Peraturan Presiden 165/2024 (Peraturan Presiden Nomor 165 Tahun 2024 tentang Kementerian Pelindungan Pekerja Migran Indonesia) is the Indonesian presidential regulation that establishes the organisation of the Ministry for the Protection of Indonesian Migrant Workers. It was signed by President Prabowo Subianto and promulgated on 5 November 2024, and took effect on that date.^[1][2] It is one of the instruments on the organisation of the state described under public administration in Indonesia, issued to implement Pasal 11 of the State Ministries Law, UU 39/2008, as amended by UU 61/2024, with Perpres 140/2024 on the organisation of state ministries among its legal bases.^[2:1]

The regulation places the protection of migrant workers, a sub-affair of the government's manpower affairs, in a ministry of its own, organised in a secretariat general, four directorates general, an inspectorate general and two expert staff.^[3][4] It transferred the staff, assets, budget and documents of the Indonesian Migrant Workers Protection Agency (BP2MI) under Perpres 90/2019 to the new ministry, and revoked Perpres 90/2019.^[5]

On the same day the President signed Perpres 166/2024, which re-established BP2MI as a non-ministerial agency headed by the minister.^[6][7] CRPG's regulatory tracker published analyses of the regulation in November and December 2025.^[8][9][10]

¶ Status and functions

Pasal 1 defines the ministry as the ministry responsible for the sub-affair of protecting Indonesian migrant workers (Pekerja Migran Indonesia, PMI), which falls within government affairs in the field of manpower (ketenagakerjaan). A migrant worker is any Indonesian citizen who will work, is working or has worked for wages outside Indonesia.^[3:1] The ministry is under and answerable to the President and is led by a minister, who may be assisted by a vice-minister appointed by the President; the minister and vice-minister form a single leadership.^[11]

Under Pasal 5 and Pasal 6, the ministry formulates, sets and implements policy on the promotion and use of overseas job opportunities, the placement of migrant workers, their protection and their empowerment. It provides technical guidance and supervision on the implementation of the sub-affair in the regions, manages state property in its charge and supervises its own units.^[12]

¶ Organisation

Pasal 7 organises the ministry in eight units: the Secretariat General; the Directorate General of Promotion and Use of Overseas Job Opportunities; the Directorate General of Placement; the Directorate General of Protection; the Directorate General of Empowerment; the Inspectorate General; an expert staff for digital transformation; and an expert staff for inter-institutional relations.^[4:1] Each directorate general formulates and implements policy in its field, provides technical guidance and supervision, and monitors, evaluates and reports on its work. The Directorate General of Promotion also covers the capacity building of migrant workers.^[13] The Inspectorate General conducts internal supervision through audits, reviews, evaluations and monitoring, and the expert staff give the minister recommendations on strategic issues in their fields.^[14]

The minister may establish technical implementing units with the written approval of the minister responsible for the state apparatus. Further organisational changes are made by presidential regulation for echelon I posts and by ministerial regulation, with the same approval, for echelon II posts and below.^[15][16]

¶ Working procedures and funding

The minister must apply the government performance accountability system, national development risk management and national digital transformation, and must report to the President on the sub-affair regularly and when needed.^[17] Units of the ministry apply the principles of coordination, integration, synchronisation and collaboration, supported by the interoperability of data and information, and the government internal control system.^[18] The ministry's human resources, finances and records are managed through the electronic-based government system, and its work is funded from the state budget.^[19]

¶ Transition and revocation

Pasal 43 kept all posts and officials of BP2MI under Perpres 90/2019 in place until new posts were created and new officials appointed under the regulation. Pasal 44 made BP2MI's staff the ministry's staff, and its assets, budget and documents the ministry's assets, budget and documents. Pasal 45 revoked Perpres 90/2019, and Pasal 46 brought the regulation into force on promulgation.^[5:1][1:1]

BP2MI itself was re-established by Perpres 166/2024 as a non-ministerial government agency headed by the Minister for the Protection of Indonesian Migrant Workers, which carries out its tasks with the units and resources of the ministry.^[6:1] The same model of a minister heading an agency was used for the creative economy in Perpres 200/2024, signed three days later.^[20]
