Peraturan Menteri Kehutanan 5/2026 (Peraturan Menteri Kehutanan Nomor 5 Tahun 2026 tentang Tata Cara Pemberian Tunjangan Kinerja bagi Pegawai di Lingkungan Kementerian Kehutanan) is an Indonesian ministerial regulation that sets the procedure for paying the performance allowance (tunjangan kinerja) to employees of the Ministry of Forestry. It was signed by the Minister of Forestry, Raja Juli Antoni, on 31 March 2026 and took effect on its promulgation on 9 April 2026.[1][2] It was issued to implement Pasal 12 of Peraturan Presiden 34/2025 on the performance allowance of the ministry's employees, and is one of the internal rules described at public administration in Indonesia.[3]
The allowance is paid monthly according to job class, at rates set in the first annex, and is measured against two components, performance achievement and attendance discipline.[4][5] The regulation fixes the ministry's working days and hours, allows flexible working by time and location, and sets deductions of up to 75 per cent for poor performance and up to 25 per cent for breaches of attendance discipline, together with deductions for certain types of leave.[6][7][8]
It replaced the performance-allowance regulation of the former Ministry of Environment and Forestry and, so far as it concerned forestry, that ministry's 2015 attendance guidelines.[9] CRPG's regulatory tracker reported it in July 2026.[10]
The performance allowance is defined in Pasal 1 as an allowance paid in central government institutions on the basis of the results of bureaucratic reform.[11] The regulation applies to pegawai, defined as civil servants and contract government employees, together with other staff appointed to a position and working full time in a unit of the ministry.[11:1] Its legal basis includes the law on state ministries as amended by Undang-Undang 61/2024, Peraturan Presiden 175/2024 on the Ministry of Forestry, Peraturan Presiden 34/2025 and the ministry's 2024 regulation on its organisation and working procedures.[3:1] The ministry is responsible for government affairs in the field of forestry.[11:2]
Under Pasal 2, the allowance is paid every month on the basis of the employee's job class (kelas jabatan). Lampiran I sets seventeen rates, from Rp2,531,250 for class 1 to Rp33,240,000 for class 17.[4:1][12] Candidate civil servants receive 80 per cent of the rate for their class. The minister receives 150 per cent of the highest allowance in the ministry and the deputy minister 90 per cent of the minister's allowance.[4:2] No allowance is paid to employees without a specific position, employees suspended or temporarily removed, employees removed from their post on waiting pay, or employees on unpaid leave or pre-retirement leave.[13]
An employee appointed as acting official, either pelaksana tugas (Plt.) where the substantive holder is permanently absent or pelaksana harian (Plh.) where the absence is temporary, receives an addition for each full calendar month: 20 per cent of the allowance of the second post where the two posts are of the same level, or the difference between the two allowances where the acting official is one level below.[13:1] Employees on study assignment receive the allowance of class 4 to class 7 according to the level of study, at half that amount during a one-year extension, and face deductions if the study is not completed.[13:2]
Pasal 11 sets two components of the allowance, performance achievement and attendance discipline. Performance is measured by the employee's performance target (sasaran kinerja pegawai, SKP) score for each quarter, which carries one of five ratings: sangat baik (very good), baik (good), butuh perbaikan (needs improvement), kurang (poor) and sangat kurang (very poor).[5:1]
The working week under Pasal 13 is five days, Monday to Friday, and 37 hours 30 minutes excluding breaks, with work starting at 07:30 local time and ending at 16:00 from Monday to Thursday and at 16:30 on Friday.[6:1] Units with special duties may set other days and hours with the approval of the Secretary General, and hours may change under presidential policies for Ramadan, national holidays and collective leave.[6:2] Employees who are not under disciplinary proceedings and are not in their first year of service may work flexibly in time, by shift or by a dynamic arrival window of up to 60 minutes that must be made up on the same day, or in location, for up to two working days a week.[6:3] Attendance is proved by the attendance record, filled in on arrival and departure, and by a daily report, both through an electronic system, with a manual form in Lampiran II for cases such as system failure or force majeure.[6:4]
Pasal 25 caps the deduction for performance at 75 per cent and that for attendance at 25 per cent of the allowance. A performance rating of cukup or needs improvement reduces the allowance by 10 per cent, a poor rating by 15 per cent and a very poor rating by 20 per cent, applied in the following quarter.[7:1] Within the attendance component, a missing daily report or late arrival and early departure attract a deduction weighted at 50 per cent, and a missing attendance record or absence without valid reason one weighted at 100 per cent. Pasal 27 ayat (3) grades lateness: 0.5 per cent for 1 to 30 minutes, 1 per cent for 31 to 60 minutes, 1.25 per cent for 61 to 90 minutes and 1.5 per cent for more than 90 minutes. Lateness or absence caused by force majeure declared by the Secretary General is not counted.[7:2] Lampiran III sets out worked examples of the calculation.[14]
Long leave, maternity leave for a fourth or later child and leave for important reasons beyond five days also reduce the allowance at rates set in Pasal 31, while annual leave and sick leave do not.[8:1] An employee who is permitted to work while an administrative appeal is pending before the civil service appeals board receives half the allowance, and the shortfall is paid back if the appeal succeeds; the allowance of an employee who dies is paid in full for that month.[15]
Pasal 37 revokes Peraturan Menteri Lingkungan Hidup dan Kehutanan P.58/Menlhk-Setjen/2015 on attendance guidelines for civil servants in the Ministry of Environment and Forestry, so far as it concerns forestry, and Peraturan Menteri Lingkungan Hidup dan Kehutanan 6/2024 on the performance allowance in that ministry. Pasal 38 brings the regulation into force on promulgation.[9:1] It was promulgated in Berita Negara 2026 No. 234.[2:1]
