Peraturan Presiden 23/2024 (Peraturan Presiden Nomor 23 Tahun 2024 tentang Rencana Tata Ruang Kawasan Strategis Nasional Kawasan Perkotaan Palembang, Betung, Indralaya, dan Kayu Agung) is an Indonesian presidential regulation that sets the spatial plan for the Patungraya Agung urban area of South Sumatra, centred on Palembang, as a national strategic area (Kawasan Strategis Nasional, KSN) designated for its importance to economic growth. It was signed by President Joko Widodo on 13 February 2024 and took effect on its promulgation the same day, as Lembaran Negara 2024 No. 36.[1] It is one of the national strategic area plans within forestry and land use regulation in Indonesia, with Peraturan Presiden 85/2024 for the Banjarbakula metropolitan area and Peraturan Presiden 123/2024 for the Subak landscape of Bali.
The plan covers 46 sub-districts in the city of Palembang and the regencies of Banyuasin, Ogan Ilir and Ogan Komering Ilir. Its stated objective combines a national centre of economic growth for southern Sumatra with the protection of food-producing land, so that the area can serve as one of the country's food barns (lumbung pangan).[2][3][4] Its water provisions rely on retention ponds, lakes, small reservoirs and river works for flood control, and on swamp irrigation.[5]
As with the plans for Banjarbakula and the Subak landscape, the regulation contains plans for spatial structure and spatial pattern, directions for space use with an indicative programme in five phases up to 2043, and directions for control through zoning, incentives, disincentives and administrative sanctions.[6][7][8][9][10] It runs for twenty years and is reviewed every five years.[11] CRPG's regulatory tracker published an analysis of the regulation in April 2026.[12]
The regulation was issued to implement Pasal 21 ayat (1) of Law 26/2007 on Spatial Planning, as amended by Undang-Undang 6/2023 on job creation, and Pasal 82 ayat (1) and Pasal 123 ayat (4) of Government Regulation 26/2008 on the National Spatial Plan, as amended by Government Regulation 13/2017.[13] Pasal 1 defines a national strategic area as an area whose spatial planning is prioritised because of its very important national influence on sovereignty, defence and security, the economy, society, culture or the environment, including areas designated as world heritage.[14]
Under Pasal 4 and Pasal 5, the plan operationalises the national spatial plan and coordinates development in the area, and guides development planning, the location of investment, and the spatial plans of South Sumatra province and of the city and regencies concerned.[15] The minister responsible for spatial planning, who administers the plan, heads the ministry organised by Peraturan Presiden 176/2024.[14:1][16]
Pasal 2 names the area the Patungraya Agung urban area and assigns it all 18 sub-districts of Palembang, 14 sub-districts of Banyuasin, 10 of Ogan Ilir and 4 of Ogan Komering Ilir. It is divided into a core urban area, surrounding urban areas, and an environmental buffer and agricultural production area. The core is the city of Palembang and part of Banyuasin II sub-district; the surrounding urban areas are parts of Betung, Tanjung Lago and Banyuasin III in Banyuasin, parts of Indralaya and Indralaya Utara in Ogan Ilir, and part of Kayu Agung in Ogan Komering Ilir.[2:1]
Pasal 6 sets the objective of a national centre of economic growth in southern Sumatra based on industry, trade and services, tourism and the creative economy, and higher education and technology, while developing the area as a national food barn with regard for environmental sustainability. Pasal 7 lists six policies, the last of which protects food-crop areas, and Pasal 13 implements it by designating sustainable food agricultural land (lahan pertanian pangan berkelanjutan), intensifying cultivation and developing supporting infrastructure, with priority given to the buffer and agricultural production area.[3:1][4:1]
Pasal 14 divides the structure plan into a system of settlement centres and a system of infrastructure networks; Pasal 18 lists the networks as transport, energy, telecommunications, water resources and urban infrastructure.[6:1] The water resources network under Pasal 42 serves the continued supply of groundwater and surface water, the conservation of water and soil, and flood control. It draws on the Musi-Sugihan-Banyuasin-Lemau inter-provincial river territory, lakes, small reservoirs (embung) and retention ponds (kolam retensi) in the area, the Tiga Dihaji dam outside it, and the Karang Agung and Palembang-Kayu Agung groundwater basins.[5:1]
The water resources infrastructure consists of flood control and swamp irrigation (irigasi rawa) systems. Flood control is to be pursued through retention ponds throughout the area, the lakes and reservoirs already named, and works on rivers, including the normalisation and bank reinforcement of the Sekanak and Lambidaro rivers in Palembang.[5:2] The urban infrastructure network under Pasal 43 comprises drinking water supply systems (SPAM), drainage, wastewater management, hazardous waste management and solid waste management; Pasal 44 lists the piped supply systems of Palembang and of the three regencies.[17] These provisions connect the plan to drinking water supply regulation and to the water resources law of Indonesia.
Pasal 52 allocates space to protected and cultivation areas on the basis of the environment's carrying capacity and with regard to disaster mitigation, and Pasal 53 groups protected areas into zones for areas protecting those below them, local protection areas, conservation areas and other protected areas.[7:1] Zone L1 is intended to prevent erosion and sedimentation, maintain the hydrological function of soil and give room for rainwater infiltration for groundwater supply and flood control.[18] The structure and pattern plans are mapped at a scale of 1:50,000.[19]
Pasal 75 to Pasal 78 set directions for space use: the conformity assessment of space-use activities (Kesesuaian Kegiatan Pemanfaatan Ruang, KKPR), issued by the minister, governor, regent or mayor according to their powers; development strategies; and an indicative programme of main projects, funded from the state and regional budgets or other lawful sources and phased in 2024, 2025 to 2029, 2030 to 2034, 2035 to 2039 and 2040 to 2043.[8:1] Pasal 81 sets the directions for control, and Pasal 120 provides for administrative sanctions ranging from written warnings to revocation or cancellation of the KKPR, demolition of buildings, restoration of spatial function and administrative fines.[9:1][10:1]
Pasal 122 allows the area to be managed by the minister, heads of agencies, the governor and regents and mayors according to their powers, with the minister able to act through the governor, and provides for a spatial planning forum. Pasal 123 provides for public participation at every stage of spatial planning.[16:1]
Pasal 124 fixes the plan's term at twenty years from promulgation, with a review once in each five-year period or more often after a large-scale disaster, a change of national or regional boundaries or a strategic change in national policy. Pasal 125 keeps existing regional spatial plans in force where consistent, keeps permits and KKPR valid until they expire, and provides that buildings already standing on river banks in settlement areas may not be altered and are to be brought under control through regional regulations, except for water resources infrastructure and certain other public facilities.[11:1]
