Peraturan Menteri Pekerjaan Umum 10/2010 (Peraturan Menteri Pekerjaan Umum Nomor 10/PRT/M/2010 tentang Tata Cara Pemilihan Pengurus, Masa Bakti, Tugas Pokok dan Fungsi, serta Mekanisme Kerja Lembaga Pengembangan Jasa Konstruksi) was an Indonesian ministerial regulation that governed the Construction Services Development Board (Lembaga Pengembangan Jasa Konstruksi, LPJK): how its governing board was selected, the length of the board's term, the board's tasks and functions, and the way the board worked. It was signed by the Minister of Public Works, Djoko Kirmanto, on 24 September 2010 and applied from that date.[1] It was issued to implement Pasal 25 ayat (3) and Pasal 27 ayat (2) of Peraturan Pemerintah 4/2010, which amended Peraturan Pemerintah 28/2000 on construction business and community participation.[2] It belongs to the body of rules on the institutions of government surveyed at public administration in Indonesia.

The regulation built the board from four stakeholder groups (kelompok unsur), namely company associations, professional associations, universities or experts, and government, each represented by up to four members at national level and two at provincial level, chosen after a fit-and-proper test and confirmed by the minister or the governor for a four-year term.[3][4] It gave the board the tasks of research and development, education and training, registration of construction workers and construction firms, and promotion of arbitration, mediation and expert assessment.[5] After a second amendment in 2015, it was revoked by Permen PUPR 51/PRT/M/2015, which was itself revoked in 2020 by Permen PUPR 9/2020.[6][7]

Background

The LPJK was the organisation of the construction services community provided for in Peraturan Pemerintah 4/2010.[8] The regulation's annex records that the board was founded on the 1945 Constitution and on Undang-Undang 18/1999 on construction services and its implementing regulations, and that its purpose was a sound, reliable and competitive construction industry, orderly construction work with equal standing between the users and providers of services, and more effective community participation.[9] Pasal 2 describes the regulation as a guide to the selection of the board, its term, its tasks and functions, its working methods and the funding of its secretariat.[10]

The regulation has six articles and two annexes. Lampiran I sets out the selection procedure, term, tasks, functions and working mechanism of the board; Lampiran II sets out the organisation of the board, its certification units and its secretariat.[10:1]

Board and selection

Lampiran I sets the conditions under which associations, universities, experts and government agencies qualify as members of a stakeholder group, at national and at provincial level. A national contractors' association, for example, had to have its head office in the capital, a membership of at least 200 firms in each province and branches in at least 17 provinces.[11] The minister determines, for each board period, which associations, universities, experts and agencies qualify.[12]

For the national board, the minister, or an official on the minister's behalf, organises recruitment in seven stages. Each stakeholder group, meeting as a Rapat Kelompok Unsur, nominates up to eight candidates for a fit-and-proper test; a testing team of ministry representatives and professionals qualified in psychological assessment examines them through a written test, a scientific paper on construction services, an interview and a psychological assessment, and sends its recommendations to the minister, who passes them to each group; each group then chooses up to four representatives; the first board meeting elects the chair and three vice-chairs, who must come from groups other than the chair's; and the minister confirms (mengukuhkan) the board, of at most sixteen members.[3:1][13] Provincial boards follow the same steps with up to four candidates and two representatives per group, at most eight members in all, and are confirmed by the governor.[3:2]

Board members had to be Indonesian citizens with at least upper-secondary education, meet the competence requirements measured by the fit-and-proper test, not chair a construction association at the same time, not be serving a criminal sentence, and not have served more than one previous term. Once elected, they were to act for the construction sector as a whole rather than for the group that nominated them.[14] The term of office was four years. A seat fell vacant on the expiry of the term, death, prolonged absence, resignation approved by the member's group, a final criminal conviction or removal, and was filled for the rest of the term by a replacement put forward by the same group.[4:1]

Tasks and powers

The board's five principal tasks were to conduct and encourage research and development in construction services, to run education and training, to register construction workers (covering classification, qualification and certification of skills and expertise), to register construction firms, and to promote arbitration, mediation and expert assessment.[5:1] The national board set capability standards for firms and workers, registered large firms and senior experts, gave equivalence to the certificates of foreign experts and registered foreign firms, supervised the certification units, and prepared model tender documents and contracts; provincial boards registered medium and small firms and junior, intermediate and skilled workers in their regions.[15]

The national board could establish certification units, license the units established by provincial boards or by the construction community, and sanction licensed units and service providers that breached its rules.[16] Applications for registration went first to an association for initial verification, then to the secretariat for a completeness check and to a certification unit for assessment, before the board meeting recorded the result in the Registration Book and the secretariat issued the certificate; firm registration ran in four three-month periods each year.[17]

The board could draw its funds from fees for its services, contributions from its members and lawful assistance from third parties that carried no conditions, and the government funded the activities of its secretariat.[18] Board meetings were to be held as needed, meetings of each stakeholder group at least once a year, and, at national level, a national coordination meeting at least once a year.[19]

Transition, amendment and revocation

Pasal 5 required the board appointed before the regulation to wind up the board's previous articles of association and facilitate the formation of a new board, allowed certificates expiring after Peraturan Pemerintah 4/2010 to be extended once, and required the new national and provincial boards to be confirmed by December 2011 at the latest; the existing boards remained in office until then.[12:1]

The regulation was amended more than once, the last time by a second amendment, Nomor 36/PRT/M/2015. Permen PUPR 51/PRT/M/2015, enacted on 15 December 2015 and promulgated on 5 January 2016, revoked it together with its amendments and kept the boards confirmed under it in office until new boards were confirmed.[6:1] Permen PUPR 51/PRT/M/2015 was in turn revoked by Permen PUPR 9/2020 on the formation of the LPJK, issued to implement Pasal 84 ayat (9) of Undang-Undang 2/2017 on construction services.[7:1] CRPG's regulatory tracker published a note on the regulation in November 2025.[20]
