Peraturan Presiden 166/2024 (Peraturan Presiden Nomor 166 Tahun 2024 tentang Badan Pelindungan Pekerja Migran Indonesia) is the Indonesian presidential regulation on the Indonesian Migrant Workers Protection Agency (Badan Pelindungan Pekerja Migran Indonesia, BP2MI). It was signed by President Prabowo Subianto and promulgated on 5 November 2024, and took effect on that date.^[1][2] It is one of the instruments on the organisation of the state described under public administration in Indonesia, issued to implement Pasal 11 of the State Ministries Law, UU 39/2008, as amended by UU 61/2024, with Perpres 140/2024 among its legal bases.^[2:1]

The regulation organises BP2MI as a non-ministerial government agency (Lembaga Pemerintah Non Kementerian) answerable to the President, but makes the Minister for the Protection of Indonesian Migrant Workers its head and the vice-minister its deputy head. The agency works through the units and resources of the ministry created on the same day by Perpres 165/2024.^[3][4][5][6]

BP2MI's fifteen functions run from implementing placement and protection policy and issuing recruitment permits to the reintegration and empowerment of returning workers. The agency also sets rules on standard employment agreements, placement costs and the processes required before departure.^[7] CRPG's regulatory tracker reported the regulation in November and December 2025.^[8][9][10]

¶ Background

BP2MI had been organised under Perpres 90/2019. Perpres 165/2024 created a Ministry for the Protection of Indonesian Migrant Workers, transferred BP2MI's staff, assets, budget and documents to it, and revoked Perpres 90/2019.^[6:1] Perpres 166/2024, signed the same day, re-established the agency on a new basis, and kept in force the implementing regulations issued under Perpres 90/2019 insofar as they do not conflict with it.^[11]

¶ Status and functions

Pasal 1 defines BP2MI as a non-ministerial government agency that carries out government tasks in the protection of Indonesian migrant workers (Pekerja Migran Indonesia, PMI), meaning any Indonesian citizen who will work, is working or has worked for wages outside Indonesia. The agency is under and answerable to the President and is led by a head; its task is to carry out government tasks in migrant worker protection in accordance with the law.^[3:1]

Pasal 4 ayat (1) lists fifteen functions. They cover implementing policy on the placement and protection of migrant workers; providing services and protection; issuing and revoking recruitment permits (surat izin perekrutan); organising placement services; supervising social security services; fulfilling migrant workers' rights; verifying their documents; placement under written agreements between the central government and the government of an employing country or an incorporated employer in the destination country; revoking and extending the licences of placement companies; and the placement of workers.^[7:1] They also cover protection while working, in coordination with Indonesian diplomatic missions in the destination country; facilitation, rehabilitation and reintegration of returned workers; the social and economic empowerment of returned workers and their families; and internal coordination and supervision.^[7:2] Under Pasal 4 ayat (2), BP2MI also drafts and sets regulations on standard employment agreements and their signing and verification, on placement costs, and on the processes required before a worker starts work.^[7:3]

¶ Organisation

Pasal 5 fills the agency's leadership from the ministry: the head is the Minister for the Protection of Indonesian Migrant Workers and the deputy head is the vice-minister, and the agency's technical echelon I units are the ministry's echelon I units with corresponding tasks.^[4:1] The head and deputy head form a single leadership; the deputy is appointed by the President and assists the head in formulating and implementing policy and in coordinating strategic policy across the agency's senior units.^[12] Pasal 18 requires BP2MI to carry out its tasks using the units and resources of the ministry whose tasks correspond, and Pasal 19 funds it from the state budget.^[5:1] The same arrangement, under which a minister heads a non-ministerial agency, was applied three days later to the creative economy in Perpres 200/2024, under which the Minister of Creative Economy heads the Creative Economy Agency.^[13]

¶ Working procedures

The regulation refers to the head as "Minister/Head" (Menteri/Kepala). The head applies the government performance accountability system, national development risk management and national digital transformation, sets the business processes between the agency's units, and reports to the President regularly and when needed.^[14] Units apply the principles of coordination, integration, synchronisation and collaboration, supported by interoperable data, and the government internal control system, and resources are managed through the electronic-based government system.^[15] Further organisational changes are made by presidential regulation for echelon I posts and by regulation of the Minister/Head, with the written approval of the minister responsible for the state apparatus, for lower posts.^[16]

CRPG's regulatory tracker reported Perpres 166/2024 together with Perpres 165/2024 on 22 November 2025, and published analyses of the agency's institutional framework on 26 November 2025 and of its mandate on 5 December 2025.^{[8:1][9:1][10:1]}
