Peraturan Presiden 46/2026 (Peraturan Presiden Nomor 46 Tahun 2026 tentang Perubahan atas Peraturan Presiden Nomor 17 Tahun 2018 tentang Penyelenggaraan Penanggulangan Bencana dalam Keadaan Tertentu) is an Indonesian presidential regulation that amends the rules under which the National Disaster Management Agency may conduct disaster management in "certain circumstances" (keadaan tertentu), outside or after a declared disaster emergency. It was signed by President Prabowo Subianto and promulgated in Jakarta on 16 July 2026, in State Gazette 2026 No. 83, and took effect on promulgation.[1] It belongs to the disaster-management part of public administration in Indonesia, whose statute is UU 24/2007.

The regulation has two articles. Pasal I replaces Pasal 3 of Perpres 17/2018, keeping three of its four paragraphs unchanged and rewriting the conditions in paragraph (2). The new text names natural, non-natural and social causes of the disaster threat, joins the conditions with "and/or", and adds a third condition covering regions in post-social-conflict reconciliation whose fiscal capacity is very low or low.[2][3] Pasal II brings the regulation into force on promulgation.[1:1] CRPG's regulatory tracker reported the amendment on 9 October 2026.[4]

Background

Perpres 17/2018 was signed by President Joko Widodo on 19 March 2018 and promulgated on 22 March 2018.[5] It defines keadaan tertentu as a situation in which the status of disaster emergency has not been declared, or has ended or not been extended, but action is still needed to reduce the risk of disaster and its wider impact.[6] Emergency status is declared by the President at national level, by the governor at provincial level and by the regent or mayor at district or city level.[7] Under UU 24/2007 the agency (Badan Nasional Penanggulangan Bencana, BNPB) and the regional disaster management agencies receive facilitated access (kemudahan akses), covering among other things the deployment of personnel, equipment and logistics, licensing, and procurement, once emergency status has been declared.[8] Pasal 3 of Perpres 17/2018 allows the Head of the BNPB to conduct disaster management, including that facilitated access, in certain circumstances.[3:1]

The preamble of Perpres 46/2026 states that in certain circumstances action is, or is still, needed to reduce the risk of disaster and/or social conflict, so that the BNPB must be given the assignment and authority to conduct disaster management. It records that Perpres 17/2018 did not comprehensively regulate disaster management where an area is affected by social conflict, given the dynamics and legal needs of society, and so had to be amended.[9] UU 24/2007 already treats social conflict between groups or communities as a form of social disaster (bencana sosial).[10]

Provisions

Under the amended Pasal 3, the Head of the BNPB may, in certain circumstances, conduct disaster management, including facilitated access in emergency response, up to a set time limit, after a decision of an inter-ministerial coordination meeting led by the coordinating minister responsible for disaster management.[2:1] This paragraph repeats the 2018 text.[3:2]

Paragraph (2) now allows that power to be used where there is a potential disaster at the maximum threat level caused by natural, non-natural and/or social factors; where evacuation, rescue or displacement has occurred, or public services have been disrupted with wide effect on the social and economic life of the community; and/or where a regional government's area is in a process of post-social-conflict reconciliation and its fiscal capacity is very low or low under the laws on state finance.[2:2] The 2018 paragraph listed only the first two conditions, joined by "and", and did not name the causes of the threat.[3:3]

Paragraphs (3) and (4) are unchanged. Disaster management under the article, including facilitated access, must follow the laws and regulations, and the conditions and procedures are left to guidelines issued by the Head of the BNPB.[2:3][3:4]

Relationship to other instruments

The regulation is made under Pasal 4 ayat (1) of the 1945 Constitution, UU 24/2007, Peraturan Pemerintah 21/2008 on the conduct of disaster management, Peraturan Pemerintah 22/2008 on disaster funding and aid management, and Perpres 17/2018 itself.[9:1] It amends only Pasal 3 of Perpres 17/2018; the definitions, the rules on declaring emergency status and the remainder of the 2018 regulation continue in force.[2:4][7:1]
