and is reviewed once every five years. Existing regional spatial plans and space-use permits remain in force to the extent consistent with it, and it contains transitional rules on buildings along river banks.[9] CRPG's regulatory tracker published an analysis of the regulation in April 2026.[10]
The regulation was issued to implement Pasal 21 ayat (1) of Law 26/2007 on Spatial Planning and Pasal 43 ayat (4) of Law 32/2014 on Marine Affairs, both as amended by Undang-Undang 6/2023 on job creation, together with provisions of Government Regulation 26/2008 on the National Spatial Plan, as amended by Government Regulation 13/2017, and of Government Regulation 32/2019 on the Marine Spatial Plan.[11] Pasal 1 defines a national strategic area as an area whose spatial planning is prioritised because it has a very important national influence on state sovereignty, defence and security, the economy, society, culture or the environment.[12]
Pasal 4 and Pasal 5 describe the plan as a tool for putting the national spatial plan and the interregional zoning plans for the Makassar Strait and the Java Sea into operation, and as the reference for development planning, for locating investments of national strategic value, and for the spatial plans of South Kalimantan province and of the cities and regencies within the area.[3:1] The minister responsible for spatial planning, who administers the plan, heads the ministry organised by Peraturan Presiden 176/2024.[12:1][13]
Under Pasal 2, the area, called the Banjarbakula metropolitan urban area, covers 13 sub-districts of Banjar Regency, 13 of Barito Kuala Regency, all 11 of Tanah Laut Regency, and all 5 each of the cities of Banjarmasin and Banjarbaru. It is made up of core urban areas, surrounding urban areas, an environmental buffer and agricultural production area, and the coastal waters of the metropolitan area.[2:1] Pasal 3 names the city of Banjarmasin and the Banjarbaru-Martapura urban area as the core, and the urban areas of Kertak Hanyar-Gambut, Sungai Tabuk, Alalak, Marabahan, Pelaihari, Jorong and Kintap as the surrounding areas.[2:2]
Pasal 6 states the objective as an urban area serving as a centre of international-scale economic activity through trade and services, tourism, industry, marine industry and agriculture, with service centres connected between areas on the basis of sustainable development. The policies in Pasal 7 include developing the core as a centre of trade, services and public administration, designating marine growth centres, improving connectivity and infrastructure, and establishing protected functions on land and in coastal waters.[3:2]
Pasal 15 divides the structure plan into a system of settlement centres and a system of infrastructure networks, and Pasal 21 lists the networks as transport, energy, telecommunications, water resources and urban infrastructure.[4:1] The water resources network under Pasal 42 serves the conservation and use of water resources and the control of water's destructive power. It identifies surface water sources in the Barito-Kapuas and Cengal-Batulicin river territories and in the Riam Kanan and Riam Kiwa reservoirs of Banjar Regency, together with groundwater basins, and its infrastructure comprises flood control, irrigation and coastal protection systems, with the two reservoirs named for flood control.[14]
The urban infrastructure network under Pasal 43 comprises drinking water supply systems (SPAM), drainage, wastewater management, hazardous waste management and solid waste management.[15] Pasal 44 requires the drinking water systems to secure the quantity, quality and continuity of supply for residents and economic activity, names the regional Banjarbakula system and the local water utilities that serve the area, and requires drinking water supply to be integrated with the water resources network to secure raw water.[15:1] These provisions connect the plan to drinking water supply regulation and to wastewater and sanitation regulation in Indonesia.
The pattern plan in Pasal 52 allocates space to protected areas and cultivation areas on the basis of the environment's carrying capacity, and requires it to take account of disaster mitigation. Protected areas are divided into zones for areas protecting the land below them, local protection areas such as river banks, conservation areas and other protected categories.[5:1] The structure and pattern plans are mapped at a scale of 1:50,000 in the annexes.[16]
Directions for space use under Pasal 81 to Pasal 84 cover the assessment of the conformity of space-use activities (Kesesuaian Kegiatan Pemanfaatan Ruang, KKPR), development strategies and an indicative programme of main projects with locations, funding sources, implementing agencies and timing.[6:1] Directions for control under Pasal 87 comprise indicative national zoning directions, which guide regional governments in preparing zoning regulations, incentives and disincentives, sanctions and the assessment of space use.[7:1] Pasal 134 provides for administrative sanctions under the spatial planning and marine laws, ranging from written warnings and temporary suspension to revocation or cancellation of the KKPR, demolition of buildings, restoration of spatial function and administrative fines.[8:1]
Pasal 136 assigns management of the area to the minister responsible for spatial planning, the minister for marine affairs and fisheries, heads of agencies, the governor and regents and mayors according to their powers, allows the minister to act through the governor by deconcentration or co-administration, and provides for a spatial planning forum to give input.[13:1] Pasal 137 provides for public participation in planning, use and control of space.[17]
Pasal 138 fixes the plan's term at twenty years from promulgation, with a review once every five years or more often after a large-scale natural disaster, a change in national or regional boundaries or a strategic change in national policy. Pasal 139 keeps existing provincial and district spatial plans in force where consistent, keeps permits and KKPR valid until they expire, and provides that buildings already standing on river banks may not be altered and are to be brought under control to restore the river-bank function, except for water resources infrastructure, places of worship, bridges and piers, pipelines and power and telecommunications lines.[9:1]
