Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat 9/2020 (Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 9 Tahun 2020 tentang Pembentukan Lembaga Pengembangan Jasa Konstruksi) is an Indonesian ministerial regulation that establishes the Construction Services Development Board (Lembaga Pengembangan Jasa Konstruksi, LPJK) as a single national body and sets its tasks, board, secretariat, funding and supervision. It was signed by the Minister of Public Works and Public Housing on 30 March 2020 and took effect on its promulgation on 6 April 2020, to implement Pasal 84 ayat (9) of Undang-Undang 2/2017 on construction services.[1][2] It belongs to the body of rules on the organisation of government bodies described at public administration in Indonesia.

The regulation makes LPJK a non-structural body answerable to the minister, charged with registration, accreditation, the appointment of expert assessors, the formation of professional certification bodies, licensing and the recognition of foreign construction workers.[3] Its board of at most seven members is drawn from accredited associations, the users of construction services and universities or experts, and is appointed by the minister with the approval of the House of Representatives.[4]

The regulation dissolved the national and provincial boards that had operated under the 2000 government regulation on the construction services community once the new board was appointed, and revoked the 2015 ministerial regulation that had governed their selection and work.[5]

Background

Pasal 84 of the 2017 construction services law provided that the exercise of part of the central government's authority should involve the construction services community, through one institution formed by the minister, and that fees charged by that institution would be non-tax state revenue; ayat (9) of the article left the detail, including the formation of the institution, to a ministerial regulation, which this instrument supplied.[1:1][6] Before it, construction services development had been carried out by a national LPJK and provincial LPJKs constituted under Peraturan Pemerintah 28/2000 on the business and role of the construction services community, as last amended by Peraturan Pemerintah 92/2010, with their selection and working methods set by Peraturan Menteri PUPR 51/PRT/M/2015.[5:1]

Pasal 2 states that the regulation is intended for the formation, guidance and supervision of LPJK, and that its aim is to increase the participation of the construction services community through an LPJK that is of good quality, responsible and accountable.[7]

Status, tasks and functions

Pasal 4 to 6 establish LPJK as a non-structural body (lembaga nonstruktural) under and answerable to the minister, seated in the national capital.[3:1] Pasal 7 gives it the tasks of registration, accreditation, the appointment of expert assessors (penilai ahli), the formation of professional certification bodies, licensing and equivalence in construction services.

Pasal 8 spells these out as functions. LPJK registers construction business entities and their experience, construction workers and their professional experience, construction training institutions and expert assessors. It accredits associations of construction businesses, of construction professionals and of the construction supply chain. It trains, tests and certifies expert assessors and appoints a registered team of them when a building fails (kegagalan bangunan). It recommends professional certification bodies (Lembaga Sertifikasi Profesi, LSP) for licensing, forms an LSP itself where no association or training body can certify a field, licenses the certification bodies for construction businesses (LSBU), recognises foreign construction workers, and manages the application for continuing professional development.[3:2] Under the definitions, an LSP is licensed by the National Professional Certification Agency on the minister's recommendation, whereas LPJK itself licenses an LSBU.[7:1]

Board

The board (pengurus) consists of a chair and members, in an odd number and at most seven. Members come from accredited associations of construction businesses, accredited associations of construction professionals, institutions that use construction services, whether government or private, and universities or experts; accredited supply-chain associations may also be represented. The minister appoints the board after obtaining the approval of the House of Representatives (Dewan Perwakilan Rakyat), and the first board had to be appointed by December 2020 at the latest. The minister also designates the chair, and members serve four-year terms.[4:1]

A selection committee set up by the minister runs a fit and proper test comprising a psychological assessment by an independent psychology institution and a substantive assessment through a written examination, a short paper and an interview. It proposes to the minister twice as many passing candidates as there are seats, and the minister submits twice the number of seats to the House of Representatives.[8] Each accredited association may nominate at most one candidate.[8:1]

Pasal 19 sets the qualifications. Candidates may not be officers or members of a political party and may not hold office in an association while on the board. The age limit at registration is 55 for candidates from government user institutions and 65 for others, and government candidates must give up their structural posts. No one may serve more than two terms, and association and user-institution candidates need at least ten years of construction experience.[9]

Secretariat, funding and supervision

A secretariat in the ministry supports LPJK. It answers to the chair on technical and operational matters and to the director general responsible for construction services on administrative ones, and is headed ex officio by the secretary of that directorate general. It consists of an administration section and functional-position groups.[10]

LPJK and its secretariat are funded from the ministry's state budget and other lawful sources, and fees charged to the public for LPJK services are non-tax state revenue (penerimaan negara bukan pajak).[11] The minister provides guidance and supervision, may assign the unit responsible for construction services to provide guidance, and may form a supervisory team.[11:1]

Transition and revocation

The national and provincial LPJKs constituted under PP 28/2000 continued certification and registration until the minister appointed the new board, and were dissolved on that appointment.[5:2] Their information systems and key documents passed to the minister on the appointment, and other assets belonging to the ministry or to regional governments had to be returned within six months of it.[5:3] Pasal 41 revoked Permen PUPR 51/PRT/M/2015 (Berita Negara 2016 No. 7), and Pasal 42 brought the regulation into force on promulgation.[5:4][2:1]

Relationship to other instruments

The Job Creation regulation in lieu of law, Perppu 2/2022, later rewrote Pasal 84 of the 2017 construction services law, the provision this regulation implements. As rewritten, the article provides that the participation of the construction services community takes place through one institution formed by the central government, where the 2017 text had named the minister. Perppu 2/2022 was enacted as law by Undang-Undang 6/2023.[12] The Toll Road Regulatory Agency, reconstituted by Permen PUPR 6/2023, is another non-structural body placed under and answerable to the same minister.[13]

CRPG's regulatory tracker published an analysis of the regulation on 26 November 2025.[14]
