Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat 20/2021 (Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 20 Tahun 2021 tentang Bangunan Gedung Fungsi Khusus) is an Indonesian ministerial regulation on special-function buildings (bangunan gedung fungsi khusus, BGFK): buildings whose function calls for a high level of secrecy and security in the national interest, or whose operation may endanger the surrounding community or carries a high risk. It was signed by the Minister of Public Works and Public Housing on 31 March 2021 and took effect on its promulgation on 1 April 2021, to implement Pasal 105 of Peraturan Pemerintah 16/2021 on buildings.[1][2]
The regulation sets the criteria and types of such buildings, the procedure by which the minister designates a building as one and revokes the designation, and the technical standards they must meet. Special-function buildings are administered by the central government: a service unit of the ministry issues their building approvals and certificates, inspects them during construction and use, and handles their demolition, and the minister may delegate part of this work to provincial governors.[3][4][5] It forms part of the licensing and administrative rules described at public administration in Indonesia. The regulation runs to 134 articles and an annex.[2:1]
Pasal 1 defines a special-function building as one that, because of its function, has a high level of secrecy and security for the national interest, or whose operation may endanger the surrounding community and/or carries a high risk of danger.[3:1] Pasal 3 turns this into four criteria, any of which may apply: a special function or high secrecy in the national interest, such as buildings with a strategic role in setting state policy or those of Indonesian missions abroad; operation that may endanger the community, framed as activities that could spread deadly viruses or microbes widely; special requirements needing high technology, such as specialist experts, materials, equipment or construction methods; and a high risk of explosion and fire.[6]
Pasal 4 lists the types: presidential palaces; nuclear installations, meaning reactors and fuel enrichment, fabrication, reprocessing and storage facilities; defence installations, such as military bases, combat training areas and weapons, radar, missile and ammunition installations; security installations, meaning forensic laboratories and ammunition depots; buildings of Indonesian missions abroad; and other buildings of a similar kind designated by the minister.[6:1]
The minister designates a special-function building by ministerial decision on the recommendation of the Director General of Human Settlements (Cipta Karya). A designation may follow a proposal by a ministry, agency or incorporated non-government owner, or the service unit's own identification, and regency and city governments may inform the unit of buildings in their areas that appear to meet the criteria. The decision lists each building with its name, type, location, number of storeys and floor area.[7][3:2] A designation of a building with a high level of secrecy must be kept confidential and not published, and such a building may be exempted from the listing of general data by agreement with the ministry or agency concerned.[7:1] The minister revokes the status, by the same kinds of procedure, when a building no longer meets the criteria.[8]
A special-function building must meet the general building planning and design standards, special technical planning and design standards, and security standards for its special function.[9] The special technical standards, set by the ministry or agency responsible for the function, cover site selection in the light of natural hazards and spatial plans, safety radii for nearby housing, security perimeters and technical specifications. The security standards, set by the same bodies, must at least provide for detection and monitoring systems, an in-building security team and standard security procedures at every stage from design to demolition.[9:1]
Pasal 25 lists the services: building approval (Persetujuan Bangunan Gedung, PBG), inspection during construction, approvals and certificates for existing buildings, inspection during use, extension of the certificate of functional worthiness (Sertifikat Laik Fungsi, SLF) and administration of the building ownership certificate (Surat Bukti Kepemilikan Bangunan Gedung, SBKBG), demolition, and inspection during demolition. The ministry's service unit, the Unit Layanan BGFK, delivers them all through the national building management information system (SIMBG).[4:1] Buildings of Indonesian missions abroad that must follow local building rules do so, and the local permits are registered in SIMBG as equivalent to Indonesian approvals.[4:2]
A building approval is to be processed within 48 working days, or in three phases for a phased approval, and the central panel of experts (TPA Pusat), appointed by the minister, examines the technical plans.[4:3][10][11] Building inspectors (Penilik BGFK) appointed by the minister inspect construction, and the minister, or the director general by delegation, issues the SLF and SBKBG for a new building free of charge within three working days of the upload of the supervisor's statement of functional worthiness, with a copy to the regency or city government.[12][13][14] During use, the unit inspects as needed, including on an application to extend the SLF, on a public report, or where a building appears to have changed function or to endanger its surroundings.[15] Demolition proceeds either by approval on the owner's initiative or by an order where the building is no longer fit and cannot be repaired, endangers people or the environment, or the owner has ignored inspection findings.[16]
The minister holds the authority over special-function buildings, is assisted by the director general, and may delegate part of it to governors by deconcentration, either for some types of building or for some stages, with provincial technical agencies carrying out the delegated work.[5:1][17] The ministry funds the service from the state budget, while owners and managers fund identification, design, construction, supervision, maintenance, conservation and demolition of their buildings.[18] The director general provides guidance to ministries and agencies responsible for the special functions, provincial governments, construction service providers, and owners and managers.[19] Until the service unit was formed, the director general performed its tasks.[20]
The regulation was signed and promulgated on the same days as Permen PUPR 21/2021 on green building performance assessment, which implements another provision of the same government regulation.[2:2][21] The Job Creation regulation in lieu of law, Perppu 2/2022, enacted as law by Undang-Undang 6/2023, amends the buildings law, Undang- Undang 28/2002, to ease the process of obtaining building approvals and certificates of functional worthiness.[22]
CRPG's regulatory tracker published an analysis of the regulation on 26 November 2025.[23]
