Peraturan Presiden 200/2024 (Peraturan Presiden Nomor 200 Tahun 2024 tentang Badan Ekonomi Kreatif) is the Indonesian presidential regulation on the Creative Economy Agency (Badan Ekonomi Kreatif, Bekraf). It was signed by President Prabowo Subianto and promulgated on 8 November 2024, and took effect on that date.[1][2] It is one of the instruments on the organisation of the state described under public administration in Indonesia, issued to implement Pasal 11 of the State Ministries Law, UU 39/2008, as amended by UU 61/2024, with Perpres 140/2024 among its legal bases.[2:1]
The regulation establishes Bekraf as a non-ministerial government agency answerable to the President and headed by the Minister of Creative Economy, with the vice-minister as deputy head and the ministry's secretary as the agency's principal secretary. Its technical work is divided among four deputies, for the strategic development of the creative economy, cultural creativity and design, digital and technology creativity, and media creativity.[3][4]
The regulation separated the creative economy from tourism. It transferred the tourism functions, staff, assets and documents of the Tourism and Creative Economy Agency under Perpres 97/2019 to the Ministry of Tourism, and revoked Perpres 96/2019 and Perpres 97/2019 in so far as they concern the creative economy.[5] CRPG's regulatory tracker reported the regulation in November and December 2025.[6][7]
Pasal 1 defines Bekraf as a non-ministerial government agency (Lembaga Pemerintah Non Kementerian) carrying out government tasks in the creative economy. It is under and answerable to the President, is led by a head, and carries out government tasks in the creative economy in accordance with the law.[3:1] Pasal 4 gives it nine functions. It formulates, sets and implements technical policy in its four fields; coordinates and synchronises the implementation of that policy; drafts norms, standards, procedures and criteria (norma, standar, prosedur, dan kriteria); provides technical guidance and supervision; and provides administrative and substantive support to its units and supervises them.[3:2]
Pasal 5 organises the agency in a head, a deputy head, a Principal Secretariat (Sekretariat Utama) and four deputies: for the strategic development of the creative economy, for cultural creativity and design, for digital and technology creativity, and for media creativity.[4:1] The head is the Minister of Creative Economy, the deputy head is the Vice-Minister of Creative Economy, and the Principal Secretary is the Secretary of the Ministry of Creative Economy; the regulation accordingly refers to the head as "Minister/Head" (Menteri/Kepala).[4:2]
Each deputy formulates and implements technical policy in its field, drafts norms and standards, provides guidance and supervision, and monitors and reports on its work. The deputy for strategic development also coordinates and drafts the master plan for the creative economy (rencana induk ekonomi kreatif) and harmonises technical policy in its field.[8] An inspectorate conducts internal supervision and reports to the Minister/Head through the Principal Secretary.[9]
The regulation caps the size of the organisation. The Principal Secretariat may have at most five bureaus, and each deputy a secretariat and at most five directorates. Bureaus, directorates and centres consist of functional and administrative positions, and smaller structural units (sections, subdirectorates and fields) may be formed only where functional positions cannot carry out the work, within fixed maxima.[10] Technical implementing units may be established with the written approval of the minister responsible for the state apparatus.[11]
The Minister/Head applies the government performance accountability system, national development risk management and national digital transformation, sets the business processes between units, and reports to the President regularly and when needed.[12] Units apply the principles of coordination, integration, synchronisation and collaboration, supported by interoperable data, and the government internal control system; resources are managed through the electronic-based government system, and the agency is funded from the state budget.[13] Further organisational changes are made by presidential regulation for echelon I posts and by regulation of the Minister/Head, with the approval of the minister responsible for the state apparatus, for lower posts.[14]
Pasal 48 kept the posts and officials of the Tourism and Creative Economy Agency (Badan Pariwisata dan Ekonomi Kreatif) under Perpres 97/2019 in place until new posts were created and new officials appointed. Pasal 49 allowed Bekraf and the Ministry of Tourism to continue using that agency's staff, assets, budget and documents according to their tasks.[5:1] Pasal 50 and Pasal 51 transferred the tourism functions previously exercised under Perpres 96/2019 on the Ministry of Tourism and Creative Economy and Perpres 97/2019 to the Ministry of Tourism, together with the related staff, assets, budget and documents.[5:2] Pasal 52 kept the implementing regulations of both instruments in force in so far as they do not conflict with the new regulation, and Pasal 53 revoked both in so far as they concern the creative economy.[5:3]
Three days earlier, Perpres 166/2024 had applied the same model to migrant worker protection, making the Minister for the Protection of Indonesian Migrant Workers the head of the Indonesian Migrant Workers Protection Agency.[15] CRPG's regulatory tracker published an analysis of the agency's structure on 26 November 2025 and an analysis of its establishment as a separate body on 5 December 2025.[6:1][7:1]
